If your CDL was downgraded in Texas, the Department of Public Safety has removed your commercial driving privileges and reclassified your license as a standard Class C. You can still drive a personal vehicle, but you’ve lost the legal authority to operate any commercial motor vehicle, and every endorsement attached to the CDL is gone with it. To get back on the road professionally, you have to identify what triggered the downgrade, fix it, and complete reinstatement with DPS.
What a Downgrade Actually Does
The physical card in your wallet may still look like a CDL, but the DPS record now shows a non-commercial status. Any employer running your record, or any officer at an inspection, will see it. Most carriers pull driving records on a regular cycle, so a downgrade typically means immediate removal from driving duties or termination.
Federal regulations require you to notify your current employer of any suspension, revocation, or cancellation of your driving privileges within 30 days of the event.1eCFR. 49 CFR 383.31 – Notification of Convictions for Driver Violations Skipping that notice doesn’t buy you time. Your employer will find out, and failing to report is a separate federal violation.
Every commercial endorsement on your record disappears with the downgrade. Hazmat, tanker, doubles and triples, passenger: all stripped. If the downgrade was solely a medical certificate lapse and you reinstate within 12 months, your prior endorsements can be restored without retesting.2Department of Public Safety. Commercial Driver License CDL Medical Certification Requirement Wait longer and you may have to retest for each one.
Do not drive a commercial vehicle during a downgrade. Driving a CMV without a valid CDL carries federal disqualification on top of any Texas penalty, and the clock on those disqualifications escalates with each subsequent conviction.3eCFR. 49 CFR 383.51 – Disqualification of Drivers
Why DPS Downgraded Your CDL
Nearly every Texas CDL downgrade traces to one of four causes. Identifying yours is step one, because reinstatement differs for each.
Expired Medical Certificate
Federal law requires commercial drivers to carry a valid Medical Examiner’s Certificate proving physical qualification to operate a CMV.4eCFR. 49 CFR 391.41 – Physical Qualifications for Drivers A certificate is good for a maximum of 24 months, and drivers with conditions like hypertension or diabetes may be certified for only 12 months.5FMCSA. For How Long Is My Medical Certificate Valid? Let it expire without submitting a new one and DPS downgrades the CDL.
Self-Certification Problem
Every Texas CDL holder must file a self-certification affidavit with DPS declaring which category of commercial driving they perform.6Legal Information Institute. 37 Texas Admin Code 16.23 – Medical Certificate Requirements If you certify in a non-excepted category, you also have to keep a valid medical certificate on file. Drivers who never file the affidavit, or who fail to update it when their driving category changes, face an automatic downgrade.
Drug and Alcohol Clearinghouse Violation
Since November 18, 2024, “prohibited” status in the FMCSA Drug and Alcohol Clearinghouse triggers a mandatory CDL downgrade. You land in prohibited status by testing positive for drugs, testing at or above the alcohol threshold, refusing a required test, or violating other program rules.7Drug and Alcohol Clearinghouse. CDL Downgrades Once FMCSA notifies the state, Texas has 60 days to record the downgrade.8eCFR. 49 CFR 383.73 – State Procedures This also catches drivers whose violations predate November 2024 if they remain in prohibited status, and the status follows you even after leaving the employer where the violation occurred. Any state licensing transaction, including a routine renewal, is denied while the Clearinghouse shows you prohibited.9FMCSA Drug and Alcohol Clearinghouse. SDLA Webinars – Questions and Answers
Delinquent Child Support
Under Texas Family Code Chapter 232, the Office of the Attorney General can petition a court to suspend your license when you owe overdue child support equal to or greater than three months’ worth of your obligation, you’ve had the chance to make payments under a repayment schedule, and you’ve failed to follow through.10State of Texas. Texas Family Code Chapter 232 – Suspension of License The suspension covers all license types, including the CDL, and drivers suspended for child support are not eligible for an occupational license in Texas. There is no workaround to keep driving while it’s unresolved.11Department of Public Safety. Delinquent Child Support Revocation
How to Get Your CDL Back
The path to reinstatement depends entirely on which trigger applies.
