Your date of lawful status in Missouri is the date your current federally authorized immigration status began, taken from your federal immigration documents. The Missouri Department of Revenue uses that date, together with the end date of your authorized stay, to decide what kind of driver’s license or non-driver ID you qualify for and how long it stays valid. State law bars the DOR from issuing a license that extends past your lawful presence in the United States.1Missouri Revisor of Statutes. RSMo 302.181
So the practical task is finding the right date on the right document. Which document controls depends on your status.
Where to Find Your Date on Each Document
Form I-94
Most non-citizens admitted to the U.S. receive a Form I-94 (Arrival/Departure Record). It shows the date you were admitted and an “Admit Until Date,” which is the last day you’re authorized to remain under that admission.2U.S. Citizenship and Immigration Services. Form I-94 Arrival/Departure Record Information for Completing USCIS Forms For F-1 students and J-1 exchange visitors, the I-94 shows “D/S” (Duration of Status) rather than a hard date, meaning you’re authorized to stay as long as you continue your program.3U.S. Customs and Border Protection. I-94 Fact Sheet Most I-94s are now electronic and can be retrieved at i94.cbp.dhs.gov, where records go back to 1983 for most admission classes.4I-94/I-95 Website. Travel Record for U.S. Visitors
Permanent Resident Card
If you’re a lawful permanent resident, look for the “Resident Since” date on your green card. That’s the date you were granted permanent residence. The card’s own expiration date is not the end of your status; it only means the physical card needs renewal.5U.S. Citizenship and Immigration Services. After We Grant Your Green Card
Employment Authorization Document
An EAD shows a “Card Expires” date, which is the last day your work authorization is valid under that card.6U.S. Citizenship and Immigration Services. Employment Authorization Document One recent change matters for 2026: as of October 30, 2025, DHS ended the automatic extension that used to give renewal applicants up to 540 days of continued work authorization while a new EAD was pending. That automatic extension no longer applies to applications filed on or after that date, with limited exceptions for TPS-related cases.7U.S. Citizenship and Immigration Services. Automatic Employment Authorization Document (EAD) Extension If your EAD has expired and you were counting on the auto-extension, your work authorization — and the date Missouri uses for your license — may already have ended.
Form I-797
USCIS issues Form I-797 (Notice of Action) to acknowledge receipt or approval of petitions. An I-797A functions as a replacement I-94 and lists your approved period of stay. An I-797B confirms approval of a worker petition such as an H-1B.8U.S. Citizenship and Immigration Services. Form I-797 Types and Functions If you’ve received an extension or change of status, this is usually where your current authorized period lives.
Visa Stamp — a Common Trap
The expiration date on the visa stamp in your passport is not the date that controls how long you can stay. The State Department is explicit: the visa expiration date only governs how long you may use that visa to seek entry at a port of entry, not how long you’re authorized to remain once admitted.9U.S. Department of State. What the Visa Expiration Date Means You could have an expired visa stamp and still be in lawful status if your I-94 date hasn’t passed. For Missouri’s purposes, don’t hand the DOR a visa stamp expecting it to set your license term.
Why Missouri Asks for This Date
Non-U.S. citizens applying for a Missouri driver’s license, non-driver ID, or instruction permit must present valid, unexpired immigration documents showing lawful status along with supporting documents that confirm the classification and length of authorized stay.10Cornell Law School. 12 CSR 10-24.448 – Documents Required for Issuance of a Driver License, Nondriver License, or Instruction Permit Lawful permanent residents can present an I-551 card, a passport stamped “Approved I-551” or “Processed for I-551,” or a reentry permit. Others present the documents matching their visa category, such as an I-94, EAD, or I-797 approval notice.11Missouri Department of Revenue. Documents Required to Obtain a Missouri Driver or Nondriver License
How Your License Expiration Is Set
Missouri sets your license or ID to expire on the same date as your immigration document, up to the normal state maximum. If your document shows Duration of Status rather than a specific date, Missouri issues a one-year license that you renew annually.11Missouri Department of Revenue. Documents Required to Obtain a Missouri Driver or Nondriver License For green card holders, Missouri recognizes that the card expiration doesn’t equal status expiration.
Fees
Fees track the length of the license, not the status itself. A standard Class F license costs $16.50 for up to three years and $25.50 for up to six years. If your immigration documents only support a shorter term, you’ll pay $16.50 for a license valid up to two years.12Missouri Department of Revenue. Permit/Driver License/Nondriver ID Fees Written and road test fees are separate.
REAL ID and Limited-Term Cards
REAL ID enforcement took effect May 7, 2025. A REAL ID-compliant license or ID is now required to board domestic flights and enter certain federal facilities.13Transportation Security Administration. REAL ID Under federal rules, states may issue REAL ID cards to people with temporary lawful status only as limited-term cards that cannot extend beyond the authorized stay. If there’s no set expiration on your stay, the maximum is one year. Each renewal requires fresh verification of continued lawful status, typically through the SAVE system, and the card must be marked on its face as limited-term.14eCFR. Part 37 Real ID Driver’s Licenses and Identification Cards
Lawful Status and Lawful Presence Are Not the Same
An unexpired I-94 date does not, by itself, mean you’re still in lawful status. USCIS treats lawful immigration status and a “period of authorized stay” as legally distinct categories.15U.S. Citizenship and Immigration Services. Chapter 3 – Unlawful Immigration Status at Time of Filing INA 245(c)(2) A student who drops out, or a worker who takes a job with an unauthorized employer, has failed to maintain status even if the date on the I-94 hasn’t passed. USCIS counts any such violation, even for a single day, and leaving and reentering the country does not erase it.16U.S. Citizenship and Immigration Services. Chapter 4 – Status and Nonimmigrant Visa Violations Filing an application for an immigration benefit also does not put you in lawful status; in most cases, status begins only when the application is approved.
What Happens If Your Authorized Date Passes
USCIS defines unlawful presence as any time in the U.S. after your authorized stay expires, and the consequences escalate with time.17U.S. Citizenship and Immigration Services. Unlawful Presence and Inadmissibility
- More than 180 days but less than one year of unlawful presence, followed by voluntary departure before removal proceedings begin: three-year bar to reentry.
- One year or more of unlawful presence, followed by departure or removal: 10-year bar.
- More than one year total, then reentry without authorization: permanent inadmissibility, with the only path back being 10 years outside the U.S. and then applying for consent to reapply.
While any of these bars is in effect, you generally cannot obtain a visa, be admitted at a port of entry, or adjust status to permanent resident without a waiver. The bars apply to overstays occurring on or after April 1, 1997.17U.S. Citizenship and Immigration Services. Unlawful Presence and Inadmissibility
Extending Your Date and Updating Your Missouri License
To stay longer than your current authorized period, file Form I-539 (Application to Extend/Change Nonimmigrant Status) with USCIS. The agency recommends filing at least 45 days before your stay expires, and the filing must go in before your current stay ends. Late filings can sometimes be excused, but only in limited circumstances.18U.S. Citizenship and Immigration Services. Application to Extend/Change Nonimmigrant Status For petition-based categories like the H-1B, the employer typically files the extension; once approved, USCIS issues a new I-797 showing the updated authorized period. F-1 students filing for a STEM OPT extension still receive an automatic work authorization extension of up to 180 days while the application is pending — this narrow extension survived the October 2025 rule change.7U.S. Citizenship and Immigration Services. Automatic Employment Authorization Document (EAD) Extension
Once you have the new documents in hand, take them to a Missouri DOR office. Your license won’t update on its own. Because Missouri ties your license term to the dates on your immigration documents, the only way to push your license expiration forward is to visit the DOR with the updated paperwork.
