What Is Considered Legally Blind in Texas: Tax Breaks and Driving Rules

In Texas, you are considered legally blind if the vision in your better eye, measured with the best available glasses or contact lenses, is 20/200 or worse, or if your visual field in that eye is no wider than 20 degrees. You only have to meet one of the two tests. The state uses the same definition the federal government uses, which is why the same medical finding opens the door to Social Security benefits, a larger federal standard deduction, a property tax exemption on your homestead, workplace accommodations, and services from Texas agencies.1State of Texas. The Two Tests, Explained

The Texas Human Resources Code sets out two independent thresholds, and meeting either qualifies you.1State of Texas. Texas Human Resources Code Chapter 91

  • Visual acuity of 20/200 or worse. With the best glasses or contacts available, your better eye sees at 20 feet what a normally-sighted person sees at 200 feet.
  • Visual field of 20 degrees or less. Even if your central sharpness is better than 20/200, your side vision is so narrow that the widest point of your better eye’s field is 20 degrees or less. A full visual field runs roughly 180 degrees, so 20 degrees is close to looking through a tube.

Both tests are run after correction. If glasses or contacts can bring your acuity above 20/200, you don’t qualify under the acuity prong no matter how poor your uncorrected vision is, and the same rule applies to the field test.3Social Security Administration. 2.00 Special Senses and Speech – Adult Conditions that commonly cross one of these lines include macular degeneration, advanced glaucoma, retinitis pigmentosa, and diabetic retinopathy. The field prong matters most for glaucoma and retinitis pigmentosa, which can wipe out peripheral vision while leaving central sight relatively intact.

How You Prove It

A licensed ophthalmologist or optometrist has to document the finding through a comprehensive eye exam. Acuity is measured in the better eye with the best available correction. Visual field is measured with perimetry; automated static threshold perimetry is standard, and Goldmann (manual kinetic) perimetry results are also accepted.3Social Security Administration. 2.00 Special Senses and Speech – Adult A comprehensive exam for this purpose typically runs $100 to $250 out of pocket if insurance doesn’t cover it.

Different benefits require different paperwork. For Social Security disability, you file an application (Form SSA-16 for SSDI) and the SSA pulls your records from your doctor and sends them to a state Disability Determination Services office. Expect roughly six to eight months for an initial decision.4Social Security Administration. How Long Does It Take to Get a Decision After I Apply for Disability Benefits For the property tax exemption, you file with your county appraisal district and attach medical documentation. For state vocational rehabilitation, you give proof of blindness to the Texas Workforce Commission.

One form to not confuse with the application: SSA-3441 is a Disability Report for appeals, used only if your initial claim was denied and you’re asking for reconsideration.5Social Security Administration. Form SSA-3441 – Disability Report – Appeal

What It Means for Driving

A common assumption is that losing your Texas driver’s license and being legally blind are the same line. They aren’t. The Department of Public Safety uses a tiered vision standard, and the cutoff for licensing is stricter than the legal blindness threshold.6Legal Information Institute. 37 Texas Admin Code 15.51 – Vision Tests

  • 20/40 or better in both eyes without lenses: no restrictions.
  • 20/50 or better in the best eye with lenses: license restricted to corrective lenses.
  • 20/60 to 20/70 in the best eye with lenses: restricted to corrective lenses, daytime driving only, 45 mph speed limit.
  • Worse than 20/70 in the best eye: no license issued.
  • Worse than 20/200 with lenses: considered blind for licensing purposes; no license issued.

So someone at 20/100 is not legally blind but still cannot hold a Texas license. Someone at exactly 20/200 is legally blind and also cannot drive.

Property Tax Exemption on Your Home

If you own a home and qualify as legally blind under the federal disability standard, Texas Tax Code Section 11.13 gives you an additional $60,000 exemption on the appraised value of your homestead for school district taxes. This stacks on top of the regular homestead exemption every homeowner gets.7State of Texas. Texas Tax Code 11.13 – Residence Homestead Cities, counties, and special districts can adopt their own additional exemptions for disabled homeowners with a floor of $3,000.8Texas Comptroller. Property Tax Exemptions

You apply through your county appraisal district with medical documentation of the blindness. Because the Tax Code ties “disabled” to eligibility for federal disability insurance, SSA recognition carries over.7State of Texas. Texas Tax Code 11.13 – Residence Homestead Once the disabled-person exemption is in place, your school district taxes are frozen at the amount assessed in the year you qualified, so a rising appraisal doesn’t raise that part of the bill.

Federal Standard Deduction

Legally blind filers get a larger federal standard deduction. For the 2025 tax year, the extra amount is $1,600 for married filers and $2,000 for unmarried filers, and the figure adjusts annually for inflation.9Internal Revenue Service. Topic No. 551, Standard Deduction The IRS definition matches the SSA and Texas standard, 20/200 or worse corrected acuity in the better eye or a field of 20 degrees or less, and you need a statement from your eye doctor to claim it.

Starting January 1, 2026, more people with blindness can also open ABLE (Achieving a Better Life Experience) accounts, which are tax-advantaged savings accounts for disability-related expenses. The ABLE Age Adjustment Act raises the age-of-onset cap from 26 to 46. Funds can go toward housing, transportation, and assistive technology without affecting means-tested benefits like SSI or Medicaid.

Social Security Benefits and the Higher Earnings Limit

The SSA runs a separate, more generous set of rules for blind claimants.2Social Security Administration. Special Rules for People Who Are Blind The clearest financial difference is the earnings cap. To keep SSDI, you generally can’t earn above the “substantial gainful activity” threshold. For 2026, that threshold is $2,830 per month for blind individuals, versus $1,690 for people with other disabilities.10Social Security Administration. Substantial Gainful Activity That is more than $13,000 a year in additional allowed earnings. Blind applicants also qualify under less restrictive work-history rules for SSDI and may be eligible for Supplemental Security Income if their income and assets fall under the SSI limits.

Workplace Accommodations

Under the Americans with Disabilities Act, employers with 15 or more employees have to provide reasonable accommodations to qualified workers with visual impairments. The EEOC has issued detailed guidance on what that looks like.11U.S. Equal Employment Opportunity Commission. Visual Disabilities in the Workplace and the Americans with Disabilities Act

Common accommodations include screen-reading software, screen magnification, optical character recognition scanners, and documents in large print or braille. Policy adjustments also count: allowing a guide dog in the office, modifying a dress code to permit tinted lenses or hats that reduce glare, or providing a qualified reader for materials a worker can’t access directly. Structural changes like brighter lighting and high-contrast signage can matter just as much. An employer can refuse an accommodation only by showing genuine undue hardship, a high bar for most mid-size and larger employers.

White Cane Law and Service Dogs

Texas law protects the right to use a white cane, guide dog, or other assistance device in any public place. The Texas Human Resources Code prohibits denying admission to public facilities based on disability or use of an assistance animal, and it bars public transportation from refusing passengers with disabilities or charging extra fares for guide dogs.12State of Texas. Texas Human Resources Code Chapter 121 – Participation in Public Life

Drivers in Texas must yield the right-of-way to any pedestrian carrying a white cane or accompanied by a guide dog. Stop fully at the intersection and let them cross; there is no need to honk or shout directions.

Under federal law, service dogs trained to assist blind individuals must be allowed in restaurants, hotels, stores, hospitals, and other places open to the public, even where pets are prohibited. A business may ask only two questions: whether the dog is a service animal required because of a disability, and what task it has been trained to perform. They cannot demand documentation, certification, or a demonstration.13U.S. Department of Justice ADA.gov. Service Animals
