In Las Vegas, adults 21 and older can legally gamble, drink around the clock, carry an open drink down the Strip, and buy recreational cannabis from a licensed dispensary, but what is and isn’t legal in Las Vegas gets stricter the moment you step off that sidewalk: prostitution is a crime everywhere in Clark County, cannabis cannot be used in public or carried through the airport, open containers are banned inside vehicles, and even jaywalking or feeding pigeons can bring a fine. Everything below is governed by a mix of Nevada state law and Clark County and City of Las Vegas ordinances, and the penalties are real.
Gambling
You must be 21 to place any bet. Nevada law makes it a misdemeanor for anyone under 21 to play a gambling game, use a slot machine, or collect winnings.1Nevada Legislature. Nevada Code 463.350 – Gaming or Employment in Gaming Prohibited for Persons Under 21; Exception A Nevada misdemeanor carries up to six months in jail, a fine of up to $1,000, or both.2Nevada Legislature. NRS Chapter 193 – Criminality Generally Casinos check IDs at the edges of gaming floors and again when they pay out jackpots.
If you win big, the IRS gets involved. Casinos issue a Form W-2G once reportable winnings reach the federal threshold and withhold 24% of larger payouts for federal income tax.3Internal Revenue Service. Instructions for Forms W-2G and 5754 Smaller wins are still taxable income. Keep a log if you plan to itemize losses against your winnings.
Alcohol, Open Containers, and the Line at the Car Door
The drinking age is 21, and underage purchase, consumption, or public possession is a misdemeanor.4Nevada Legislature. Nevada Code 202.020 – Purchase, Consumption or Possession of Alcoholic Beverage by Person Under 21 Years of Age Bars and liquor stores can serve 24 hours a day; Nevada has no statewide last call.
Clark County allows open containers of alcohol on public sidewalks along the Strip and Fremont Street, which is why you can carry a drink block to block in the tourist corridors. Glass is banned on the Strip, so the drink has to be in a plastic cup, aluminum can, or paper cup. Bars and casinos pour into compliant cups for this reason.
That tolerance stops at the curb. It is a misdemeanor to have an open alcoholic beverage in the passenger area of a vehicle on a highway. Passengers in a taxi, limousine, or rideshare are exempt, but the driver of that vehicle is not.5Nevada Legislature. Nevada Code 484B.150 – Drinking Alcoholic Beverage While Driving Motor Vehicle; Possession of Open Container in Motor Vehicle Public intoxication by itself is not a crime in Nevada, though related conduct like disturbing the peace can be charged as a misdemeanor.
Driving Under the Influence
Nevada’s DUI penalties escalate quickly, and the first offense is already serious. A first DUI within seven years is a misdemeanor requiring either two to six months in jail or residential confinement, or 48 to 96 hours of community service, plus a fine between $400 and $1,000. The court also orders an alcohol education course, a victim impact panel, and an ignition interlock device for 185 days. A blood alcohol concentration of 0.18 or higher triggers mandatory substance abuse treatment. A $35 civil penalty and a $60 chemical analysis fee are added on top.6Nevada Legislature. NRS Chapter 484C – Driving Under the Influence
A second DUI within seven years is an enhanced misdemeanor with 10 days to six months in jail, a fine up to $1,000, and a one-year license revocation. A third offense within that window is a felony with mandatory prison time. Rideshares in Las Vegas are cheap and constant; use one.
Cannabis
Recreational cannabis is legal for adults 21 and older when purchased from a state-licensed dispensary. Buying from anyone else is illegal regardless of what the seller tells you. Legal possession tops out at 2.5 ounces of flower or a quarter ounce of concentrate.7Nevada Cannabis Compliance Board. Laws and Regulations – Section: Possession and Consumption
Where you can use it is far narrower than where you can buy it. Public consumption is prohibited, including on sidewalks, in parks, on casino property, in hotel rooms unless the property explicitly allows it, and in vehicles.7Nevada Cannabis Compliance Board. Laws and Regulations – Section: Possession and Consumption Legal consumption is essentially limited to a private residence or a licensed cannabis consumption lounge. Lounges sell single-use products that must be consumed entirely on site; you cannot carry anything in or out, and no alcohol or tobacco is allowed inside.8Nevada Cannabis Compliance Board. Regulation 15 Cannabis Consumption Lounge
Do Not Bring Cannabis to the Airport
Harry Reid International Airport sits under federal jurisdiction, where cannabis is still a controlled substance. TSA will confiscate it at the checkpoint and may notify airport law enforcement. The airport has installed bright green amnesty boxes before security where you can discard cannabis products with no questions asked.
