California withholding is the state income tax your employer or other payer deducts from your paycheck, pension, or certain other payments and sends directly to the state throughout the year. It is not an extra tax. It is a prepayment of the California personal income tax you already owe, credited against your bill when you file your return. If too much came out, you get a refund. If too little came out, you owe the balance and possibly a penalty.
Who Collects It
Two agencies share the work. The Employment Development Department (EDD) handles withholding on wages, which your employer calculates each pay period and remits on your behalf.1Cornell Law School. Cal. Code Regs. Tit. 22, 4320-1 – Employer Required to Withhold Income Taxes The Franchise Tax Board (FTB) oversees withholding on non-wage income, including payments to nonresidents, independent contractors, and real estate sellers.2California Legislative Information. California Revenue and Taxation Code 18662
California’s income tax runs through nine brackets, from 1% on the lowest slice of taxable income up to 12.3% on the highest. A 1% Mental Health Services Tax applies above $1 million in taxable income, which pushes the effective top rate to 13.3%. The thresholds adjust annually for inflation and differ by filing status. The withholding tables build all of that in, so you do not need to run the math yourself to get a reasonable deduction from each check.
What Income Is Subject to Withholding
Regular Wages
Every paycheck from a California employer has state income tax calculated and withheld before the money reaches your account. Your employer uses the EDD’s withholding schedules together with your filing status and the allowances on your Form DE 4 to set the amount.3California Employment Development Department. DE 4 – Employee’s Withholding Allowance Certificate
Bonuses, Commissions, and Other Supplemental Wages
Bonuses, stock options, commissions, and overtime pay follow different rules. When an employer pays these separately from regular wages, California permits flat-rate withholding instead of running the amount through the normal brackets. Stock options and bonuses are withheld at a flat 10.23%; commissions, overtime, and other supplemental payments at a flat 6.6%.4California Employment Development Department. Information Sheet – Personal Income Tax Withholding Those flat rates often come in under what a higher earner actually owes on the extra income, so review your overall year-to-date withholding after a large bonus.
Pensions and Annuities
Retirement income from a pension or annuity is withheld in a manner similar to wage withholding. You can change the amount by filing the appropriate form with your plan administrator.
Non-Wage Payments
Revenue and Taxation Code Section 18662 reaches a broad range of non-wage payments: interest, dividends, rents, prizes, winnings, and compensation for services.2California Legislative Information. California Revenue and Taxation Code 18662 The withholding rate is 7% of the gross amount, which most often affects nonresidents earning California-source income.5Cornell Law School. Cal. Code Regs. Tit. 18, 18662-4 – Withholding on Payments to Nonresidents The FTB can also require withholding after notifying a payer that a payee has been underreporting.
Real Estate Sales
When California real property is sold, the buyer or escrow company must generally withhold 3⅓% of the sales price and send it to the FTB on Form 593.6Cornell Law School. Cal. Code Regs. Tit. 18, 18662-3 – Real Estate Withholding Sellers can elect an alternative calculation based on estimated gain, which often shrinks the amount significantly. Several exemptions apply:
- Sales price of $100,000 or less: no withholding is required.
- Principal residence: no withholding if the seller certifies the property qualified under IRC Section 121.
- Loss or zero gain: no withholding if the seller certifies there is no taxable gain.
You claim the exemption by completing the relevant section of Form 593 and giving it to escrow before closing.7Franchise Tax Board. Instructions for Form 593 Real Estate Withholding Statement If you are a nonresident selling California property, plan for the 3⅓% as part of your closing costs unless an exemption or the alternative calculation applies.
How Your Paycheck Amount Is Calculated
Four inputs drive the withholding on regular wages: your filing status, the number of allowances you claim, any additional withholding you request, and the EDD’s published withholding schedules. You provide the first three on Form DE 4.3California Employment Development Department. DE 4 – Employee’s Withholding Allowance Certificate
The method works roughly like this. Your employer starts with gross wages, subtracts a standard deduction (for 2026, $5,706 annually for single filers or $11,412 for married filers claiming two or more allowances), subtracts any additional estimated-deduction allowances, runs the result through the progressive rate brackets, and then subtracts a tax credit tied to the number of regular allowances claimed.8California Employment Development Department. 2026 Withholding Schedules – Method B More allowances means less tax withheld from each check.
If you had no California tax liability last year and expect none this year, you can claim exempt status on Line 3 of the DE 4. That status expires annually and must be renewed by February 15 to stay in effect.3California Employment Development Department. DE 4 – Employee’s Withholding Allowance Certificate
Form DE 4 and the Federal W-4 Are Separate
California does not accept the federal W-4 for state withholding. You file both: a W-4 with the IRS for federal, and a DE 4 with your employer for California. They work differently. The federal W-4 was redesigned in 2020 and no longer uses numbered allowances; it uses dollar-amount adjustments for dependents, other income, and deductions. The California DE 4 still uses the traditional allowance system, where each allowance reduces the wages subject to state withholding by a set amount.
This catches people. Update your W-4 after a life change and it is easy to forget the DE 4, which leaves your state withholding out of step with your federal. Adjust one, review the other.
Changing Your Withholding
You can give your employer a new DE 4 at any time. Common reasons to update it: marriage or divorce, the birth or adoption of a child, a large raise, picking up freelance income, or claiming new deductions or credits that change your overall tax picture.
To have more tax withheld and lower the chance of owing in April, claim fewer allowances or add a specific dollar amount on the additional-withholding line. To take home more each payday, claim more allowances. Your employer must put the change into effect by the start of the first payroll period ending 30 or more days after you submit the form.
A quick check after the change takes effect: compare the year-to-date California tax withheld on your pay stub against your estimated annual state tax. If the annualized withholding is off by more than a few hundred dollars from what you expect to owe, submit another DE 4 to fine-tune it.
If Too Little Is Withheld
Underwithholding means you owe the balance at filing. The FTB can also charge an estimated-tax penalty under Revenue and Taxation Code Section 19136, which works like interest on the shortfall for each quarter you underpaid rather than a flat fine.9California Legislative Information. California Revenue and Taxation Code 19136 The penalty does not apply if the tax owed after subtracting withholding and credits is less than $500 ($250 if married filing separately).
If the shortfall comes from negligence or a substantial understatement of income, California can add an accuracy-related penalty of 20% of the underpayment under RTC Section 19164, on top of the estimated-tax penalty.10California Legislative Information. California Revenue and Taxation Code 19164
To stay clear of the estimated-tax penalty, make sure withholding and estimated payments cover at least 90% of your current-year tax or 100% of last year’s tax. The second figure rises to 110% if your adjusted gross income exceeded $150,000 ($75,000 if married filing separately). Hit either threshold and you are protected even if you still owe a balance in April.
If Too Much Is Withheld
Overwithholding carries no penalty, but it has a real cost. Every extra dollar sent to the FTB is money you could have saved, invested, or used to pay down debt during the year. A large refund feels good at filing, but it is an interest-free loan to the state. If your refund consistently runs several hundred dollars or more, claiming an additional allowance on the DE 4 shifts that money back into your regular paychecks.
What on Your Pay Stub Isn’t Income Tax Withholding
Other California deductions on the stub are easy to mistake for income tax. State Disability Insurance (SDI) is withheld at 1.3% of all wages for 2026, with no wage ceiling, and funds short-term disability and paid family leave benefits.11California Employment Development Department. Contribution Rates, Withholding Schedules, and Meals and Lodging Values It is not a prepayment of income tax and does not appear as a credit on your return. A line labeled “CASDI” or “SDI” is separate from the “CA PIT” or “CA Tax” line, which is the actual state income tax withholding.
