A domestic partnership in Massachusetts is a locally registered relationship status, available only in a handful of cities and towns that have passed their own ordinances. There is no statewide domestic partnership law. If you live in one of the eight municipalities that offer it, you can register with your city or town clerk, but the rights you receive are narrow and apply mostly at the municipal level. Marriage it is not.
Where You Can Register
Only eight Massachusetts municipalities currently offer domestic partnership registration: Arlington, Boston, Brewster, Brookline, Cambridge, Nantucket, Provincetown, and Somerville.1Mass.gov. Massachusetts Law About Unmarried Couples and Domestic Partnerships If your city or town isn’t on that list, there is no domestic partnership to register. Each municipality wrote its own ordinance under home rule authority, so the specific language, fees, and benefits differ from place to place. Always confirm the details with your local clerk before you file.
Somerville is the outlier. In 2020 it became the first city in the country to adopt a multi-partner ordinance, so registration there is not limited to two people. The ordinance extends to domestic partners the same rights and privileges the city grants to married people, but only within the reach of city ordinances.
Who Qualifies
Requirements vary slightly, but most ordinances ask both partners to declare, under penalty of perjury, that they:
- Are at least 18 and mentally competent to enter a contract
- Share basic living expenses and are responsible for each other’s well-being, including any dependents
- Are each other’s sole domestic partner (except in Somerville)
- Are not married to anyone else
- Are not related by blood in a way that would bar marriage under Massachusetts law
Partners also agree to tell the clerk if the relationship status changes.2City of Boston. How To File For A Domestic Partnership Somerville adds a 90-day waiting period after a prior partnership ends before you can register a new one, unless the previous partnership ended because a partner died.3City of Somerville. How Registration Works
You register at the clerk’s office in the municipality where you live. You fill out the form, sign the declaration, pay the fee, and the clerk records the partnership and issues documentation.
Fees differ. Boston charges $50 to file plus $12 for a certified copy of the partnership certificate.2City of Boston. How To File For A Domestic Partnership Cambridge charges $35. Call ahead to confirm the amount and whether you need an appointment. Brookline, for example, handles registrations by appointment only.
What a Domestic Partnership Actually Gets You
Set expectations here. Registration gives you formal documentation of your relationship, and some employers accept that documentation when extending health insurance to a domestic partner. Hospitals often cite visitation as a benefit, though most hospitals already let patients name their own visitors regardless of legal status. Some municipal ordinances use the registration to define “family” for city employment benefits or local policies.
That is roughly the extent of it. The state’s own guidance is explicit that a domestic partnership ordinance “does not affect state law in many important areas of property rights, custody and inheritance.”1Mass.gov. Massachusetts Law About Unmarried Couples and Domestic Partnerships
One thing registration does not give you is automatic medical decision-making authority. In Massachusetts, no one has that authority for an incapacitated adult without a signed healthcare proxy, including spouses. For domestic partners, the healthcare proxy is the only reliable way to make sure your partner can speak for you in a medical crisis.
What It Doesn’t Get You
Marriage is a federally recognized legal status. A locally registered domestic partnership is not, and that single difference drives most of the gaps that matter.
Inheritance. Under Massachusetts intestacy law, a domestic partner is not in the line of succession. If your partner dies without a will, the estate passes to a surviving spouse, children, parents, or more distant relatives, and you inherit nothing.1Mass.gov. Massachusetts Law About Unmarried Couples and Domestic Partnerships Decades of shared life produce no legal claim without the right documents.
Federal taxes. The IRS states that people in a registered domestic partnership, civil union, or similar relationship not denominated as a marriage are “not lawfully married for federal tax purposes.” You cannot file a joint federal return. If your employer covers your domestic partner on its health plan, the fair market value of that coverage is added to your taxable income as imputed income, unless the partner qualifies as your tax dependent. Spousal coverage is tax-free; domestic partner coverage usually isn’t.4IRS. Publication 15-B – Employer’s Tax Guide to Fringe Benefits
Estate taxes. Spouses can transfer unlimited assets to each other tax-free under the federal marital deduction. Domestic partners cannot. Massachusetts has its own estate tax with a $2,000,000 threshold and no marital deduction for domestic partners, so an estate that would pass tax-free between spouses can generate a real state estate tax bill when it passes to a partner instead.5Mass.gov. Massachusetts Estate Tax Guide
FMLA leave. Federal FMLA defines “spouse” as someone you entered a legally recognized marriage with, and the regulatory history confirms the definition was written so employers would not be required to grant FMLA leave to care for an unmarried domestic partner.6Federal Register. Definition of Spouse Under the Family and Medical Leave Act If your partner has a serious health condition, you have no federally protected right to take leave to care for them.
Social Security, COBRA, immigration. Social Security survivor and spousal benefits, COBRA continuation coverage if a partner loses employer insurance, and immigration sponsorship for a non-citizen partner are all tied to marriage. Federal law lists COBRA-eligible dependents as a spouse, former spouse, or child; domestic partners are not on that list.7U.S. Department of Labor. COBRA Continuation Coverage
Portability. Marriage travels with you across state lines. A Boston domestic partnership has no legal standing outside the municipalities that recognize such arrangements, and many states do not recognize them at all.
What to Put in Place Yourself
Because registration itself does so little in the areas that matter financially and medically, domestic partners carry the burden of building the protections marriage would provide automatically. At minimum, each partner should have:
- A will naming the other as beneficiary
- A durable power of attorney for financial decisions
- A healthcare proxy designating the other as agent
- Updated beneficiary designations on retirement accounts and life insurance
- Where appropriate, joint ownership of real estate with rights of survivorship, so property passes directly to the surviving partner without probate
A written cohabitation agreement is the other big piece. Massachusetts courts have held that “unmarried cohabitants may lawfully contract concerning property, financial, and other matters relevant to their relationship,” subject to ordinary contract rules.1Mass.gov. Massachusetts Law About Unmarried Couples and Domestic Partnerships A sound agreement covers how jointly acquired property would be divided if the relationship ends, whether either partner would provide financial support afterward, how shared debts and expenses are handled, and what happens to the home if one partner moves out. Both partners should sign voluntarily, and each should consult a separate attorney so there is no later question of pressure or misunderstanding.
Ending a Domestic Partnership
Procedurally, ending a domestic partnership is simpler than divorce. In Boston, either partner can file a termination form with the City Clerk’s Office and pay a $12 fee, and the filing partner must notify the other in person or by certified mail.8City of Boston. How To End A Domestic Partnership No court is involved unless the partners disagree about property or finances.
That simplicity is also the catch. A divorce court can divide assets equitably, order support, and enforce its orders. When a domestic partnership ends, you have none of that framework. Without a cohabitation agreement, you are negotiating from scratch, and any court fight runs on breach-of-contract theory rather than family law. Mediation can help, but it cannot replicate what a divorce court would do.
If you registered in Somerville, the 90-day waiting period before you can enter a new domestic partnership runs from the date of termination.3City of Somerville. Registering a Domestic Partnership in Somerville Check with the clerk’s office where you first registered for any local rules that apply.
