What Is the SUI Tax Rate in Washington State?

The Washington SUI tax rate for 2026 runs from 0.00% to 6.00% for employers in good standing, applied to the first $78,200 of each employee’s wages.1Employment Security Department. How We Determine Tax Rates Employers who are behind on filings or payments can pay as much as 8.15%. The State Unemployment Insurance tax is owed entirely by the employer, never withheld from employee paychecks, and the Employment Security Department (ESD) sets each business’s specific rate based on its own claims history, its industry, and how long it has been operating in Washington.

What Goes Into Your Rate

Your total rate is built from pieces that get added together. The two main components are an experience-based tax and a graduated social cost tax, plus a small employment administration fund fee of 0.02% to 0.03%.1Employment Security Department. How We Determine Tax Rates A solvency surcharge under RCW 50.29.041 can also apply in years when the state’s unemployment trust fund balance drops below statutory thresholds.2Washington State Legislature. RCW 50.29.025 – Contribution Rates

The Experience Tax

This is the larger piece and reflects how much your former employees have drawn in unemployment benefits. The ESD calculates a benefit ratio by dividing the total benefits charged to your account over the previous 48 months by your total taxable payroll during that same period. Every qualified employer in the state is then ranked by benefit ratio and sorted into one of 40 rate classes. Rate class 1 pays 0.00%; rate class 40 pays 5.40%.2Washington State Legislature. RCW 50.29.025 – Contribution Rates

Each unemployment claim filed by a former employee gets charged to your account for four years. That pushes your benefit ratio higher and can move you into a more expensive rate class. Businesses with low turnover and few layoffs tend to sit in the single-digit rate classes, paying well under 1%.

The Social Cost Tax

Not every benefit payment can be traced back to a specific employer. When a business closes permanently, or when benefits are paid under circumstances that don’t get charged to any single account, those costs are spread across all employers through the social cost tax. The social cost portion is capped at 1.22%, and the combined experience tax and social cost tax cannot exceed 6.00%.1Employment Security Department. How We Determine Tax Rates Even an employer sitting in rate class 40 will not pay more than 6% once both pieces are added.

The 2026 Taxable Wage Base

You pay SUI tax only on wages up to a per-employee ceiling. For 2026, that ceiling is $78,200.1Employment Security Department. How We Determine Tax Rates Once an employee crosses that figure in a calendar year, no further SUI tax is owed on that person’s pay for the rest of the year. The wage base adjusts annually based on changes in the state’s average annual wage under RCW 50.24.010.3Washington State Legislature. Washington Code 50.24.010 – Contributions It was $67,700 in 2024 and $72,800 in 2025, so the climb has been steady.

Washington SUI is separate from the Federal Unemployment Tax Act (FUTA) tax of 0.6% on the first $7,000 of each employee’s wages, which goes directly to the IRS.1Employment Security Department. How We Determine Tax Rates The state rate and the federal rate are independent of each other.

If You’re a New Employer

A business that hasn’t been operating in Washington long enough to build a claims history doesn’t have a benefit ratio yet. Instead, the ESD assigns a rate based on the industry’s track record. For 2026, new employers pay 115% of the average rate for all businesses in their industry classification, with a federal floor of 1.00%.1Employment Security Department. How We Determine Tax Rates Industries are identified by the first four digits of the employer’s North American Industry Classification System (NAICS) code.4Cornell Law Institute. Washington Admin Code 192-320-025

A new restaurant will therefore start at a different rate than a new software company, because the hospitality sector historically generates more unemployment claims than tech. The experience tax portion of a new employer rate must fall between 1.00% and 5.40%, and the social cost portion cannot exceed the rate assigned to rate class 40.4Cornell Law Institute. Washington Admin Code 192-320-025 You keep the industry-based rate until the ESD has enough data to calculate your own benefit ratio.

If You’re Behind on Filings

Employers who fall behind on filing or payment move to a separate, higher rate schedule. For 2026, delinquent rates range from 1.25% to 8.15%, exceeding the normal 6% ceiling.1Employment Security Department. How We Determine Tax Rates Delinquent employers are also disqualified from the Voluntary Contribution program that could otherwise lower their rate, so the extra cost compounds.

Corporate Officers Are Exempt by Default

Officers of for-profit corporations who perform services in Washington are automatically exempt from unemployment insurance coverage.5Washington Department of Revenue. Unemployment Insurance The corporation doesn’t pay SUI tax on an exempt officer’s wages, and the officer cannot collect unemployment benefits. To get coverage for a corporate officer, the corporation has to file a written request with the ESD, and the exemption only ends once the commissioner approves a request to terminate it.6Washington State Legislature. RCW 50.04.165 This matters most for small corporations where the owner is also an officer and may be assuming coverage that isn’t actually in place.

Buying Down a Rate Spike

Washington lets some employers lower their tax rate through the Voluntary Contribution program. You make a one-time payment that the ESD subtracts from the benefit charges on your account, which can drop you into a lower rate class for the current year.7Employment Security Department. Voluntary Contribution Program – Lower Your Tax Rate The ESD sends a notice and application to eligible employers in the first quarter of each year.

To qualify, your business must be taxable, cannot have a delinquent rate, cannot be a local government, and your rate class must have jumped by at least eight classes from the prior year.7Employment Security Department. Voluntary Contribution Program – Lower Your Tax Rate Applications must be postmarked by March 1. If a single large layoff spiked your rate class, the program can save significantly more than it costs.

How You Learn Your Rate Each Year

Each December, the ESD sends a tax rate notice to every registered employer. The notice contains your rate for the upcoming calendar year, including the experience tax, social cost factor, and any applicable surcharges.1Employment Security Department. How We Determine Tax Rates It also lists your employer account number for filings. If the notice shows a rate class jump that surprises you, check whether a Voluntary Contribution makes sense before the March 1 deadline.
