What Is Maximum Base Rent for NYC Rent-Controlled Units?

Maximum Base Rent in NYC is the ceiling rent that the state Division of Housing and Community Renewal (HCR) calculates every two years for each rent-controlled apartment, based on the building’s taxes, operating costs, and a fixed return on property value. It is almost never the rent a tenant actually pays. A separate figure, the Maximum Collectible Rent, is what shows up on the bill, and it moves toward the MBR in small, capped annual steps. The current cycle covers 2026–2027.1Homes and Community Renewal. 2026-27 MBR Standard Adjustment Factor

MBR Versus MCR: The Ceiling and the Bill

The MBR is a calculated maximum. The MCR is what the tenant is legally charged. The MCR is generally lower, often by a wide margin, and only creeps upward in controlled increments.2New York State Homes and Community Renewal. Fact Sheet #22: Maximum Base Rent Program (MBR): Questions and Answers for Owners

A simple example shows how this plays out. If a tenant’s MCR is $1,000 and the newly calculated MBR is $1,200, the landlord cannot jump the rent to $1,200. The MCR rises by a capped percentage, and if the MBR itself goes up again at the next recalculation (because the building’s taxes or operating costs rose), the gap can persist for years. That is why most rent-controlled tenants pay well below the theoretical maximum for their apartment.

Which Apartments the MBR System Covers

The MBR system applies only to apartments still under traditional rent control, which is governed by the Emergency Housing Rent Control Law.3Justia. New York Emergency Housing Rent Control Law In New York City, that generally means apartments in buildings put up before February 1, 1947, with a tenant who has lived there continuously since before July 1, 1971.4Homes and Community Renewal. Rent Control This is a shrinking pool.

Rent stabilization is a different program with different rules, and MBR does not apply there. Succession rights can keep a unit rent-controlled when a qualifying family member who has lived in the apartment as a primary residence takes over after the tenant of record dies or permanently leaves. Without a valid successor, the unit typically moves into rent stabilization once vacant, and the MBR framework no longer governs it.

How HCR Calculates the Ceiling

HCR builds the MBR from a building-wide figure called the Maximum Gross Building Rental, then divides it among individual apartments.5Cornell Law Institute. New York Comp. Codes R. and Regs. Tit. 9 2201.4 – Maximum Base Rents The building-wide figure adds up:

  • Real estate taxes recorded by the city’s finance administration.
  • Recorded water and sewer charges.
  • An operating and maintenance allowance covering fuel, utilities, payroll, repairs, replacement reserves, and miscellaneous costs.
  • A vacancy and collection loss figure set at 1% of the maximum gross building rental.
  • A return on capital value fixed at 8.5% of the property’s equalized assessed value, using the 1971–1972 equalized ratio of 1.754.5Cornell Law Institute. New York Comp. Codes R. and Regs. Tit. 9 2201.4 – Maximum Base Rents

When a building has commercial space or other non-residential income, the formula proportionally reduces the share of taxes, water charges, and capital return assigned to the residential units, so residential rents reflect residential costs. HCR then allocates the building-wide total across individual apartments using a room index value adjusted for floor location. A larger unit on a higher floor carries a proportionally larger share. The result is each apartment’s MBR for the cycle.

The Annual Cap on What a Tenant Actually Pays

Even when a new MBR comes in well above the current MCR, the collectible rent can only climb in limited yearly steps. Under the Housing Stability and Tenant Protection Act of 2019, the MCR can rise by the lesser of 7.5% per year or the average of the five most recent annual increases approved by the Rent Guidelines Board for one-year renewal leases.2New York State Homes and Community Renewal. So in a period when RGB increases have been averaging 2% or 3%, that lower number is the cap, not 7.5%. The MCR gets its own step-up in each of the two years of the cycle. The only ways to push rent above this annual cap are approved Major Capital Improvements or individual apartment improvements, both of which require their own HCR approval.

What Owners Must File for the 2026–2027 Cycle

The MBR runs on a two-year schedule. For the 2026–2027 cycle, owners of buildings with rent-controlled units must file MBR applications with HCR to receive any increase.1Homes and Community Renewal. 2026-27 MBR Standard Adjustment Factor If HCR approves the filing, it issues an Order of Eligibility and a Notice of Maximum Base Rent that sets the new ceiling for each rent-controlled unit in the building. Without that Order of Eligibility, there is no legal basis to raise rents under the MBR system for the whole cycle.

Violation Clearance and Service Certifications

This is where most applications get stuck. The owner must certify that every rent-impairing violation on record with the NYC Department of Housing Preservation and Development has been cleared, and that at least 80% of all other code violations have been corrected.6New York State Homes and Community Renewal. 2024-25 Maximum Base Rent (MBR) Application The cutoff date for which violations count depends on when the owner files: violations on record as of January 1 of the year preceding the cycle count for owners who file by June 30 of the relevant odd-numbered year, or violations from six months before filing if submitted later.

Certification goes on DHCR Form VC.2New York State Homes and Community Renewal. Fact Sheet #22: Maximum Base Rent Program (MBR): Questions and Answers for Owners Alongside it, the owner files an Operation and Maintenance and Essential Services Certification confirming heat, hot water, elevator maintenance, and other required services, and must show that specified amounts of annual rental income are being spent on actual operation and maintenance.6New York State Homes and Community Renewal. 2024-25 Maximum Base Rent (MBR) Application The forms carry explicit warnings about the legal consequences of false certifications.

Serving Tenants Before the Increase Can Be Collected

The Order of Eligibility is not enough on its own. Before any increase becomes collectible, the landlord must personally serve each affected tenant with a Notice of Increase in MBR and MCR Computation on DHCR Form RN-26S or RN-26, showing the specific dollar amount of the increase and the new MCR.7New York State Homes and Community Renewal. 2022-2023 Maximum Base Rent (MBR) Binder The landlord also files a Master Building Rent Schedule with HCR listing the MBRs and MCRs for every rent-controlled apartment in the building.2New York State Homes and Community Renewal. Fact Sheet #22: Maximum Base Rent Program (MBR): Questions and Answers for Owners Skip the service step, or fail to document it, and the higher rent cannot legally be collected even with HCR’s approval in hand.

Challenging an MBR Order

Tenants (and owners) can challenge an MBR order by filing Form RA-94, titled “MBR Challenge Re: Maximum Base Rent Order.”8Homes and Community Renewal. Tenant/Owner Forms For tenants, the usual grounds are the landlord’s failure to maintain essential services like heat or hot water, or unresolved building violations that the landlord claimed were corrected. The challenge must be filed within the deadline printed on the MBR order.

If HCR finds the objection valid, it can revoke the Order of Eligibility or reduce the increase until the owner corrects the problems. The strongest challenges pair specific HPD violation numbers with photos or other records showing the condition still exists, along with dated communications to the landlord about repairs or service interruptions.

When the Rent-Controlled Tenant Leaves

MBR only applies while the apartment stays rent-controlled, and that status depends on unbroken occupancy. If the tenant of record permanently vacates and no qualifying family member claims succession rights, the apartment typically moves into rent stabilization. The MBR framework stops governing the unit, and future increases follow RGB guidelines instead. Landlords who assume this transition is automatic without filing the proper paperwork with HCR run into administrative problems later.
