The sales tax in Orange County, Florida is 6.5% on most taxable purchases. That total combines Florida’s 6% statewide sales tax with a 0.5% county discretionary surtax, and both are collected together as a single charge at the register.1Justia. Florida Statutes 212.05 – Sales, Storage, Use Tax2Florida Department of Revenue. Discretionary Sales Surtax Information The county’s 0.5% share has been in place since 2003 and is currently authorized through December 31, 2035.
How the Rate Breaks Down
Two layers make up the 6.5%. The first is Florida’s flat 6% sales tax, which applies statewide to taxable goods and certain services. The second is Orange County’s 0.5% discretionary surtax, added on top. You never see the two charges listed separately; your receipt shows one combined tax figure.
The $5,000 Cap on Big-Ticket Items
On expensive physical goods, the county’s 0.5% surtax only applies to the first $5,000 of the sales price per item. Everything above that is taxed at the 6% state rate alone.3Florida Legislature. Florida Statutes 212.054 – Discretionary Sales Surtax; Limitations, Administration, and Collection
A $30,000 vehicle is a useful example. The 0.5% surtax applies only to the first $5,000, which comes to $25. The 6% state tax applies to the full $30,000, which comes to $1,800. Total tax: $1,825.
The cap is per item, not per transaction. If you buy three separate pieces of equipment on one invoice, each one gets its own $5,000 surtax threshold, as long as the items are not normally sold together as a set or integrated unit. The cap also does not apply to every taxable transaction. Services, service warranties, admissions, and certain lease or rental arrangements are subject to the full 0.5% surtax on the entire amount.
What Gets Taxed
Most tangible personal property sold in the county carries the 6.5% rate. That covers electronics, clothing, household furniture, building materials, and similar physical goods. Florida also taxes a specific list of services written into the tax code, including nonresidential pest control.4Florida Department of Revenue. Sales and Use Tax on Insect or Pest Exterminator Services Residential pest control is not taxable.
Shipping and Delivery
Delivery charges are generally taxable when they are part of a taxable sale. If the shipping charge is listed separately on the invoice and the buyer has the option of picking up the item or arranging their own transport, the delivery charge is not taxed.5Florida Department of Revenue. Are Delivery Charges Subject to Sales Tax? A retailer that bundles shipping into the product price will tax the full amount; one that itemizes shipping and offers pickup will not.
Labor and Installation
When a repair or installation involves parts attached to or incorporated into the item, both the parts and the labor are taxable. Pure labor jobs with no materials used are not subject to sales tax, but the service provider has to document that no parts or other items were incorporated into the work.6Florida Department of Revenue. Digital Downloads and Streaming
Florida does not currently impose sales tax on digital downloads such as e-books, music files, or streaming video subscriptions. These products are neither tangible personal property nor an enumerated taxable service under Florida law. Streaming video services may be subject to Florida’s separate Communications Services Tax, which is a different levy from the sales tax discussed here.7Florida Department of Revenue. What’s Exempt
A few categories of everyday purchases are permanently exempt from the 6.5% tax. Food products for human consumption, including produce, milk, dairy products, fruit, sugar, and spices, are exempt as long as they are not prepared meals. Prescription medications and medical supplies dispensed under an individual prescription are also exempt, along with prosthetic devices, hearing aids, crutches, orthopedic shoes, prescription eyeglasses, and dentures.8Florida Senate. Florida Statutes 212.08 – Sales, Rental, Use, Consumption, Distribution, and Storage Tax; Specified Exemptions Florida also runs periodic tax holidays on items like school supplies and disaster preparedness gear, but the grocery and medical exemptions are permanent.
Commercial Rent Is No Longer Taxed
Florida used to tax the rental or lease of commercial real property, but that tax was fully repealed effective October 1, 2025. No state sales tax or county surtax applies to rent or license fees for commercial rental periods beginning on or after that date.9Florida Department of Revenue. Sales Tax on Commercial Rentals Repealed Effective October 1, 2025 If you lease commercial space in Orange County, you should no longer see sales tax on rent for any occupancy period starting in 2026 or later.
Collecting Sales Tax as a Business
Any business making taxable sales in Florida has to register before conducting business by completing a Florida Business Tax Application (Form DR-1), filed online through the Florida Department of Revenue or on paper.10Florida Department of Revenue. Account Management and Registration The application asks for your Federal Employer Identification Number (or Social Security Number if you don’t have an FEIN), a physical business address, and a description of your business activities.11Florida Department of Revenue. Florida Business Tax Application DR-1 You have to submit a new application if you move your business to a different Florida county, add a location, change your legal entity type, or change ownership.
Businesses buying inventory for resale can purchase those items tax-free using a Florida Annual Resale Certificate, which the Department of Revenue issues to any business registered to collect sales tax. You give a copy to your supplier, certifying the goods will be resold rather than used internally.12Florida Dept. of Revenue. Annual Resale Certificate for Sales Tax The certificate cannot be used for items the business will consume, such as office furniture or computers. If you buy something tax-free for resale and later use it yourself, you owe use tax on it.
Remote and Marketplace Sellers
Out-of-state businesses have to collect and remit Florida sales tax if their taxable remote sales exceeded $100,000 in the previous calendar year. Florida uses only a dollar threshold, with no separate transaction count.13Florida Legislature. Florida Statutes 212.0596 – Taxation of Remote Sales If you sell through a marketplace like Amazon or Etsy, the platform is typically responsible for collecting and remitting the tax, and sellers may not separately collect tax on those sales.14Florida Legislature. Florida Statutes 212.05965 – Taxation of Marketplace Sales A narrow exception exists for sellers with more than $1 billion in annual U.S. gross sales, who may contractually agree with the marketplace to collect tax themselves.
Filing Frequency and Due Dates
Returns are filed through the Department of Revenue’s eServices portal. They are due on the first day of the month following each reporting period, but a payment received by the 20th of that month is still considered timely.15Florida Department of Revenue. Sales and Use Tax Return DR-15 How often you file depends on how much tax you collect each year:
- Monthly, if you collect more than $1,000 in annual sales tax
- Quarterly, for $501 to $1,000 in annual collections
- Semiannually, for $101 to $500
- Annually, for $100 or less
These thresholds are based on tax collected, not total sales revenue.16Florida Dept. of Revenue. Florida Sales and Use Tax Filing or paying late triggers an automatic 10% penalty on the tax owed, with a minimum of $50 even if no tax is due. Unpaid balances also accrue interest at a floating rate, set at 11% annually for the first half of 2026 and updated every January 1 and July 1.17Florida Dept. of Revenue. Tax and Interest Rates
