What Is Tax, Title, and License in Texas: Sales Tax, Title Fee, and Registration

Tax, title, and license in Texas are the three state charges layered onto every vehicle purchase: a 6.25% motor vehicle sales tax on the price you pay, a one-time title fee of $28 or $33 depending on your county, and annual registration that starts at $51.75 before local add-ons. All of it is due within 30 days of the sale, and the penalty for missing that window is $25 right away plus another $25 for each month you stay late.

The 6.25% Sales Tax

Texas charges 6.25% on the full purchase price of the vehicle, including any dealer add-ons rolled into the deal.1State of Texas. Texas Tax Code 152.021 – Retail Sales Tax A $30,000 vehicle generates $1,875 in tax. Cities and counties don’t layer their own motor vehicle sales tax on top; the 6.25% is the whole rate.

Private-Party Sales and Standard Presumptive Value

Buy from a private seller and the state checks your reported price against its Standard Presumptive Value (SPV) for that vehicle. If you paid at least 80% of the SPV, tax is based on what you actually paid. If you paid less, tax is calculated on 80% of the SPV instead.2Texas Comptroller of Public Accounts. Standard Presumptive Value – Motor Vehicle Tax Guide

If the vehicle is genuinely worth less than that floor because of a rebuilt title, high mileage, or damage, you can submit a certified appraisal on Form 14-128 and be taxed on the appraised value.2Texas Comptroller of Public Accounts. Standard Presumptive Value – Motor Vehicle Tax Guide

Trade-In Credit

A trade-in handled through the same transaction reduces the taxable amount. On a $30,000 purchase with a $10,000 trade-in, you owe 6.25% on $20,000, saving $625.3Texas Comptroller of Public Accounts. Trade-Ins – Motor Vehicle Tax Guide Selling your old vehicle separately forfeits that credit.

Gifts and Military Buyers

Vehicles gifted between eligible family members are taxed at a flat $10, and community-property transfers between spouses owe no tax at all.4Texas Comptroller of Public Accounts. Family Transfers – Motor Vehicle Tax Guide Calling a transaction a “gift” to an ineligible recipient does not avoid the 6.25% rate. Active-duty U.S. military members stationed in Texas are not exempt from motor vehicle sales tax; the Servicemembers Civil Relief Act does not reach this tax.5Texas Comptroller of Public Accounts. Military Personnel – Motor Vehicle Tax Guide Foreign military personnel attached to a NATO force, and their dependents, are exempt.

Title Fee: $28 or $33

The title fee is a one-time charge for the certificate of title issued in your name. If you live in a county classified as a nonattainment area under the federal Clean Air Act or an affected county under the Texas Health and Safety Code, you pay $33. Everywhere else, $28.6State of Texas. Texas Transportation Code 501-138 – Collection and Disposition of Fees Most buyers in or near Dallas-Fort Worth, Houston, Austin, San Antonio, and El Paso pay the $33 rate.

Annual Registration

The state base registration fee for passenger vehicles and light trucks of 6,000 pounds or less is $50.75.7State of Texas. Inspection Replacement Fee

Texas eliminated the annual safety inspection for non-commercial vehicles in January 2025 under House Bill 3297 and replaced it with a $7.50 inspection replacement fee collected at registration each year. A brand-new vehicle that has never been registered anywhere pays $16.75 upfront to cover the first two years.9Texas Department of Public Safety. Vehicle Safety Inspection Changes Take Effect January 2025 Commercial vehicles still need a passing safety inspection before registration.

Emissions Testing

Seventeen counties still require a passing emissions test before registration: Brazoria, Collin, Dallas, Denton, El Paso, Ellis, Fort Bend, Galveston, Harris, Johnson, Kaufman, Montgomery, Parker, Rockwall, Tarrant, Travis, and Williamson.8Texas Department of Motor Vehicles. County Add-Ons

Counties add their own fees for roads, bridges, and local processing, and the amounts vary. Expect your all-in registration cost to land somewhere between $70 and $90 for a standard passenger vehicle, depending on where you live. Your renewal notice each year shows the exact total.

What to Bring

The core document is Form 130-U, the Application for Texas Title and/or Registration, available at the county tax office or on the TxDMV website.10Texas Department of Motor Vehicles. Form 130-U It captures the VIN, sale price, odometer reading, and buyer and seller information.

Bring the following to your County Tax Assessor-Collector’s office:

  • Proof of Texas liability insurance meeting the state minimums of $30,000 per person and $60,000 per accident for bodily injury, plus $25,000 for property damage.11Texas Department of Insurance. Tips to Help You Shop for Auto Insurance
  • A Texas driver’s license or state-issued photo ID.
  • The signed title from the seller on a private-party purchase. Dealers handle this for you on a dealer sale.
  • Emissions test results, if you live in one of the 17 counties above.

New Texas residents titling an out-of-state vehicle also need the prior state’s title or registration, and the Comptroller may charge either a $90 new-resident tax or the difference between the tax already paid elsewhere and the Texas 6.25% rate.8Texas Department of Motor Vehicles. New to Texas

The 30-Day Deadline

You have 30 days from the sale date to title and register the vehicle in your name.13Texas Department of Motor Vehicles. Buying or Selling a Vehicle Miss it and you owe a $25 penalty immediately plus $25 for each additional month you remain delinquent. Neither the county tax office nor TxDMV can waive or reduce these penalties.14Texas Department of Motor Vehicles. Title Penalties Press Release Three months late on a private-party purchase means $75 added to the bill before you’ve paid a cent of the tax or standard fees. Private sales are where this trips people up most often, because no dealer is driving the paperwork for you.
