The sales tax in New York State starts at a 4% state rate, but what you actually pay at checkout runs between about 7% and 8.875% once county, city, and regional transit taxes are added. New York City sits at the top of that range. Groceries, most clothing items under $110, and both prescription and over-the-counter medicines are exempt.
How the Rate Is Built
Every taxable sale in New York carries the 4% state tax imposed under Tax Law Section 1105.1New York State Senate. New York Tax Law 1105 – Imposition of Sales Tax That piece never changes, no matter which of the 62 counties you’re in.
Counties and certain cities add their own layer under Tax Law Section 1210, generally between 0.5% and 3%, though several jurisdictions are authorized at higher rates. New York City’s local rate of 4.5% is the highest in the state.2New York State Senate. New York Tax Law 1210 – Taxes of Cities and Counties Administered by State Tax Commission Local authorizations expire and have to be renewed by the legislature, so local pieces can shift when those renewals come up. In most counties the local rate lands at 3% to 4.5%, which puts the combined state-and-local bill in the 7% to 8.5% range before any transit surcharge.
On top of state and local tax, a 0.375% Metropolitan Commuter Transportation District surcharge applies to the same goods and services wherever the purchase is delivered inside the district.3Department of Taxation and Finance. Sales Tax Rates, Additional Sales Taxes, and Fees The district covers the five boroughs of New York City plus seven surrounding counties:
- Dutchess
- Nassau
- Orange
- Putnam
- Rockland
- Suffolk
- Westchester
Outside those counties and the city, the surcharge doesn’t apply.
New York City’s 8.875% Rate
Inside the city, the combined rate is 8.875%: the 4% state portion, the 4.5% city portion, and the 0.375% transit surcharge.3Department of Taxation and Finance. Sales Tax Rates, Additional Sales Taxes, and Fees A handful of transactions carry extra charges on top of that. Parking in the city, for example, is subject to an additional 6% surcharge beyond the standard 8.875%.
Which Rate Applies to Your Purchase
New York uses destination-based sourcing. The rate is set by the locality where the item or service is delivered to the customer, not where the seller operates.4Department of Taxation and Finance. Publication 750 – A Guide to Sales Tax in New York State If you order something online from an Albany business and it arrives at your home in Nassau County, you pay the Nassau County combined rate. When the seller arranges the delivery, shipping and handling charges are rolled into the taxable amount.
What’s Exempt
Several everyday categories don’t carry sales tax, which is why the headline rate overstates what most households pay on a typical week of spending.5Department of Taxation and Finance. Quick Reference Guide for Taxable and Exempt Property and Services
Groceries
Unprepared food for home consumption is exempt from both state and local tax. Fruits, vegetables, bread, meat, dairy, and similar staples qualify. Candy, soda, and prepared meals sold for immediate consumption, such as restaurant food or hot deli items, are taxable.
Clothing and Footwear Under $110
Each item of clothing or footwear priced below $110 is exempt from the 4% state tax. The threshold is per item or per pair, so three shirts at $80 each all qualify; a single $150 jacket is fully taxable.
The local portion is a separate question. Each county and city had to opt in to extend the exemption to its own local tax. Many did, including New York City, Erie County, Monroe County, and most counties statewide, meaning clothing under $110 is fully tax-free there. A number of jurisdictions did not opt in, including Suffolk, Westchester (outside certain cities), Rockland, Orange, Putnam, Rensselaer, and Saratoga, among others. In those areas you’ll still see the local tax on a clothing receipt even though the state 4% comes off.
Medicine
Prescription drugs and over-the-counter medicines are both exempt from state and local sales tax. Certain medical equipment and supplies bought for personal use also qualify, though equipment a medical practice buys to treat patients for compensation does not.
What’s Taxable Beyond Physical Goods
The default rule is that any retail sale of tangible personal property is taxable unless a specific exemption applies.1New York State Senate. New York Tax Law 1105 – Imposition of Sales Tax Furniture, appliances, electronics, motor vehicles, and building materials all fall in that default category.
The tax also reaches a defined list of services under Section 1105(c):
- Information services that collect, compile, or analyze data and furnish reports (personal, individualized research and news-gathering uses are excluded)
- Installation, maintenance, and repair of tangible personal property, with an exception for work done at your home by someone you hire directly who isn’t in that regular trade
- Processing and printing performed on material you supply
- Utilities, including gas, electricity, refrigeration, and steam
- Telephone and communication services
- Hotel occupancy
Services that aren’t on the statutory list, such as legal fees, medical services, and most personal care services, are generally not subject to sales tax.
Software and Digital Products
Prewritten computer software is taxable no matter how it’s delivered: on a disc, by download, or accessed remotely.6Department of Taxation and Finance. Computer Software – Tax Bulletin ST-128 Custom software written for a single customer is treated differently and is generally not taxable. Digital music, movies, and e-books can be taxable when they have a tangible equivalent. Treatment of pure cloud services and streaming subscriptions is less settled and may turn on whether the transaction looks more like a sale of tangible property or an excluded service.
Online and Out-of-State Purchases
If you buy something from an out-of-state seller who doesn’t collect New York tax, you owe use tax at the same combined rate you would have paid locally.7Department of Taxation and Finance. Sales and Use Tax on My Income Tax Return Individuals report it on their state income tax return, using Form IT-201 for residents and Form IT-203 for nonresidents and part-year residents.
If you already paid sales tax to another state on the same purchase, New York may allow a reciprocal credit, but only when the other state offers a corresponding credit for New York taxes.8Department of Taxation and Finance. Reciprocal Credit for Sales or Use Taxes Paid to Other Taxing Jurisdictions Without reciprocity, you can end up paying both states.
Most of the time, you won’t notice this on online orders because the seller already charges you. Following the 2018 Supreme Court decision in South Dakota v. Wayfair, New York requires out-of-state sellers to register and collect its sales tax once they cross both of two thresholds in the preceding four sales tax quarters: more than $500,000 in gross receipts from sales delivered into New York, and more than 100 such sales.9Department of Taxation and Finance. Sales Tax Nexus Crossing one but not the other doesn’t trigger the obligation. Marketplace providers like Amazon, eBay, and Etsy are separately required to collect and remit tax on qualifying third-party sales made through their platforms.10Department of Taxation and Finance. Sales Tax Collection Requirement for Marketplace Providers Between those two rules, the use-tax line on your return mostly catches purchases from smaller out-of-state sellers that fall under the thresholds.
