New York’s Disability Benefits Law, usually shortened to NY DBL, is a state-mandated short-term disability program that pays most private-sector employees a weekly cash benefit when an off-the-job injury or illness keeps them from working. The benefit is 50% of your average weekly wage, capped at $170 per week, for up to 26 weeks in any 52-week period.1New York State Senate. New York Workers Compensation Law 204 – Disability and Family Leave During Employment You claim it by filing Form DB-450 within 30 days of the start of your disability.
What DBL Covers and What It Doesn’t
DBL applies only to conditions that are unrelated to your job. A broken leg from a weekend fall, recovery from surgery, a serious illness, or pregnancy and childbirth all qualify. Injuries or illnesses caused by your work go through workers’ compensation instead, and the two programs don’t overlap.
Pregnancy is treated as a qualifying disability on its own. The standard covered period is four weeks before your due date and six weeks after a vaginal delivery, or eight weeks after a cesarean.2NYSIF. Who’s Eligible
You generally become eligible after four consecutive weeks of employment with a covered employer. There’s no minimum number of hours per week, so part-time workers accrue eligibility on the same four-week clock as full-time workers.
Two situations give you immediate eligibility with no waiting period. If you were already covered under a previous employer and move directly to another covered employer, you’re protected on your first day at the new job. The same is true if you were collecting unemployment benefits right before starting.3New York State Workers’ Compensation Board. Disability Benefits
You can also qualify after your employment ends. If your disability begins within four weeks of your last day of work, you file through your most recent employer’s insurance carrier. If more than four weeks have passed and you’re on unemployment, the claim goes to the New York State Special Fund for Disability Benefits, with Form DB-450 mailed directly to the Workers’ Compensation Board’s Disability Benefits Bureau.3New York State Workers’ Compensation Board. Disability Benefits Note that unemployed claimants face a stricter standard: you must be unable to perform any work you’re reasonably qualified for by training and experience, not just unable to do your most recent job.
Workers Who Aren’t Covered
Several groups fall outside the DBL mandate:
- Government employees of the state, counties, cities, or other public entities, unless the employer has voluntarily opted in.4Workers’ Compensation Board. Disability and Paid Family Leave Benefits Coverage Voluntary Coverage
- Certain employees of religious, charitable, or educational nonprofits, depending on the nature of the work.
- Students working for the school, college, or university where they’re enrolled.
- Independent contractors. Only employees qualify, though the Workers’ Compensation Board can reclassify a misclassified worker if the facts support it.
- Domestic workers in private homes who put in fewer than 20 hours per week or work fewer than 30 days in the calendar year.5New York State Senate. New York Code WKC 202 – Covered Employer
Even in excluded categories, an employer can choose to provide voluntary coverage, so it’s worth asking HR whether DBL is part of your benefits.
How Much You Get, and For How Long
DBL pays 50% of your average weekly wage, calculated from your earnings over the eight weeks before your disability began. The hard ceiling is $170 per week, a figure unchanged since May 1, 1989.1New York State Senate. New York Workers Compensation Law 204 – Disability and Family Leave During Employment If you earn $1,000 a week, your 50% calculation would be $500, but you still receive only $170. If your average weekly wage is under $20, you receive your full average wage.
Every new claim has a seven-day waiting period. Benefits start on the eighth consecutive day of disability, and you receive nothing for that first week, although those days still count toward the total benefit period.1New York State Senate. New York Workers Compensation Law 204 – Disability and Family Leave During Employment The overall cap is 26 weeks of benefits within any 52-consecutive-week period, whether that time off comes from one disability or several.6New York State Insurance Fund. One rule catches people off guard. If the same or a related condition causes successive periods of disability separated by less than three months, the law treats them as a single continuous disability.1New York State Senate. New York Workers Compensation Law 204 – Disability and Family Leave During Employment A relapse within 90 days doesn’t trigger a new seven-day waiting period.
Because $170 is a floor-level safety net rather than real income replacement, many employers offer supplemental short-term disability coverage through private insurers. Check your benefits packet.
What You Pay Into It
Your employer can deduct a small contribution from your paycheck toward DBL premiums. The maximum is 0.5% of your wages, capped at $0.60 per week.7New York State Senate. New York Code WKC 209 – Contributions by Employees At the cap, you’d pay no more than $31.20 a year. The employer picks up the rest.
