Family leave in California runs on two separate programs that most workers use together: the California Family Rights Act (CFRA) protects your job for up to 12 unpaid workweeks, and Paid Family Leave (PFL) replaces roughly 70 to 90 percent of your wages for up to eight weeks. CFRA keeps your position waiting. PFL keeps money coming in. Neither one does the other’s job, and knowing which is which is the difference between a smooth leave and an expensive surprise.
Two Programs, Two Different Jobs
PFL is a state insurance benefit administered by the Employment Development Department. It sends you a check. It does not stop your employer from replacing you.
CFRA is an employment law. It forces a covered employer to hold your position (or a comparable one) open while you’re gone. It pays you nothing.
Most California workers who take family leave qualify for both and use them at the same time. If you qualify only for PFL and not CFRA, you can collect the benefit but your job is not legally protected. That gap catches people off guard, especially those working for small employers or those who haven’t been on the job long enough to meet CFRA’s thresholds.
What CFRA Protects
CFRA, codified at Government Code Section 12945.2, gives eligible employees up to 12 workweeks of unpaid, job-protected leave in a 12-month period. When you come back, your employer must reinstate you to the same position or one comparable in pay, benefits, and working conditions.1California Legislative Information. California Government Code 12945.2
CFRA reaches further than federal FMLA. It applies to employers with five or more employees, where FMLA requires 50.2California Civil Rights Department. Family Care and Medical Leave Quick Reference Guide As the employee, you have to meet two conditions:
- More than 12 months of service with your current employer.
- At least 1,250 hours worked in the 12 months before leave begins.
That hours threshold works out to roughly 24 hours a week. Part-timers above that line usually qualify; those below usually don’t.1California Legislative Information. California Government Code 12945.2
You don’t have to take CFRA leave in one block. For child bonding, leave comes in blocks of at least two weeks, with two shorter blocks allowed during the leave period.3California Civil Rights Department. Leave for Pregnancy Disability and Child Bonding Quick Reference Guide For leave to care for an ill family member, the minimum increment is whatever your employer treats as its shortest regular leave period, often a day or part of a day.
Reinstatement is strong but not absolute. An employer can refuse to bring you back only if it can prove your position would have been eliminated anyway, for example in a legitimate layoff that would have hit you regardless of leave. Replacing you or restructuring to cover your absence does not count. An employer can also deny reinstatement if it proves you obtained or used CFRA leave fraudulently.4Cornell Law School. Cal. What PFL Pays
PFL, authorized under Unemployment Insurance Code Section 3301, pays benefits for up to eight weeks within any 12-month period.5California Legislative Information. California Unemployment Insurance Code 3301 The benefit replaces about 70 to 90 percent of wages earned 5 to 18 months before your claim, with lower-paid workers getting the higher percentage.6Employment Development Department. Paid Family Leave Benefit Payment Amounts The maximum weekly benefit for 2026 is $1,765. There is no waiting period; benefits can start on the first day of leave.
PFL eligibility is wider than CFRA’s. You don’t need any minimum tenure with a specific employer. You must have earned at least $300 in wages subject to State Disability Insurance deductions in the 18 months before your claim, and you must be employed or looking for work when leave begins.7Employment Development Department. One boundary matters: PFL does not cover your own illness or disability. Time off for your own serious health condition falls under State Disability Insurance, a separate program. PFL is only for caring for others or bonding with a new child.
What Counts as Family Leave
PFL and CFRA cover overlapping reasons, with one key difference on your own health.
- Bonding with a newborn, newly adopted, or newly placed foster child, within the first year after arrival. Both programs.7Employment Development Department. Paid Family Leave
- Caring for a qualifying family member with a serious health condition. Both programs.5California Legislative Information. California Unemployment Insurance Code 3301
- Qualifying military exigencies when a close family member is deployed to a foreign country, such as arranging childcare, attending military ceremonies, handling deployment-related legal or financial matters, or supporting a service member on rest and recuperation. Both programs.8Employment Development Department. Paid Family Leave for Military Family
- Your own serious health condition. CFRA only; use State Disability Insurance for wage replacement.
