A discharge of mortgage in New York is the recorded certificate that removes your lender’s lien from your property after the loan is paid in full. Making the final payment doesn’t clear the mortgage from public records on its own. Your lender has to prepare a certificate of discharge (also called a satisfaction of mortgage), sign and notarize it, and present it to the county clerk where the original mortgage was filed. State law gives them 30 days to do it, and until that filing is recorded, the old loan still shows as an encumbrance on your title.1New York State Senate. What the Certificate Must Say
The discharge is a formal document stating that the mortgage debt has been paid and that the lender releases its lien. Under Real Property Law Section 321, it must be signed and acknowledged before a notary in the same manner required to record a deed.2New York State Senate. New York Real Property Law RPP 321 – Recording Discharge of Mortgage It has to identify the original mortgage clearly: the names of borrower and lender, the date of the mortgage, and the recording information the county clerk assigned when the mortgage was first filed (the book and page number or document number).
Who signs the certificate matters as much as what it says. If the mortgage was never assigned, the original lender or its legal successor signs. If the loan was assigned to another entity, the last recorded assignee has to sign. When two or more parties appear as mortgagees or assignees, the party designated in the mortgage or assignment to receive payment is the one who signs.2New York State Senate. The 30-Day Filing Deadline
New York puts the duty on the lender, not on you. Once the full principal and interest have been paid, the lender must prepare the certificate and arrange for it to be presented to the county clerk within 30 days.1New York State Senate. New York Real Property Law RPP 275 – Certificate of Discharge of Mortgage Required The lender pays the recording fee. A parallel provision in Section 1921 of the Real Property Actions and Proceedings Law reinforces the same obligation: the lender must execute and acknowledge a satisfaction and either record it or deliver it to you within the same 30-day window.3New York State Senate. New York Real Property Actions and Proceedings Law RPA 1921 – Discharge of Mortgage
Section 1921 also requires the lender to return the original promissory note and mortgage document to you within 45 days of payoff.3New York State Senate. New York Real Property Actions and Proceedings Law RPA 1921 – Discharge of Mortgage Those originals are your proof that the debt is extinguished. Keep them.
One boundary worth knowing: the penalty-backed obligations under Section 275 apply only to lenders who make five or more mortgage loans in a calendar year.1New York State Senate. New York Real Property Law RPP 275 – Certificate of Discharge of Mortgage Required If you borrowed from a private individual who rarely lends, the statutory penalties below don’t apply, though the lender still has a common-law duty to release a satisfied lien. Mortgages granted to or made by the State of New York and its political subdivisions are also exempt.
Penalties When the Lender Misses the Deadline
The statute imposes escalating penalties payable to you when a covered lender misses the deadline:
- $500 if the lender fails to present the certificate for recording within 30 days of full payment
- $1,000 if the lender fails within 60 days
- $1,500 if the lender fails within 90 days
Both RPL Section 275 and RPAPL Section 1921 set out these identical tiers.1New York State Senate. New York Real Property Law RPP 275 – Certificate of Discharge of Mortgage Required3New York State Senate. New York Real Property Actions and Proceedings Law RPA 1921 – Discharge of Mortgage On top of the statutory amounts, if the delay causes actual financial harm (a blown sale, a higher rate on a new loan, attorney fees to clean up title), you can pursue those damages too. The New York State Department of Financial Services can investigate complaints against regulated lenders and servicers who refuse to issue a timely discharge.
Why This Matters for Your Title
A mortgage lien doesn’t disappear when the loan balance hits zero. The lien stays in the public record until the discharge is recorded, and it will show up on every title search done on the property. That matters whenever you sell, refinance, take out a home equity loan, or move the property into a trust.
Title insurers and new lenders require clean title before closing. An old mortgage that still appears on the record will stall the transaction. You may have to chase down affidavits, indemnity agreements, or extra documentation from the prior lender to prove the debt was satisfied. In the worst cases, a homeowner has to bring a quiet title action under Article 15 of the Real Property Actions and Proceedings Law to get a court order formally removing the lien. That process is slow and expensive, which is exactly why the 30-day deadline and penalty structure exist.
