What Is the Nevada Modified Business Tax? Rates, Credits & Deadlines

The Nevada Modified Business Tax is a quarterly payroll tax that employers pay on wages paid to workers in the state. General businesses pay 1.17% on quarterly taxable wages above $50,000; financial institutions and mining operations pay 1.554% on all taxable wages with no threshold. Returns and payments are due by the last day of the month after each calendar quarter, and revenue goes to Nevada’s State General Fund.

Who Has to Pay

If your business is subject to Nevada’s unemployment compensation law under NRS Chapter 612, you generally owe the MBT. The tax runs on two tracks: Chapter 363B covers general businesses, and Chapter 363A covers financial institutions and businesses subject to the net proceeds of minerals tax.1Justia. Nevada Revised Statutes Chapter 363B – Business Tax

General businesses only owe tax when quarterly taxable wages exceed $50,000. Below that line, you owe nothing, but you still have to file a return showing zero.2State of Nevada Department of Taxation. Who’s Exempt

Nonprofit 501(c) organizations, Indian tribes, and political subdivisions are not required to file or pay the MBT.4Nevada Department of Taxation. How to Calculate What You Owe

Start with total employee compensation for the quarter. “Wages” tracks the unemployment insurance definition in NRS 612.190, so gross wages, salaries, commissions, bonuses, and reported tips all count.5Nevada Legislature. Subtract Health Insurance Premiums

Before applying any rate, subtract what you paid in health, dental, and vision insurance premiums for employees that quarter. If premiums exceed gross wages in a low-payroll quarter, the excess carries forward to offset gross wages in the next quarter.2State of Nevada Department of Taxation. Apply the Rate

After the deduction, apply the rate for your classification:

A Worked Example

Your general business pays $101,000 in wages for the quarter and $5,000 in employee health premiums. Subtract the $5,000, leaving $96,000 in net taxable wages. Subtract the $50,000 threshold, leaving $46,000. Apply 1.17%, and you owe $538.20 for the quarter.

The Commerce Tax Credit

Nevada also imposes a Commerce Tax on businesses with more than $4,000,000 in annual Nevada gross revenue. If you pay the Commerce Tax, you can apply a non-refundable credit equal to 50% of what you paid against your MBT liability.6State of Nevada. Commerce Tax FAQs So $10,000 in Commerce Tax paid becomes a $5,000 credit against MBT bills. It can’t drive MBT below zero, but if you’re above the Commerce Tax revenue line and skip the credit, you’re overpaying.

What Happens If You’re Late

Under NRS 360.417, the Department of Taxation can impose a penalty of up to 10% of the unpaid tax, plus interest at 1% per month (or fraction of a month) on the outstanding balance.9Nevada Legislature. Nevada Revised Statutes 360-417 – Penalty for Failure to Pay Tax or Fee Interest runs from the original due date, so delays compound quickly on a large payroll. The penalty itself scales with how late you are, starting at 2% for payments no more than 10 days past due under Nevada Administrative Code 360.395 and climbing from there.

Deducting the MBT on Your Federal Return

The MBT is a state payroll tax, not an income tax. Under 26 U.S.C. § 164, state and local taxes paid in carrying on a trade or business are deductible as a business expense on your federal return, as long as they aren’t income taxes, real property taxes, or personal property taxes claimed elsewhere.10Office of the Law Revision Counsel. 26 U.S. Code 164 – Taxes The MBT fits that category, so what you pay reduces your federal taxable income.
