If you miss jury duty in Nevada, the court will order you to appear at a show-cause hearing and explain why. If your reason isn’t satisfactory, you can be held in contempt and fined up to $500 in state district court, up to $100 in justice court, or up to $1,000 plus as much as three days in jail if the summons came from federal court. Most people who contact the court on their own and offer a legitimate reason get rescheduled rather than penalized.
What the Court Does After a No-Show
Nevada’s rule is simple. If you were summoned to district court and didn’t appear without being excused, the court orders you to come in and explain the absence. That’s the show-cause hearing. If you cannot give a satisfactory reason, the court holds you in contempt and imposes a fine of up to $500.1Nevada Legislature. Nevada Revised Statutes Section 6.040 – Penalty for Failing to Attend and Serve as a Juror
The statute doesn’t spell out what happens if you ignore the show-cause order too, but courts have broad authority to enforce their own orders. Continuing to ignore every notice raises the realistic possibility of a bench warrant. That escalation is uncommon for someone who responds, and routine for someone who doesn’t.
How Much You Can Be Fined
The penalty depends on which court summoned you.
District court. Up to $500, following a contempt finding at the show-cause hearing.1Nevada Legislature. Nevada Revised Statutes Section 6.040 – Penalty for Failing to Attend and Serve as a Juror
Justice court. A separate statute governs this lower court, and the penalty is lighter: a juror who fails to appear without a reasonable excuse can forfeit up to $100, which the district attorney can recover in court.2Nevada Public Law. Federal court. If your summons came from a U.S. District Court in Nevada, federal law lets the court fine you up to $1,000, sentence you to up to three days in jail, order community service, or impose any combination of those penalties.3Office of the Law Revision Counsel. 28 USC 1866 – Selection and Summoning of Jury Panel You still get a chance to show good cause first.
Federal jury pools also work differently. Prospective federal jurors are typically on call for a three-month window rather than a single day, so “missing” federal jury duty can mean failing to stay available during that whole period. Read your federal summons carefully.
What to Do if You’ve Already Missed
Contact the court. Today, if possible. Call the jury commissioner or jury services number listed on your summons, explain what happened, and ask what they need from you. Courts handle no-shows constantly, and most are willing to work with people who reach out on their own before enforcement starts.
If a show-cause hearing is scheduled, treat it as the serious proceeding it is. Bring documentation: a doctor’s note, hospital records, proof of a family emergency, travel records, anything that supports your reason. The judge is deciding whether your absence was willful defiance of a court order or an honest problem. Documents answer that question better than words.
For a first-time miss, many courts will simply reschedule your service to a later date instead of fining you. The people who get rescheduled are almost always the ones who called first.
Reasons the Court Will Accept
Nevada courts can excuse you from a particular service date for several reasons:4Nevada Legislature. Nevada Revised Statutes Chapter 6 – Juries
- Illness or physical disability that prevents you from serving.
- A serious illness or death in your immediate family.
- Undue hardship or extreme inconvenience, including financial hardship or caregiving conflicts.
- Public necessity, where your absence from work would harm public welfare.
- Serving as the primary around-the-clock caregiver for someone with a documented medical condition.
A temporary excuse doesn’t erase your obligation. The court will direct you to appear on a future date. A permanent physical or mental disability can qualify you for a permanent excuse, but the court may require a certificate from a physician or advanced practice registered nurse describing the condition.4Nevada Legislature. Any of these reasons can also work as the “good cause” you offer at a show-cause hearing after a missed date, provided you can document it.
Your Job Is Legally Protected
If you missed jury duty because you were afraid of losing your job, that fear is unfounded under Nevada law. An employer who fires you, threatens to fire you, or hints that jury service will cost you your job is committing a gross misdemeanor.4Nevada Legislature. Nevada Revised Statutes Chapter 6 – Juries
You can also sue. Remedies include reinstatement with no loss of seniority, lost wages and benefits, reasonable attorney’s fees, and punitive damages up to $50,000.4Nevada Legislature. Nevada Revised Statutes Chapter 6 – Juries
The protections are specific. Your employer cannot require you to use sick leave or vacation time for jury duty. If you’re reporting for jury duty, your employer cannot schedule you to work within the 8 hours before your reporting time. And if your jury service runs 4 or more hours on a given day, your employer cannot make you work between 5:00 p.m. that day and 3:00 a.m. the next morning. Each violation is a misdemeanor.
Federal jurors get a parallel shield. Under 28 U.S.C. ยง 1875, no employer can fire, threaten, intimidate, or coerce a permanent employee because of federal jury service. Penalties include civil fines of up to $5,000 per violation per employee, lost wages, and court-ordered reinstatement.5GovInfo. 28 USC 1875 – Protection of Jurors Employment
If an employer did pressure you into missing your date, bring that up at the show-cause hearing. It’s relevant to whether the absence was willful, and it exposes the employer to its own penalties.
Watch Out for Jury Duty Scams
Anyone who missed jury duty is a prime target for scammers. The script is familiar: a caller claims to be a court official or sheriff’s deputy, says there’s a warrant out for your arrest over the missed service, and demands immediate payment of a “fine” by gift card, cryptocurrency, or wire transfer. It’s always a scam.6Las Vegas Metropolitan Police Department. Court, Jury Duty, Warrant or Traffic Ticket Scam
The warning signs are consistent:
- A phone call or text about a warrant you’ve never been served with in writing.
- Demands for immediate payment over the phone.
- Instructions to pay in gift cards, cryptocurrency, or other untraceable methods.
- Threats of arrest within hours if you don’t comply.
- Pressure to stay on the line and not call anyone else.
No real court calls to demand payment or threaten arrest over the phone. Actual jury duty penalties move through a formal court process with written notices and a scheduled hearing. If you get a suspicious call, hang up, and then call the court directly using the number on your original summons or the court’s official website.
