What Is the Rescission Period in Nevada?

The rescission period in Nevada is the short window after you sign a contract when you can still cancel without penalty. How long you get depends on what you bought. Timeshares and homes in a common-interest community carry a five-calendar-day right to cancel. Gym and dance studio contracts give you three business days. Door-to-door purchases and most home-secured refinances carry a three-business-day federal right. Nevada does not provide a general cooling-off period for ordinary consumer purchases or for standard residential real estate sales.

Timeshare Contracts: Five Calendar Days

Nevada gives timeshare buyers five calendar days from signing to cancel, with the deadline running until midnight of the fifth day.1Nevada Legislature. Nevada Code 119A.410 – Right to Cancel Contract of Sale You do not need a reason. The contract itself must spell out this right.

This cancellation right cannot be waived. If a developer tries to get you to sign away your cooling-off period, the entire contract becomes voidable at your option.1Nevada Legislature. Nevada Code 119A.410 – Right to Cancel Contract of Sale

Written notice can go to the developer by personal delivery, by certified mail with return receipt requested, or by an express or overnight service with proof of service. Common-Interest Community Purchases: Five Calendar Days

Health Clubs and Dance Studios: Three Business Days

Schools accredited by a regional accrediting agency recognized by the U.S. Department of Education may also keep a nonrefundable deposit, but only if they disclosed that it was nonrefundable before you paid it. Federal Rescission Rights That Reach Nevada Buyers

Door-to-Door and Off-Premises Sales

The Federal Trade Commission’s cooling-off rule gives you three business days to cancel a purchase made outside the seller’s normal place of business, including sales at your home, your workplace, a hotel, a convention center, or a fairground. The rule applies to purchases of $25 or more at your home and $130 or more at other locations.8eCFR. 16 CFR Part 429 – Rule Concerning Cooling-Off Period for Sales Made at Homes or at Certain Other Locations

The seller has to give you a dated receipt or contract with the seller’s name and address and two copies of a cancellation form, all in the language used during the sales pitch, and the contract has to state that you can cancel any time before midnight of the third business day.9eCFR. 16 CFR 429.1 – Rule Concerning Cooling-Off Period for Sales Made at Homes or at Certain Other Locations If the seller fails to deliver those materials, your cancellation window may never start running.

Home-Secured Loans Under TILA

The Truth in Lending Act gives homeowners three business days to rescind most consumer credit transactions secured by their principal residence. That covers refinances, home equity loans, and HELOCs. It does not cover the original mortgage used to purchase the home.10Office of the Law Revision Counsel. 15 USC 1635 – Right of Rescission as to Certain Transactions

The three days run from the latest of three events: closing, delivery of your required TILA disclosures, or delivery of the rescission notice form. If the lender never delivers the disclosures or the rescission notice, your right to cancel stretches to three years after closing. Vacation homes and investment properties do not qualify.11Consumer Financial Protection Bureau. Regulation Z 1026.23 – Right of Rescission

You rescind by notifying the lender in writing. Once you do, the lender has 20 days to return any money or property and release its security interest in your home.

Residential Real Estate Outside the HOA Context

Nevada does not provide a general cooling-off period for ordinary residential real estate purchases. What you do have is a separate rescission right tied to the seller’s disclosure duties. If the seller never gave you the required disclosure form about the property’s condition, you can cancel any time before the property is conveyed to you, with no penalty.12Nevada Legislature. Nevada Code 113.150 – Remedies for Seller’s Delayed Disclosure or Nondisclosure of Defects in Property

The same statute protects you if a seller or seller’s agent discloses a previously unknown defect before closing (and the repair cost was not capped in the purchase agreement). You can rescind before conveyance or accept the property as-is. There is no fixed day count here. The right remains open until the deed transfers.12Nevada Legislature. Nevada Code 113.150 – Remedies for Seller’s Delayed Disclosure or Nondisclosure of Defects in Property

How to Deliver the Notice So It Counts

A cancellation that arrives one day late, or at the wrong address, can lock you into the contract. Every rescission right above requires written notice, and some statutes dictate exactly how to send it.

Timeshare notices accept personal delivery, certified mail with return receipt requested, or express/overnight delivery with proof of service.1Nevada Legislature. Nevada Code 119A.410 – Right to Cancel Contract of Sale Common-interest community notices allow hand delivery or prepaid U.S. mail, plus electronic transmission for resales.3Nevada Legislature. Nevada Code 116.41095 – Required Form of Information Statement Health club notices must be in writing and delivered in person or mailed with a timely postmark.5Nevada Legislature. Nevada Code 598.950 – Cancellation of Contract by Buyer; Notice Required

Certified mail with return receipt requested is the safest default even when other methods are allowed, because it creates a paper record of when you sent the notice and when the other party received it. Where the contract or statute permits electronic delivery, the federal ESIGN Act generally keeps your electronic notice from being rejected just because it is electronic.13Office of the Law Revision Counsel. 15 USC 7001 – General Rule of Validity Still, read the contract. If it demands a particular delivery method, use it. An email that satisfies federal law can fall short if the Nevada statute controlling your transaction says “certified mail.”

What Happens If You Miss the Window

Once the rescission period closes, the contract binds you.

In a common-interest community sale, letting the five-day window lapse usually means losing your earnest money if you walk away later, and the seller may add breach-of-contract claims for relisting costs or price drops. Timeshare contracts are harder to escape: developers enforce them through collections, maintenance fees keep accruing, and getting out typically requires negotiation with the developer, a secondary-market sale, or specialized legal help. Health club and dance studio contracts past the three-business-day window generally bind you for the full term, with limited exceptions such as relocation or medical inability to use the facility.

Stopping payment without a legal basis for cancellation on any contract type can trigger a breach claim for the full contract amount, lost profits, or liquidated damages set out in the agreement, which courts will enforce if the amount is reasonable.
