What Is the Average Wrongful Death Settlement in California?

The average wrongful death settlement in California is roughly $973,000, based on nearly 1,000 cases resolved between 2019 and 2024, but the median is closer to $295,000. The gap between those two numbers is the real story. A handful of very large verdicts pull the average up while most families settle for considerably less. Many claims resolve between $500,000 and $5 million, and jury verdicts tend to land in the $1 million to $5 million range.1Danko Law. What any particular family receives depends less on an average and more on the specifics of the case.

What Actually Moves the Number

There is no formula. A few factors do most of the work:

Cause of death also matters. Trucking cases generally recover more than passenger-car cases because of larger commercial policies. Reported product liability recoveries have reached roughly $10.6 to $10.8 million in individual cases, and a single pipeline explosion case produced a $10.65 million recovery.6GJEL Accident Attorneys. What Families Can and Cannot Recover

California splits wrongful death damages into economic and non-economic categories, and there is no cap on either in a standard (non-medical) wrongful death case.7CMS Law. How to Calculate Wrongful Death Damages

Economic damages cover measurable losses: the income and financial support the decedent would have provided over their remaining lifetime, the value of household services like cooking, cleaning, and childcare, funeral and burial costs, pre-death medical expenses, and the loss of expected benefits such as health insurance and retirement contributions.8Justia. CACI 3921 – Wrongful Death Damages Projecting future earnings generally requires an economist, who weighs current salary, career trajectory, inflation, and the shorter of the decedent’s or the surviving plaintiff’s life expectancy.3Helbock Law. How Are Damages Calculated in a Wrongful Death Lawsuit Future economic damages must be reduced to present cash value.

Non-economic damages compensate the intangible losses: love, companionship, comfort, care, moral support, protection, guidance, loss of sexual relations, and loss of the decedent’s training.8Justia. CACI 3921 – Wrongful Death Damages These often make up the largest portion of a verdict.9Advocate Magazine. Arguing Non-Economic Damages in a Wrongful Death Case There is no fixed formula. Under California’s standard jury instruction (CACI 3921), jurors use their own judgment and common sense.10Plaintiff Magazine. Three categories are off the table. California bars recovery for the family’s own grief, sorrow, or mental anguish. The decedent’s own pain and suffering is excluded from the wrongful death action itself. Punitive damages are prohibited except in the narrow case of a felony homicide with a conviction.8Justia. Medical Malpractice Cases Are Capped

When the death results from medical malpractice, non-economic damages are capped. Under MICRA, as updated by Assembly Bill 35 in 2022, the wrongful death cap started at $500,000 in 2023 and increases by $50,000 each year until it reaches $1 million.11State of California Governor’s Office. Governor Newsom Signs Legislation to Modernize California’s Medical Malpractice System For 2026, the cap is $650,000.12Chain Law. California Medical Malpractice Damage Caps Economic damages remain uncapped.

A 2025 appellate decision, Ng v. Superior Court, held that when a family brings both a wrongful death claim and a survival action from the same malpractice incident, each claim gets its own separate MICRA cap. The Fourth District Court of Appeal reasoned that the two claims address “separate and distinct” injuries, with the wrongful death claim compensating heirs and the survival action compensating the estate.13Metropolitan News-Enterprise. Survival Actions, and a Major 2026 Change

A survival action is a separate claim that often runs alongside wrongful death. It compensates the decedent’s estate for damages the decedent personally suffered between the wrongful act and death: medical expenses, lost wages, and property damage. Punitive damages are available in a survival action if the defendant acted with malice, fraud, or oppression, which is how families often reach punitive damages that the wrongful death claim itself does not allow.14Shouse Law Group. Survival Action

A significant change took effect in 2026. SB 447, which temporarily let survival actions include damages for the decedent’s pain, suffering, and disfigurement, expired on January 1, 2026, and the legislature’s attempt to extend it through SB 29 was not enacted.15Daily Journal. Survivors Will No Longer Recover Pain and Suffering Damages Actions filed by December 31, 2025, preserve those non-economic survival damages. Cases filed on or after January 1, 2026, are limited to economic damages and, where authorized, punitive damages.16GRSM. What Record Verdicts Look Like

Recent California verdicts have far exceeded historical averages, and they explain why the average sits so much higher than the median. A sampling from 2025:

What the Family Actually Keeps

The gross settlement is not the take-home. Three deductions and divisions matter.

Attorney fees. California wrongful death attorneys almost always work on contingency. The standard fee is one-third of the gross recovery if the case settles before a lawsuit is filed, rising to 40% once litigation begins or the case goes to trial. Medical malpractice cases carry lower MICRA caps on fees: 25% pre-filing and 33% after litigation starts.21JNY Law. What Are Contingency Fees and How Do Injury Attorneys Get Paid Litigation costs such as filing fees, expert witnesses, and depositions sit on top of the percentage and are typically advanced by the firm, then deducted from the settlement.22Victims Lawyer. How heirs split the money. After fees and costs, multiple family members divide the remainder by agreement or, if they cannot agree, by court order. The allocation is not based on inheritance shares. Courts apportion the funds based on the proportion each heir’s personal loss bears to the losses of the others.23Advocate Magazine. Conflict Issues in Wrongful Death Actions A spouse who depended heavily on the decedent’s income may receive a larger share than a financially independent adult child. The defendant has no say in how heirs divide the money. A minor’s share typically goes into a blocked account, trust, or structured arrangement until the child reaches adulthood.24GJEL Accident Attorneys. How Is Compensation Divided

Taxes. Wrongful death settlements are generally not taxable. Under Internal Revenue Code Section 104(a)(2), damages received on account of personal physical injuries or sickness are excluded from gross income, and California wrongful death awards are compensatory. The main exception is punitive damages from a survival action, which are generally taxable as income. Interest earned on a settlement may also be taxable.25IRS. Deadlines That Can Erase the Claim

A standard wrongful death lawsuit must be filed within two years of the date of death under Code of Civil Procedure Section 335.1.26California Courts Self-Help. Statute of Limitations If the cause of death was not immediately apparent, the clock may start on the date it was or should reasonably have been discovered. Medical malpractice wrongful death claims run on a separate deadline: three years from the date of injury or one year from discovery, whichever comes first.27FindLaw. California Wrongful Death Laws A minor plaintiff’s clock is tolled until age 18.

When the responsible party is a government agency or employee, the timeline collapses. Under the California Tort Claims Act, a formal administrative claim must be filed with the public entity within six months of the date of death.28Advocate Magazine. Government Tort Claims The entity has 45 days to accept or reject. If rejected, the family generally has six months from the rejection notice to sue.29Dordick Law. Government Liability Personal Injury California Missing the six-month administrative deadline can forfeit the right to sue entirely, with limited exceptions for late filings within one year.