Prostitution
Prostitution is illegal in Clark County, which covers the city of Las Vegas and the entire Strip. Nevada law bars engaging in or soliciting prostitution anywhere except a licensed house of prostitution, and no county with a population of 700,000 or more may license one. Clark County is well past that threshold.9Nevada Legislature. Nevada Code 201.354 – Unlawful for Customer to Engage in Prostitution or Solicitation for Prostitution Except in Licensed House of Prostitution A first solicitation offense is a misdemeanor carrying up to six months in jail, a minimum $400 fine, and a civil penalty of at least $200; later offenses are gross misdemeanors with higher fines and up to 364 days in jail.2Nevada Legislature. NRS Chapter 193 – Criminality Generally Soliciting a minor, including an officer posing as one, is a felony from the first offense.
Licensed brothels operate in some rural Nevada counties with smaller populations. None are near Las Vegas. Strip clubs are a separate, regulated industry.
Firearms
Nevada is an open-carry state. A visible firearm is legal in most public places, including the Strip, without a permit. Concealed carry requires a Nevada concealed handgun permit or a recognized permit from one of roughly 33 reciprocating states; applicants must be 21 (or 18 for active and honorably discharged military), pass a background check, and complete a certified firearms safety course covering Nevada law.10Nevada Legislature. Nevada Code 202.3657 – Application for Permit to Carry Concealed Firearm
Firearms are off-limits at public schools, child care facilities, university campuses including UNLV, the Nevada Legislative Building, and secured airport areas, with federal law adding post offices, VA facilities, federal courthouses, military bases, and the Hoover Dam area. Casinos set their own policies, and most prohibit firearms on the property even though state law does not expressly ban them there.
Smoking on Casino Floors
Most indoor workplaces and restaurants in Nevada are smoke-free under the Clean Indoor Air Act. Gaming areas of casinos and stand-alone bars that don’t serve food are exempt, which is why cigarette smoke is still common on casino floors. A restaurant inside a casino must be smoke-free even when it sits a few feet from a smoking gaming area.11Southern Nevada Health District. Nevada Clean Indoor Air Act: A Guide for the General Public Some casinos voluntarily set aside nonsmoking gaming sections, but nothing requires them to.
Everyday Conduct That Can Still Get You Cited
Jaywalking
Where adjacent intersections have working traffic signals, pedestrians must use marked crosswalks. Crossing mid-block in those areas is a civil infraction, not a misdemeanor, with a fine of up to $100.12Nevada Legislature. Nevada Code 484B.287 – When Pedestrian Must Yield Right-of-Way to Vehicle; When Crossing at Crosswalk Is Required Enforcement along Las Vegas Boulevard is more active than visitors expect.
Feeding Pigeons and Wildlife
Feeding pigeons in Clark County is a misdemeanor, and the City of Las Vegas has extended the prohibition to feral animals and wildlife generally.13City of Las Vegas. Feeding Wildlife Now Prohibited A misdemeanor can mean up to six months in jail, a $1,000 fine, or both.2Nevada Legislature. NRS Chapter 193 – Criminality Generally Warnings are more common than arrests, but citations do happen.
Juvenile Curfew
Anyone under 18 who is not with a parent or guardian faces curfew rules. On the Strip (Las Vegas Boulevard South between Sahara and Sunset), minors must be off the boulevard by 9:00 PM on Fridays, Saturdays, and legal holidays. In other public areas, curfew is 10:00 PM Sunday through Thursday and midnight on Fridays and Saturdays; during school holidays and summer vacation it moves to midnight every night.14Clark County. Clark County Department of Juvenile Justice Services – Common Laws Pertaining to Juveniles
Getting Married the Same Day
Nevada imposes no waiting period, no blood test, and no residency requirement for a marriage license. Both parties appear at the Clark County Marriage License Bureau with valid government-issued photo ID, pay $102, and walk out with a license the same day; a pre-application online speeds things up.15Clark County. Clark County Clerk Fees The minimum age without special process is 18. A 17-year-old needs parental or guardian consent plus a court order finding by clear and convincing evidence that the marriage is in the minor’s best interests, and nobody younger than 17 can marry in Nevada at all.16Nevada Legislature. NRS Chapter 122 – Marriage If you’ve been married before, bring the date and location of your final divorce or annulment decree.
