GAP insurance in Texas covers the shortfall between what your auto insurer pays for a totaled or stolen vehicle and what you still owe on the loan or lease. If you owe $20,000 and the insurer values the car at $15,000, the insurer pays $15,000 to your lender (minus your deductible) and you would owe the remaining $5,000 out of pocket. GAP coverage pays that $5,000. The shortfall is largest in the first couple of years of ownership, especially if you put less than 20 percent down or financed for 60 months or longer.1Texas Department of Insurance. Two Products, Two Regulators
Texas treats GAP as two distinct products, and the one you buy decides which rules apply, who you complain to, and how refunds work.
A GAP waiver agreement is a debt cancellation product sold by a lender or dealer. It isn’t technically insurance. The lender agrees to waive the balance your auto insurance doesn’t cover. These agreements are regulated by the Office of Consumer Credit Commissioner (OCCC) under the Texas Finance Code and the Texas Administrative Code.2Legal Information Institute. 7 Tex. Admin. Code 83.812 – Gap Waiver Agreement Debt cancellation agreements sold through retail installment contracts at dealerships fall under Texas Finance Code Chapter 354 and must be submitted to the OCCC for approval before a dealer can use them.3State of Texas. A GAP insurance policy is an actual insurance product regulated by the Texas Department of Insurance (TDI). You buy it through your auto insurer and add it to your existing policy. The coverage behaves the same way at claim time, but pricing, cancellation, and the complaint process all run through insurance channels instead of consumer credit channels.
Where to Buy GAP Coverage and What It Costs
You have three main places to buy it, and the price gap between them is wide.
- At the dealership, GAP waiver agreements typically cost several hundred dollars. The fee gets rolled into your loan balance, so you pay interest on it for the life of the loan.
- Through your auto insurer, adding GAP to an existing comprehensive and collision policy usually costs between $20 and $40 per year depending on the vehicle and insurer. You can cancel it any time.
- Some credit unions and banks offer their own GAP products at competitive rates, worth comparing before you sign anything at the dealership.
TDI recommends checking with your insurance agent before accepting dealer-offered GAP coverage to see whether your insurer has a better price.1Texas Department of Insurance. Do You Need Gap Insurance for Your Car? How Does It Work?
What Texas Law Requires the Seller to Tell You
No lender in Texas can require you to buy GAP coverage to get a loan. Under Texas Finance Code Section 342.4021, any lender offering a gap waiver agreement must give you a separate written notice, apart from the loan documents, stating that the agreement is not required to get the loan.4State of Texas. Texas Finance Code Section 342.4021 – Agreements Regarding Debt Suspension, Debt Cancellation, and Gap Waiver That disclosure must come before the lender shows you the agreement’s terms.
OCCC rules add further restrictions on licensed lenders. They cannot offer a gap waiver agreement if the original loan term is less than 48 months (unless the loan calls for a balloon payment), if the required disclosure hasn’t been provided, or if the purchase is made a condition of credit. The agreement cannot include exclusions beyond those listed in the administrative code, and the fee must be reasonable under maximum schedules the OCCC sets based on the amount financed.2Legal Information Institute. 7 Tex. Admin. Code 83.812 – Gap Waiver Agreement
For debt cancellation agreements under Chapter 354, the contract itself must spell out the cost, term, claim procedures, required documentation, refund calculation method, and a clear statement that the purchase isn’t required to get credit. All exclusions must be disclosed in plain language.5State of Texas. Texas Finance Code Section 354.004 – Required Debt Cancellation Agreement Language
When GAP Coverage Won’t Pay
GAP doesn’t cover every dollar of your remaining balance in every situation. Texas regulations allow gap waiver agreements to exclude losses in several categories:2Legal Information Institute. 7 Tex. Admin. Code 83.812 – Gap Waiver Agreement
- Losses from dishonest, fraudulent, or criminal conduct that results in a felony conviction.
- Damage that existed before the date of the loan.
- Mechanical or electrical failure unrelated to an accident or theft.
- Embezzlement or secretion by someone in lawful possession of the vehicle.
- Damage during a race or speed contest.
- Government confiscation.
GAP insurance policies issued by insurers may carry their own exclusion lists, so read the contract itself rather than assuming the categories match.
Three other situations catch people off guard:
Lapsed primary insurance. GAP only works if you maintain continuous comprehensive and collision coverage on the vehicle. Without a primary total-loss settlement, there is nothing for GAP to supplement, and the claim will be denied. Providers check this first.