After a Medical Certificate Lapse
Get a new DOT physical from a medical examiner on the FMCSA National Registry. As of June 23, 2025, the examiner submits your certificate information electronically, and you no longer need to carry a paper copy as proof of medical fitness.4eCFR. 49 CFR 391.41 – Physical Qualifications for Drivers A DOT physical typically runs $50 to $200 depending on the provider.
Once your new certificate is on the National Registry, visit a DPS driver license office in person to complete the upgrade. You can skip the CDL knowledge and skills exams if all four conditions are met: your record status is “Eligible” (not suspended or disqualified for other reasons), your driver’s license hasn’t been expired for more than two years, the downgrade is less than 12 months old, and your new medical certificate is on file with the National Registry.2Department of Public Safety. Commercial Driver License CDL Medical Certification Requirement Transaction fees apply at the office. Miss the 12-month window and expect a full retest.
After a Self-Certification Issue
Submit the Texas CDL Self-Certification Affidavit (Form CDL-7) to DPS, declaring your commerce category. If you certify in a non-excepted category, include a valid medical certificate.2Department of Public Safety. Commercial Driver License CDL Medical Certification Requirement You can submit by email, fax, or mail with your full name, date of birth, and driver license number. If you’re changing between certification categories, you have to go in person.
After a Clearinghouse Violation
This is the longest road back. You must complete the federal Return-to-Duty process in order: a Substance Abuse Professional evaluates you, you complete any prescribed education or treatment, the SAP conducts a follow-up evaluation confirming compliance, and you pass a return-to-duty drug or alcohol test with a negative result.12FMCSA Drug and Alcohol Clearinghouse. The Return-to-Duty Process and the Clearinghouse Only after that negative test does your prohibited status clear.
Once FMCSA notifies Texas that you’re no longer prohibited, the state must make you eligible for reinstatement.8eCFR. 49 CFR 383.73 – State Procedures The full process commonly takes a few weeks to several months depending on severity and prescribed treatment, and SAP evaluation, treatment, and testing together typically cost $500 to $1,200 out of pocket, not counting follow-up tests a future employer will require.
After a Child Support Suspension
You need the Attorney General’s office or the court to issue an order vacating or staying the suspension. That generally means paying the arrears in full or entering an acceptable repayment agreement that includes a lump-sum payment toward the overdue balance plus ongoing payments.13Office of the Attorney General. License Suspension Once the AG’s office submits the release order to DPS, the suspension is lifted.11Department of Public Safety. Delinquent Child Support Revocation
When You Have to Retake CDL Exams
Texas DPS draws a clear line. If the downgrade was solely due to an expired medical certificate, your license hasn’t expired, and the downgrade is less than 12 months old, no retesting is required.14Department of Public Safety. Commercial Driver License CDL Frequently Asked Question
If your CDL was voluntarily surrendered or downgraded for any other reason, you will need to retake both the CDL knowledge and skills exams to get your commercial privileges back.14Department of Public Safety. Commercial Driver License CDL Frequently Asked Question The same applies to medical downgrades left unresolved beyond 12 months. The gap between a single office visit and a full CDL retest is the biggest reason to move quickly once you know you’ve been downgraded.
Fees and Checking Your Status
DPS charges reinstatement fees for four specific enforcement actions: departmental suspensions ($100), safety responsibility suspensions ($100), administrative license revocations from failing or refusing a breath or blood test ($125), and education program suspensions ($100).15Department of Public Safety. Section 7 – Reinstatement Fees and Special Licenses A straightforward medical certificate downgrade does not fall into those categories, and child support suspensions do not carry a reinstatement fee either, though transaction fees still apply when you visit the office.
DPS sends downgrade notices by mail to the address on your license record.16Department of Public Safety. Notification of Enforcement Action If you’ve moved and haven’t updated your address, you won’t see it, and the downgrade stands anyway. Check your current status through the DPS License Eligibility portal online, especially as your medical certificate renewal date approaches. After you’ve paid fees and submitted documents, go back to the same portal to confirm your CDL has actually been restored. Don’t assume the paperwork went through just because you handed it in.
