Oklahoma exempts a wide range of purchases from its 4.5% state sales tax, and knowing what is exempt from sales tax in Oklahoma can save real money at the register. The main categories are groceries and food ingredients, prescription drugs and most medical equipment, motor vehicles (which pay a separate excise tax instead), direct purchases by federal, state, and local government, purchases by specific categories of nonprofits, resale inventory, manufacturing equipment, agricultural inputs, and clothing or footwear under $100 during the state’s August sales tax holiday. One caveat runs through almost everything below: most exemptions remove only the 4.5% state portion. City and county sales taxes usually still apply.1Oklahoma.gov. State Sales Tax on Food and Food Ingredients
Groceries and Food Ingredients
Since August 29, 2024, food and food ingredients have been exempt from Oklahoma’s 4.5% state sales tax. That covers milk, bread, fruits and vegetables, meat, pasta, eggs, frozen meals, snack foods, bottled water, and soft drinks in a bottle or can.1Oklahoma.gov. State Sales Tax on Food and Food Ingredients
Plenty of things in a grocery store are not covered. Prepared food sold by the retailer, including deli sandwiches, rotisserie chicken, and in-store sushi, remains taxable at the full state rate. So do alcoholic beverages, beer, dietary supplements, pet food, vitamins, toiletries, and over-the-counter medications.1Oklahoma.gov. State Sales Tax on Food and Food Ingredients
The part that catches people out: the grocery exemption removes only the state’s 4.5%. City and county sales taxes still apply to every food purchase, so you will still see tax on your receipt.1Oklahoma.gov. State Sales Tax on Food and Food Ingredients
Prescription Drugs and Medical Equipment
Prescription drugs for human use are exempt when prescribed, administered, or distributed by a licensed practitioner. The exemption also extends to medical appliances, medical devices, and other medical equipment, including corrective eyeglasses, contact lenses, and hearing aids, when provided under a practitioner’s authorization or purchased by an individual under a prescription or work order.2Justia. Oklahoma Statutes Title 68 Revenue and Taxation 68-1357.6 Drugs and Medical Devices and Equipment Exemption
Three additional categories carry their own exemption, each requiring a practitioner’s prescription or distribution:
- Prosthetic devices such as artificial limbs and replacement joints.
- Durable medical equipment like hospital beds, wheelchairs, and oxygen concentrators.
- Mobility-enhancing equipment, including walkers and crutches.2Justia. Oklahoma Statutes Title 68 Revenue and Taxation 68-1357.6 Drugs and Medical Devices and Equipment Exemption
Over-the-counter medications bought without a prescription are not covered.
Clothing and Footwear During the August Sales Tax Holiday
Oklahoma holds a three-day sales tax holiday each year, starting at 12:01 a.m. on the first Friday in August and ending at midnight on the following Sunday. During that weekend, any article of clothing or footwear priced under $100 is exempt from state sales tax.3Justia. Oklahoma Statutes Title 68 Revenue and Taxation 68-1357.10 Clothing or Footwear Exemption of Certain Sales Exceptions
Accessories, items designed primarily for athletic activity or protective use (steel-toed boots, football cleats), and clothing rentals are not included. Anything priced at $100 or more is fully taxable even during the holiday.4Oklahoma.gov. Sales Tax Holiday
Motor Vehicles Pay Excise Tax Instead
Buy a car, truck, or motorcycle in Oklahoma and you will not see sales tax on the transaction. Vehicle transfers pay an excise tax instead.5Justia. Oklahoma Statutes Title 68 Revenue and Taxation 68-2103 Tax on Transfer of Legal Ownership Use and First Registration of Vehicles
- New vehicles: 3.25% of the vehicle’s value.
- Used vehicles: $20 on the first $1,500 of value, plus 3.25% on the rest.
- Off-road ATVs and motorcycles: 4.5% of the actual sales price before any trade-in credit, minimum $5.
For commercial vehicles, trailers, and semitrailers registered to haul cargo on Oklahoma highways, the excise tax explicitly replaces all sales and use taxes.5Justia. Oklahoma Statutes Title 68 Revenue and Taxation 68-2103 Tax on Transfer of Legal Ownership Use and First Registration of Vehicles
Government and Nonprofit Purchases
Sales of tangible personal property or services directly to the United States, the State of Oklahoma, or any of its political subdivisions (cities, counties, school districts) are exempt.6Justia. Oklahoma Statutes Title 68 Revenue and Taxation 68-1356v2 Exemptions Governmental and Nonprofit Entities Private contractors working on government projects generally do not inherit that exemption and owe sales tax on materials, with a narrow carve-out for contractors working for specific entities such as Oklahoma municipalities, counties, public school districts, higher education institutions, rural water districts, and named authorities like the Grand River Dam Authority. Those contractors must present the exempt entity’s exemption letter, documentation of the contractual relationship, and a signed certification on each invoice.7Cornell Law Institute. Nonprofits are where Oklahoma’s rules trip people up. Federal 501(c)(3) status by itself does not give an organization an Oklahoma sales tax exemption. The legislature has designated specific categories that qualify, each with its own eligibility requirements beyond the IRS determination letter.8Oklahoma.gov. Oklahoma Sales Tax Exemption Packet Qualifying categories include:
- Food collection and distribution organizations primarily serving the needy.
