What Is NY Withholding Tax and How Does It Work?

New York withholding tax is the state income tax your employer takes out of each paycheck and sends to the New York State Department of Taxation and Finance in your name, so you pay your yearly state tax in small installments instead of one lump sum at filing time. If you live or work in New York City or Yonkers, local income tax comes out of the same check through the same process. How much is removed depends on your filing status, the allowances you claim on Form IT-2104, and what you earn in that pay period.

How the Paycheck Deduction Works

Any employer that keeps an office or does business in New York and pays wages has to withhold state income tax from those wages.1New York State Senate. New York Tax Law 671 – Requirement of Withholding Tax From Wages The employer calculates the amount so that, spread across the year, what gets pulled from your checks lines up roughly with the state tax you’ll owe for the year. Treat it as prepayment on an installment plan.

When you file your return, every dollar withheld gets credited against your actual tax bill. Too much withheld means a refund. Too little means you owe the difference in April. The point of the system is to land close to even when your IT-2104 is filled out correctly, though a raise, a new job, a move into or out of the city, or a second earner in the household can throw the math off.

Who Has New York Tax Withheld

Residents of New York owe state income tax on all their income no matter where the employer sits, so withholding applies to every paycheck a resident gets from a New York employer. Nonresidents get withholding too when their wages come from a New York source, typically because they are physically working in the state.2Cornell Law School. 20 NYCRR 176.1 – Employer’s Failure to Withhold New York State Personal Income Tax

Remote Workers and the Convenience of the Employer Rule

If you live outside New York but work remotely for a New York employer, do not assume you escape New York tax. Under the state’s convenience of the employer rule, wages you earn working from home for a New York employer are treated as New York-source income subject to withholding when you work remotely for your own convenience rather than out of a necessity for the employer.3Tax.NY.gov. TSB-M-06(5)I – New York Tax Treatment of Nonresidents and Part-Year Residents Application of the Convenience of the Employer Test to Telecommuters and Others Telecommuters in New Jersey, Connecticut, and other nearby states regularly get caught by this.

No Reciprocity With Neighboring States

New York has no reciprocal tax agreement with any neighboring state. A New Jersey resident commuting into a New York office still has New York tax withheld from every check. You then claim a credit on your home-state return for the tax paid to New York to avoid being taxed twice on the same wages. The credit works, but your money sits with New York during the year.

Independent Contractors Are Not Withheld

Only employees have tax withheld. If you are paid as an independent contractor, no New York income tax comes out of your checks, and you are responsible for sending your own estimated payments to the state, usually each quarter. Whether you are an employee or a contractor depends on how much control the hiring company has over your work, including your schedule, your tools, and how you perform the job.4Internal Revenue Service. NYC and Yonkers Local Taxes Come Out of the Same Check

State withholding is only part of the picture if you live in New York City or Yonkers. Both impose local income taxes collected through the same payroll process as the state tax, so the amount missing from your paycheck is noticeably larger than it would be elsewhere in the state.

New York City Residents

City residents pay a local income tax on top of the state tax, with rates running from 3.078% at the bottom bracket to 3.876% on income above $50,000 for single filers. It applies to residents of the five boroughs only. If you move into or out of the city during the year, file an updated IT-2104 with your employer so the city portion starts or stops.5Tax.NY.gov. Yonkers Residents and Nonresidents

Yonkers residents pay an income tax surcharge figured as a percentage of their state tax; for withholding on supplemental wages, the Yonkers resident rate is 1.95975%. Nonresidents who earn wages inside Yonkers pay a separate earnings tax of 0.50%, also withheld through payroll.6Tax.NY.gov. NYS-50-T-Y – Yonkers Withholding Tax Tables and Methods

Setting Your Withholding With Form IT-2104

Your employer cannot guess how much to take out. You tell them by filing Form IT-2104, the Employee’s Withholding Allowance Certificate, which is separate from the federal W-4.5Tax.NY.gov. Form IT-2104 Employee’s Withholding Allowance Certificate On the form you declare your filing status (single, married, or head of household), the number of allowances you want to claim, and any extra dollar amount you want withheld per pay period to cover other income. The form also asks whether you live in New York City or Yonkers, which is how the local withholding gets switched on.7Tax.NY.gov. Your employer feeds the information from your IT-2104 into the state’s published withholding tables, which turn your filing status, pay frequency, and gross wages into a specific dollar amount per paycheck. New York uses graduated rates, so higher earners have a larger percentage pulled out. The state updates the tables when rates change.

Two Earners in the Household

If both you and your spouse work and your combined wages are under $107,650, the IT-2104 instructions tell each of you to check the “Married, but withhold at higher single rate” box and split your total allowances between the two employers. Skip that step and each employer withholds as if its paycheck is your entire household income, which usually leaves you underwithheld at year end.7Tax.NY.gov. The Narrow Exemption

A small group of workers can file Form IT-2104-E instead and have no New York tax withheld at all. To qualify you must be under 18, over 65, or a full-time student under 25, and you must have had no New York income tax liability last year and expect none this year.8Tax.NY.gov. Form IT-2104-E Certificate of Exemption From Withholding Year 2026 Military spouses covered by the Servicemembers Civil Relief Act can also claim it. The exemption certificate expires every April 30, so you have to refile it each year if you still qualify.9Cornell Law School. 20 NYCRR 171.8 – Exemption From Withholding of New York State Personal Income Tax for Certain Employees Incurring No New York State Personal Income Tax Liability Everyone else uses the regular IT-2104.

How It All Settles at Year End

After the calendar year closes, your employer issues a W-2 showing your total wages and the federal, state, and local tax withheld. The deadline to get W-2s to employees is January 31.10Social Security Administration. Deadline Dates to File W-2s You carry the state and local withholding figures from the W-2 onto your New York return: Form IT-201 if you are a full-year resident, Form IT-203 if you are a nonresident or part-year resident.

The withholding amount on your W-2 lands on the return as a credit, reducing what you owe dollar for dollar. If the IT-2104 was set correctly, you should owe little and get back little. A big balance due or a big refund is a signal to revisit the form and adjust your allowances for next year.
