Passing a stopped school bus in Florida is a four-point moving violation with a minimum total cost of $265, and the penalties climb sharply if you went around the bus on the side where children board or if you’ve done it before. A single conviction can push your license toward suspension through the points system; a second offense within five years triggers a suspension automatically. If a camera on the bus caught you rather than a police officer, you’re on a different track with its own deadlines.
When the Law Requires You to Stop
Florida law requires every driver to come to a complete stop when approaching a school bus with its stop signal activated, and to stay stopped until the signal is withdrawn and the flashing red lights go off.1Florida Senate. Florida Statutes 316.172 – Traffic to Stop for School Bus That rule applies whether you’re behind the bus or coming from the opposite direction, on two-lane and multi-lane roads alike.
The one exception is a divided highway. If a raised median, physical barrier, or unpaved space of at least five feet separates you from the bus, you don’t have to stop when traveling the other way.1Florida Senate. Florida Statutes 316.172 – Traffic to Stop for School Bus A painted center line or a turn lane is not a physical divider. If you’re not sure the road qualifies, stop.
The Standard Penalty: Fine, Points, and Driving School
The base statutory fine is a minimum of $200.2Florida Senate. Florida Statutes 318.18 – Amount of Penalties After mandatory court costs and surcharges, the minimum you’ll actually pay is $265.3Florida Department of Highway Safety and Motor Vehicles. School Bus Safety A judge can go higher.
A conviction also adds four points to your driving record.3Florida Department of Highway Safety and Motor Vehicles. School Bus Safety Four points from one ticket is enough to trigger a points-based suspension on its own if you already have recent violations: 12 points in 12 months brings a 30-day suspension, 18 in 18 months brings three months, and 24 in 36 months brings a year.4Florida Department of Highway Safety and Motor Vehicles. The court can order you to complete a basic driver improvement course as part of the sentence.3Florida Department of Highway Safety and Motor Vehicles. If You Passed on the Side Where Children Board
Florida treats passing a bus on the loading side as a more serious violation with its own penalty. The minimum fine is $400, totaling at least $465 with court costs.2Florida Senate. You also have to appear before a judge. This offense is on Florida’s list of infractions requiring a mandatory hearing, so you can’t resolve it by paying online or by mail.5The Florida Legislature. A Second Offense Within Five Years
A second conviction for failing to stop for a school bus within five years brings a license suspension of at least 180 days and up to one year.2Florida Senate. Florida Statutes 318.18 – Amount of Penalties The statute uses “shall,” so DHSMV has no discretion to skip the suspension.
If the repeat offense involved passing on the children’s side, the suspension runs at least one year and up to two years.3Florida Department of Highway Safety and Motor Vehicles. If a Bus Camera Caught You
Many Florida school districts now mount cameras on buses to record vehicles that run the stop signal, and those systems are authorized by state law.7Florida Senate. Florida Statutes 316.173 – Operation of School Buses; Passing a Stopped School Bus A camera violation generates a Notice of Violation mailed to the registered owner. The civil penalty amount mirrors the fines under Florida Statute 318.18.8The Florida Legislature. Florida Statutes 316.173 – Operation of School Buses
The important difference from a police-issued ticket: a camera citation is a civil penalty only. No points go on your driving record, and it isn’t logged as a moving violation conviction.
You have 60 days from the mailing date of the notice to either pay the fine or request an administrative hearing with the school district.8The Florida Legislature. Florida Statutes 316.173 – Operation of School Buses Ignoring the notice is the worst option. If you don’t respond, the county can escalate the matter to a Uniform Traffic Citation, which brings court costs and the same consequences as a ticket written by an officer.
Insurance Fallout
A conviction shows up when your auto policy renews. Florida doesn’t cap the premium increase an insurer can impose for a moving violation, and comparable Florida moving violations have been associated with premium increases of roughly 17 to 24 percent depending on coverage level. That surcharge typically sticks for three to five years.
If a suspension follows a repeat offense, you may need to file an SR-22 certificate, which is proof of bodily injury and property damage liability coverage that Florida requires to satisfy financial responsibility laws after certain suspensions. SR-22 policies cost more, and letting the required coverage lapse brings another suspension plus a reinstatement fee of up to $500.9Florida Department of Highway Safety and Motor Vehicles. Getting Your License Back
If your license is suspended for a repeat school bus violation, reinstatement requires completing an Advanced Driver Improvement course and paying a $60 reinstatement fee at a Florida driver license service center.4Florida Department of Highway Safety and Motor Vehicles. During the suspension, you can apply for a hardship license through your local DHSMV Administrative Reviews Office for limited work or medical driving. Proof of Advanced Driver Improvement completion is required for that application as well, along with the reinstatement fee and any other applicable license fees.4Florida Department of Highway Safety and Motor Vehicles. Points and Point Suspensions A hardship license is not guaranteed. Driving on a suspended license in Florida is a separate criminal offense, so waiting it out beats taking the risk.
