What Is a W-6 Form? Michigan Tax Reciprocity Eligibility and Filing

The Michigan W-6 form, officially the Michigan Individual’s Certificate of Michigan Residency, is what you hand your employer when you live in Michigan but work in a reciprocal state so that only Michigan income tax, at 4.25 percent, is withheld from your paycheck instead of the work state’s tax.1State of Michigan. 2026 Michigan Income Tax Withholding Guide Without it on file, your employer will usually default to withholding for the state where you physically work, leaving you to chase a refund the following spring.

States Covered by the Form

Form W-6 only works if your job is in one of the six states that have a reciprocal tax agreement with Michigan:2State of Michigan. 2025 Michigan Individual Income Tax MI-1040 Instructions

  • Illinois
  • Indiana
  • Kentucky
  • Minnesota
  • Ohio
  • Wisconsin

If you commute to any other state for work, Form W-6 does nothing for you. In that case, the mechanism to avoid double taxation is a credit on your Michigan return for taxes paid to the other state, which is a separate process.3Michigan Legislature. Who Qualifies to File It

Two things have to be true. You have to be a legal Michigan resident, meaning Michigan is where you keep your permanent home and intend to return when you’re away. And the income in question has to be W-2 wages: salary, hourly pay, or commissions paid by an employer.

Self-employment income, business income, and independent contractor fees are not covered by the reciprocal agreements.4Wisconsin eRules. Section 2.02 Reciprocity, Chapter 2 Income Taxation If you freelance in Ohio or Indiana, you may still owe tax there and have to handle it on your own; Form W-6 has no role because there is no employer payroll system to route it through.

How to Fill Out and Submit the Form

The current version of Form W-6 is on the Michigan Department of Treasury website. The fields are short and need to be accurate:

  • Your full legal name as it appears on your identification
  • Your Social Security number
  • Your permanent Michigan home address
  • Your employer’s full legal name and address
  • The reciprocal state where you work

Give the completed form to your employer’s payroll or HR department. You do not mail it to the Michigan Department of Treasury; the employer keeps it on file and uses it to switch your withholding over to Michigan tax. Every employer that is required to withhold federal tax from your compensation must also withhold Michigan tax once the certificate is in their records.5Michigan Legislature. Michigan Compiled Laws 206.703 – Tax Withholding; Deduction; Amount; Computation Withholding is calculated at 4.25 percent of your compensation after personal and dependency exemption allowances.1State of Michigan. 2026 Michigan Income Tax Withholding Guide

Turn it in as early as you can, ideally during onboarding. File a new one if you change employers in a reciprocal state or move your residence. Then check a pay stub or two to confirm the deduction is Michigan tax and not the work state’s.

If the Wrong State’s Tax Was Withheld

If the form never made it onto your employer’s desk, or they failed to act on it, you may see tax withheld for the work state on paychecks already issued. You do not owe tax to both states, but you do have to clean it up.

The Michigan Department of Treasury’s instruction is to file a nonresident return with the work state to recover the tax withheld in error.6State of Michigan. Are My Wages Earned in Another State Taxable in Michigan if I Am a Michigan Resident? You’ll want the W-2 showing the withheld amount, proof of Michigan residency, and whatever reciprocity exemption form the work state uses. Each of the six reciprocal states has its own nonresident form for this purpose.

You still file your Michigan resident return and report all of your income, including what you earned across the state line. If you can’t get the full refund from the work state in the same tax year, Michigan allows a nonrefundable credit for taxes paid to other government units outside Michigan, though the direct refund from the work state is usually the cleaner route.6State of Michigan. Local City Taxes Are Not Covered

Reciprocity is a state-level deal. It does not cover the city and county income taxes that several reciprocal states, especially Ohio, Indiana, and Kentucky, let their municipalities impose. Those local governments are not parties to the agreement, so they can still tax a Michigan resident who works within their borders.

Ohio is the most common example, with hundreds of municipalities levying their own tax. If your workplace is in one of them, you may owe city tax even though no Ohio state tax is withheld. Michigan does allow a nonrefundable credit on your Michigan return for local taxes paid to a city in a reciprocal state.6State of Michigan. Military Spouses

Under the federal Military Spouses Residency Relief Act, if you are the spouse of a service member stationed outside Michigan and you keep Michigan as your permanent home, the other state cannot tax your wages. You include the out-of-state wages on your Michigan return instead.7State of Michigan. Federal Military Spouses Residency Relief Act

If your civilian employer in the other state will not withhold Michigan tax voluntarily, make estimated payments to Michigan to avoid penalty and interest. If the other state does withhold its own tax, you cannot credit that on your Michigan return; you have to file a nonresident return with that state to get the money back. The other state or the employer may ask for a statement confirming your nonresident status.7State of Michigan. Federal Military Spouses Residency Relief Act

Penalties for Filing When You Don’t Qualify

Submitting a Form W-6 when you aren’t actually a Michigan resident can trigger Michigan tax penalties. The Department of Treasury uses a tiered schedule: 10 percent of the tax due for negligence, 25 percent for intentional disregard of tax rules, and up to 100 percent for fraud.8State of Michigan Department of Treasury.