Past-due loan amounts. GAP usually will not pay late fees or past-due payments. The balance used in the GAP calculation is your scheduled payoff, not the inflated balance from missed payments.
Rideshare and delivery driving. Most personal auto policies exclude commercial use. If your primary insurer denies a total-loss claim because you were driving for a rideshare or delivery service, GAP typically pays nothing, because it only pays the difference after your primary insurance settles.
One more point to tuck away: if you refinance your auto loan, your existing GAP coverage almost certainly ends, because gap waiver agreements are tied to the specific loan they were sold with. You would need to buy new coverage to stay protected.
When GAP Coverage Makes Sense, and When to Drop It
GAP earns its cost in specific situations:
- You put less than 20 percent down and are underwater from day one.
- You financed for 60 months or more, so the balance drops slowly while the car depreciates fast.
- You rolled negative equity from a trade-in into the new loan.
- You leased the vehicle. Many lessors require GAP, and even when they don’t, the gap between residual value assumptions and actual value can be large.
You can drop GAP once your loan balance falls below your vehicle’s market value. That crossover often happens around two years into ownership, though it depends on your loan terms and the car. TDI suggests periodically comparing your loan balance against online car value guides to decide whether to keep paying.1Texas Department of Insurance. Do You Need Gap Insurance for Your Car? Canceling and Getting a Refund
For a gap waiver agreement, the refund rules in Texas are specific. If you cancel within 60 days of the loan date and have not filed a claim, the lender must refund the entire fee. After 60 days, refunds use the pro rata method: remaining loan term divided by total loan term, applied to the original fee. The refund is applied to your loan balance rather than paid to you directly.2Legal Information Institute. 7 Tex. Admin. Code 83.812 – Gap Waiver Agreement
If you pay off your loan early, the lender must also provide a pro rata refund. This matters if you sell the car or refinance before the loan term ends; some borrowers simply forget they paid for GAP and never ask for the refund they are owed.2Legal Information Institute. 7 Tex. Admin. Code 83.812 – Gap Waiver Agreement
For debt cancellation agreements under Chapter 354, the contract itself must state how refunds are calculated and how to request cancellation in writing. If your contract doesn’t include these terms, it may not comply with Texas law.5State of Texas. Texas Finance Code Section 354.004 – Required Debt Cancellation Agreement Language
GAP insurance policies bought through your auto insurer work more simply. You can cancel at any time by contacting the insurer, and any premium adjustment happens through regular policy billing.
Filing a Claim and What the Provider Can Ask For
For a gap waiver agreement, Texas regulations limit the documents the provider can require to process a claim:2Legal Information Institute. 7 Tex. Admin. Code 83.812 – Gap Waiver Agreement
- A gap waiver claim form.
- Proof of your primary insurer’s loss settlement and payment.
- Verification of your primary insurance deductible.
- A copy of the police report, if one was filed.
For debt cancellation agreements under Chapter 354, the required documents must be spelled out in the contract, and the agreement must state that no documentation beyond what it lists is required.5State of Texas. Texas Finance Code Section 354.004 – Required Debt Cancellation Agreement Language
If the Claim Is Denied or Underpaid
Most GAP disputes are about how much the provider will pay, not whether they will pay. Common fights involve the loan balance used in the calculation, deductions for past-due amounts, and processing delays. Pull out your contract and check the exact formula for calculating the benefit before escalating, because many denials come from the borrower expecting coverage for amounts the contract explicitly excludes.
If you believe the provider is misapplying the contract, ask for a written explanation of the denial or reduction. That forces them to point to specific language, which either confirms the exclusion or reveals an error you can challenge.
Where you file a complaint depends on which product you have. For a GAP insurance policy, contact TDI through the online Consumer Complaint Portal or call the TDI Help Line at 800-252-3439, Monday through Friday, 8 a.m. to 5 p.m. Central time.6Texas Department of Insurance. Get Help with an Insurance Complaint For a gap waiver agreement or debt cancellation agreement sold through a dealer or licensed lender, the OCCC handles complaints at 800-538-1579.
Keep copies of the original gap agreement, your primary insurance settlement statement, loan payoff records, and all correspondence with the provider. If the regulator complaint process doesn’t resolve the dispute, an attorney who handles insurance or consumer finance cases can evaluate whether arbitration or a lawsuit makes sense based on the dollar amount involved.