- Children’s homes operated by a 501(c)(3) on church-owned property.
- Parent-teacher associations with an IRS 501(c)(3) determination letter.
- Community-based health centers providing primary care at no cost.
- Affordable housing nonprofits that build or remodel homes sold to low-income residents.
Each category requires its own application (Form 13-16-A) filed with the Oklahoma Tax Commission. A nonprofit that doesn’t match a legislated category pays sales tax like any other buyer.8Oklahoma.gov. Oklahoma Sales Tax Exemption Packet Public and private schools and higher education institutions have a separate exemption for materials, supplies, and equipment used to construct or improve school-owned buildings, provided they meet accreditation standards and hold 501(c)(3) status.9Cornell Law Institute. Disabled Veteran Exemption
Veterans receiving disability compensation at the 100% rate get a personal sales tax exemption, capped at $25,000 in qualifying purchases per year. The exemption also covers the veteran’s spouse and authorized household members buying on the veteran’s behalf.10Cornell Law Institute. Oklahoma Administrative Code 710:65-13-275 Exemption for Disabled Veterans in Receipt of Compensation at the 100 Percent Rate
Unremarried surviving spouses of qualifying veterans — and of service members who died in the line of duty — keep access to the exemption, but the cap drops to $1,000 in qualifying purchases per year.10Cornell Law Institute. Oklahoma Administrative Code 710:65-13-275 Exemption for Disabled Veterans in Receipt of Compensation at the 100 Percent Rate
Using the exemption requires an exemption card from the Oklahoma Tax Commission, presented at the time of purchase. Vendors must honor it.11Justia. Oklahoma Statutes Title 68 Revenue and Taxation 68-1361.2 Disabled Veterans Exemption Proof of Eligibility Required
Resale, Manufacturing, and Agricultural Purchases
Businesses can buy inventory for resale without paying sales tax, because the tax gets collected when the end customer buys the product. You need a valid Oklahoma sales tax permit and must give the vendor your permit number along with a written certification that the items are for resale. That certification can go on the invoice, in a separate letter, or on a Streamlined Sales and Use Tax Exemption Certificate.12Justia. Oklahoma Statutes Title 68 Revenue and Taxation 68-1357v4 Exemptions General
Manufacturers can buy machinery, equipment, and other tangible personal property used in a manufacturing operation tax-free. Production supplies like electricity and natural gas also qualify when used in the production process or to generate the heat and power manufacturing requires. If a single meter serves both manufacturing and non-manufacturing uses, the whole usage qualifies when the predominant use is manufacturing.13Justia. Oklahoma Statutes Title 68 Revenue and Taxation 68-1359 Exemptions Manufacturing14Cornell Law Institute. Oklahoma Administrative Code 710:65-13-150.1 Manufacturing Exemption Taxable and Exempt Transactions
Farmers and ranchers regularly engaged in agricultural production for profit can purchase feed, fertilizer, seed, and farm machinery exempt from sales tax. Feed for horses, mules, or draft animals used in agricultural production needs an invoice certification and the buyer’s Oklahoma agricultural exemption number. Building materials for livestock facilities follow a similar process, with the contractor providing a sworn statement that the materials are for an agricultural permit holder’s livestock facility.15Cornell Law Institute. Oklahoma Administrative Code 710:65-13-17 Certification Required for Sales Tax Exemption for Certain Agricultural Transactions
How to Claim an Exemption
At the register, you need an exemption certificate given to the vendor before or at the time of sale. It must show your name and address, the reason for the exemption, and your Oklahoma sales tax permit number when relevant. For repeat purchases from the same vendor, the certificate can stay on file instead of being presented every time.16Cornell Law Institute. Oklahoma Administrative Code 710:65-13-200 Exemption on Sales for Resale
Misusing an exemption certificate is a misdemeanor. A conviction for knowingly claiming an exemption you don’t qualify for carries a fine of double the tax that should have been collected, up to 60 days in jail, or both. The Oklahoma Tax Commission can also impose an administrative fine of up to $500, and the purchaser is personally liable for the tax, interest, and penalties.17Cornell Law Institute. Oklahoma Administrative Code 710:65-7-21 Streamlined Sales and Use Tax Exemption Certificate
Local Taxes Usually Still Apply
Oklahoma cities and counties levy their own sales taxes on top of the state’s 4.5%, and most state-level exemptions don’t touch them. Groceries are the clearest example, but the same pattern holds elsewhere. Residential electricity and natural gas are exempt from state sales tax, yet the statute explicitly keeps city, town, and county sales taxes in place.12Justia. Oklahoma Statutes Title 68 Revenue and Taxation 68-1357v4 Exemptions General Before counting on any exemption, check whether it covers the state rate only or the local rate too. For consumers, it’s almost always state only.