California also defines family broadly. Both PFL and CFRA cover a spouse, registered domestic partner, child, parent (including in-laws and stepparents), grandparent, grandchild, and sibling.5California Legislative Information. California Unemployment Insurance Code 3301 Federal FMLA covers only a spouse, child, or parent.2California Civil Rights Department. Family Care and Medical Leave Quick Reference Guide
CFRA also lets you name a “designated person” when you request leave. That can be someone related by blood or someone whose relationship with you is the equivalent of a family tie. Your employer can limit you to one designated person per 12-month period.1California Legislative Information. California Government Code 12945.2
How Leave Stacks for a Birth Mother
This is where California family leave gets genuinely complicated. A birth mother who qualifies for everything can combine three programs for far more time off than any single one provides.
California’s Pregnancy Disability Leave (PDL) gives up to four months (about 17.3 weeks) of leave to employees disabled by pregnancy, childbirth, or a related condition. Federal FMLA runs concurrently with PDL, so both are consumed during the pregnancy disability period. CFRA does not run concurrently with PDL.9Cornell Law School. Cal. Code Regs. Tit. 2, 11093 – Relationship Between CFRA Leave and Pregnancy Disability Leave
Once pregnancy disability ends, you can start up to 12 workweeks of CFRA leave for baby bonding. Four months of PDL plus 12 workweeks of CFRA adds up to roughly seven months of job-protected time off. PFL benefits can be collected during portions of this leave, but PFL’s eight-week cap means it won’t cover the whole stretch.
Outside the pregnancy context, CFRA and FMLA generally run at the same time when you qualify for both, so you don’t get 12 weeks from each.
Filing a PFL Claim
File no earlier than the first day of leave and no later than 41 days after that date. Missing the 41-day window can mean losing benefits or outright denial.10Employment Development Department. Paid Family Leave Claim Process
The central form is the Claim for Paid Family Leave Benefits (DE 2501F). Part A collects your personal information, employer, last day worked, and leave start date. What else you need depends on the claim type:
- Bonding: documentation of your relationship to the child, such as a birth certificate, adoption agreement, or foster placement record.
- Care: the person you’re caring for completes Part C and their doctor completes Part D, the medical certification. Without the certification, EDD cannot process the claim.
- Military assist: supporting documents related to the deployment.
You can file through EDD’s SDI Online portal or by mail. Payments typically arrive on a state-issued debit card.11Employment Development Department. How to File a Paid Family Leave Claim by Mail
Health Insurance While You’re on Leave
During CFRA leave, your employer must keep your group health coverage going at the same level and on the same terms as if you were still working. That includes dental, vision, mental health, and dependent coverage if your plan has them. The duty lasts for the length of your CFRA leave, up to 12 workweeks.12New York Codes, Rules and Regulations. Cal. Code Regs. Tit. 2, 11092 – Terms of CFRA Leave
If you don’t come back after leave ends, your employer can recover the premiums it paid during your unpaid time off, unless the reason you didn’t return is a continuing serious health condition or other circumstances beyond your control.12New York Codes, Rules and Regulations. Cal. Code Regs. Tit. 2, 11092 – Terms of CFRA Leave Taking leave and then voluntarily quitting could leave you owing months of premiums.
Taxes on PFL
PFL benefits are federally taxable. EDD sends a Form 1099-G in January of the following year, and you report that amount on your federal return. California does not tax PFL benefits on your state return, under Revenue and Taxation Code Section 17083.13Employment Development Department. Paid Family Leave Benefits and Payments FAQs EDD does not automatically withhold federal taxes from PFL payments, so set some aside.
If Your PFL Claim Is Denied
EDD will send a Notice of Determination with an Appeal Form (DE 1000A). You have 30 days from the date on the notice to file an appeal, electronically or in writing. Late appeals can still be submitted with an explanation, and an Administrative Law Judge decides whether to accept them.14Employment Development Department. State Disability Insurance Appeals
Lost the DE 1000A? A detailed letter works, as long as it includes your Social Security number and clearly identifies the decision you’re appealing.14Employment Development Department. State Disability Insurance Appeals
