What Is the Legal Gambling Age in Illinois?

The legal gambling age in Illinois is 21 for casinos, video gaming terminals, and sports betting, and 18 for the lottery, horse racing, and charitable games such as bingo and raffles.1Illinois General Assembly. The Two Age Tiers

Illinois sorts every form of legal gambling into one of two buckets.

The Mix-Ups That Trip People Up

Horse Racing Is 18, Not 21

Horse racing is the activity people most often get wrong. The Illinois Racing Board sets the wagering age at 18 for pari-mutuel betting, both at the track and at off-track facilities.4Illinois Racing Board. Rules for Wagering The casino age limit does not reach across to racing just because both involve wagering.

Racinos Split the Age by What You’re Playing

The 2019 gambling expansion allowed racetracks to operate as “racinos,” offering casino-style gaming alongside live and simulcast racing. At a racino, the two age rules sit side by side inside the same building. You can bet a horse at 18, but you have to be 21 to sit down at a slot machine or table game on the casino floor.4Illinois Racing Board. Rules for Wagering

Video Gaming Terminals in Bars Are 21

The slot-style machines tucked into the corner of a bar or restaurant are not lottery machines, even though they look similar to one. They’re video gaming terminals, governed by the Video Gaming Act, and the age limit is 21.5Illinois General Assembly. 230 ILCS 40/40 Video Gaming Terminal Use by Minors Prohibited An 18-year-old can walk in, buy a scratch-off at the counter, and still be too young to play the machine ten feet away.

Sports Betting on Illinois College Teams Is Off-Limits at Any Age

Even once you turn 21, Illinois prohibits betting on in-state college teams entirely, and prop bets on individual college athletes are not allowed regardless of what school they attend. Spreads, totals, and moneylines on out-of-state college games are still available.

Penalties for Gambling Underage

Illinois treats illegal gambling, including gambling by someone below the legal age, as a Class A misdemeanor. A conviction can bring up to one year in jail, a fine of up to $2,500, or both.8Illinois General Assembly. 720 ILCS 5/28-1 Gambling9Illinois General Assembly. Illinois Compiled Statutes 730 ILCS 5/5-4.5-55 Class A Misdemeanor If you’re underage and win money, expect the establishment or the regulator to confiscate those winnings.

The business carries its own exposure. A casino or other venue that lets underage patrons gamble risks fines and the suspension or revocation of its gaming license from the Illinois Gaming Board. Under the Video Gaming Act, a licensee that knowingly permits a person under 21 to play a terminal commits a business offense carrying a fine of up to $5,000 per violation.5Illinois General Assembly. 230 ILCS 40/40 Video Gaming Terminal Use by Minors Prohibited That is why ID checks at the door of a casino and at a video gaming terminal are not optional for the staff.

Private Home Games

The age limits above apply to licensed, commercial gambling. Social gambling in a private setting, such as a home poker game, sits in a different place in the statute: it’s legal as long as nobody profits from running the game itself. Winning a pot is fine. Charging a rake, collecting a door fee, or taking a cut for hosting turns the game into illegal gambling.8Illinois General Assembly. 720 ILCS 5/28-1 Gambling The line between hosting a game and operating one can be thinner than people realize.