How to Verify the Discharge Was Recorded
The discharge has to be recorded with the county clerk’s office in the county where the original mortgage was filed. When the clerk accepts the document, they mark the mortgage record as “discharged,” which is what actually clears the lien from public records.2New York State Senate. New York Real Property Law RPP 321 – Recording Discharge of Mortgage
Many New York county clerks now accept electronic recording, so a satisfaction submitted through an e-recording network can be on the record within hours instead of weeks. If your lender tells you the document was “sent to the county,” ask for the recording confirmation number. Most county clerk websites let you search the land records yourself to confirm the discharge is on file.
Clerks reject documents that contain errors or omit required information. Common triggers for rejection include a misspelled borrower name, a wrong recording reference number for the original mortgage, or a missing notarization. When a document comes back, the lender has to correct and resubmit it. The clerk’s processing clock restarts, but the statutory penalty clock keeps running from your original payoff date.
When the Loan Was Sold or Transferred
Most New York mortgages change hands at least once before they’re paid off. The original lender may have sold the loan, assigned it to a trust, or registered it through the Mortgage Electronic Registration Systems (MERS). The satisfaction has to come from whoever appears in the county records as the current holder.2New York State Senate. New York Real Property Law RPP 321 – Recording Discharge of Mortgage
If you’re not sure who holds your mortgage, federal rules let you send your servicer a written request for the identity and contact information of the owner or assignee. The servicer must respond within 10 business days.4eCFR. Title 12 Chapter X Part 1024 Subpart C – Mortgage Servicing That’s useful when the servicer sending your monthly statements is a different company from the one that actually owns the loan.
For MERS-registered mortgages, the satisfaction can be executed in MERS’s name by the servicer, because MERS acts as the mortgagee of record even though it doesn’t own the debt.5Fannie Mae. Satisfying the Mortgage Loan and Releasing the Lien If the assignment chain wasn’t properly recorded over the years, expect delays while the current holder establishes its authority to issue the discharge. This is one of the most common reasons a satisfaction takes longer than 30 days.
If the Original Lender No Longer Exists
When the lender that originated your mortgage is gone, the path depends on how it went away. If it was a bank or savings institution that failed and ended up in FDIC receivership, the FDIC can issue a lien release. You’ll need recorded copies of the mortgage and any assignments leading to the receivership, a recent title search, and proof the loan was paid in full, such as a promissory note stamped “PAID” or a HUD-1 settlement statement. A credit report is not accepted as proof of payoff, and processing takes at least 30 business days once the FDIC has everything.6FDIC.gov. Obtaining a Lien Release
If the lender merged with another institution without government assistance, you contact the successor bank. The FDIC can’t help with voluntary mergers. For a defunct mortgage company that wasn’t a bank, you may need to contact the Secretary of State’s office in the state where the company was incorporated to identify a successor or custodian of records.6FDIC.gov. Obtaining a Lien Release If no successor can be found, a quiet title action may be the only remaining option.
If Your Lender Won’t File the Discharge
When 30 days have passed since your final payment and nothing has been recorded, start with a written demand to the lender or servicer. Cite RPL Section 275 and spell out the penalty tiers. Many lenders act quickly once they see the clock is running and the penalties are accumulating.
If that doesn’t move things, you have a few escalation paths. File a complaint with the New York State Department of Financial Services, which regulates mortgage lenders and servicers in New York. You can also sue the lender to force the discharge and recover the statutory penalties, your actual damages, and potentially attorney fees. For one-to-six family owner-occupied homes and condominiums, RPAPL Section 1921 provides additional protections if the lender fails to deliver the satisfaction and the original loan documents within 90 days.3New York State Senate. New York Real Property Actions and Proceedings Law RPA 1921 – Discharge of Mortgage
The last resort is a quiet title action under Article 15 of the Real Property Actions and Proceedings Law. A court order from that proceeding can clear the lien from your title even without the lender’s cooperation. It’s slow and expensive, but it’s the remedy that works when nothing else does.