Don’t confuse this with the separate Paid Family Leave contribution. For 2026, the PFL employee deduction is 0.432% of gross wages, up to $411.91 for the year.8New York Paid Family Leave. How to File a Claim
The form is DB-450, “Notice and Proof of Claim for Disability Benefits.” It has three parts, each completed by a different person:9Workers’ Compensation Board. New York State Notice and Proof of Claim for Disability Benefits
- Part A, which you complete, covers your personal information, the date your disability began, your last day of work, and wages over the previous eight weeks.
- Part B is for your healthcare provider: diagnosis, limitations, treatment dates, and an estimated return-to-work date. A physician, chiropractor, dentist, podiatrist, psychologist, or certified nurse midwife can sign it.
- Part C goes to your employer, which verifies wage history, date of hire, and any DBL or PFL time used in the past 52 weeks. The employer must return the form with Part C completed within three business days.
If your employer stalls on Part C, send the form directly to the insurance carrier with Parts A and B filled in. The carrier cannot deny your claim solely because your employer failed to complete its section.9Workers’ Compensation Board. New York State Notice and Proof of Claim for Disability Benefits
In most cases, you submit the completed form to your employer or your employer’s disability carrier.2NYSIF. About Your Disability Benefits Claim If you don’t know who the carrier is, ask HR or check with the Workers’ Compensation Board.
The 30-Day Deadline
You have 30 days from the start of your disability to file.10New York State Senate. New York Code WKC 217 – Notice and Proof of Claim Missing the deadline doesn’t automatically kill the claim, but the carrier isn’t required to pay benefits for any period more than two weeks before the date you actually submit your proof. A two-month delay can erase weeks of benefits.
If you can show that filing on time wasn’t reasonably possible, say you were hospitalized and incapacitated, the Board can waive the penalty. The deadline also doesn’t apply to claimants who are mentally incompetent, physically incapable of filing, or minors without a legal guardian.10New York State Senate. New York Code WKC 217 – Notice and Proof of Claim
What Happens After You File
The insurance carrier has 18 days from receiving your completed proof of disability to either begin paying benefits or notify you of a denial. Late payments accrue simple interest from the 10th day after notice was given, and carriers that delay without good cause face an additional penalty of up to 25% of the unpaid benefit amount.11New York State Senate. New York Workers Compensation Law 220 – Penalties
A denial must come in writing within 18 days, followed by a formal rejection within 45 days of receiving your proof. The notice should explain the reasons and tell you how to request a review.
Appealing a Denial
If your claim is denied, you can request a review through the Workers’ Compensation Board. The process may start with conciliation, an informal resolution attempt, and can proceed to a hearing before a Workers’ Compensation Law Judge.12New York State Workers’ Compensation Board. Workers Compensation Issue Resolution – An Introduction If the carrier ignores a Board inquiry about your review, the claim is deemed approved. You have 30 days to appeal a judge’s decision to a three-member Board panel.
If Your Employer Doesn’t Have Coverage
Employers are required by law to carry DBL insurance, and noncompliance is a misdemeanor with escalating fines.11New York State Senate. New York Workers Compensation Law 220 – Penalties From your side, what matters is that an uninsured employer doesn’t leave you without a benefit. You can file a claim directly with the Workers’ Compensation Board, which can then pursue the employer for the unpaid benefits you should have received. You’re protected from retaliation for reporting a coverage violation.
Using DBL With Paid Family Leave
DBL and Paid Family Leave are separate benefits, and you cannot collect both at the same time.13New York Paid Family Leave. Paid Family Leave and Other Benefits You can, however, use them back-to-back, and the combined total cannot exceed 26 weeks in any 52-week period.
After childbirth, you generally have two paths. You can take DBL first for physical recovery and then switch to PFL for bonding at any point during the baby’s first 12 months. Or you can skip the disability period and go straight to PFL. Each benefit needs its own application with its own documentation, so plan the sequence before you file.13New York Paid Family Leave. Paid Family Leave and Other Benefits PFL pays 67% of your average weekly wage (capped at 67% of the statewide average weekly wage), which is substantially more than the $170 DBL maximum, and that difference is worth factoring into the order you use them in.
