The Virginia tax rebate is a one-time payment from the Commonwealth of up to $200 for individual filers and up to $400 for married couples filing jointly, sent to people who owed state income tax on their 2024 return. The 2025 General Assembly authorized the payment, and the Department of Taxation calculates it automatically from your filed return.1Virginia Tax. Who Qualifies
Eligibility turns on a single question: after every credit, deduction, and subtraction was applied to your 2024 Virginia return, did you still owe some amount of state income tax? If yes, you qualify. If credits such as the earned income tax credit or the credit for taxes paid to another state zeroed out your balance, you don’t, no matter how much was withheld from your paychecks.1Virginia Tax. Tax liability is not the same as what you paid or what you got back. Someone who had $5,000 withheld but owed only $3,000 after credits has a $3,000 liability and qualifies. Someone whose credits brought the final figure to zero does not, even with heavy withholding.
Both residents and nonresidents who filed a valid Virginia return can qualify, as long as that return shows a positive tax liability for 2024.1Virginia Tax. What You Need to Know About the 2025 Tax Rebate
How Much You Get
The $200 and $400 figures are ceilings, not flat payments. Your rebate equals your actual 2024 tax liability or the maximum for your filing status, whichever is smaller.2Legislative Information System. Virginia Budget Bill – HB1600 Item 258
An individual filer with a $150 liability gets $150. One with a $600 liability gets the full $200. A couple with a combined liability of $350 receives $350, not $400. The Department of Taxation pulls the numbers straight from your return.1Virginia Tax. What You Need to Know About the 2025 Tax Rebate
The Filing Deadline
To receive the 2025 rebate, your 2024 Virginia individual income tax return must reach the Department of Taxation by November 3, 2025. That applies to spring filers and late filers alike. If you missed the April deadline, you still qualify as long as your return arrives before the November cutoff.1Virginia Tax. What You Need to Know About the 2025 Tax Rebate
File after November 3 and you forfeit the rebate, regardless of what you owed. There is no extension or appeal process.
How and When Payments Arrive
The Department of Taxation sends your rebate the same way you received your most recent Virginia refund. Direct deposit refunds mean the rebate goes to the same bank account. Paper check refunds, or no refund at all, mean a paper check in the mail. If the bank account on file is closed, the state defaults to a mailed check.1Virginia Tax. What You Need to Know About the 2025 Tax Rebate
If you filed before July 1, 2025, your rebate should have arrived by mid-to-late October 2025; the legislation required payment by October 15.2Legislative Information System. Virginia Budget Bill – HB1600 Item 258 Returns filed between July 1 and November 3 are processed on a rolling basis, with rebates sent in the order returns were received.
Virginia Tax runs an online rebate lookup where you can check eligibility and payment status. If you filed before July 1 and nothing has arrived by the end of October, contact the Department directly. If you moved recently, confirm your USPS forwarding order is active, because paper checks go to the address on your most recent return.1Virginia Tax. What You Need to Know About the 2025 Tax Rebate
When Your Rebate Can Be Reduced
The rebate is subject to Virginia’s Setoff Debt Collection Act, so the state can reduce or hold the payment to cover outstanding debts. That includes money owed to Virginia Tax, the Department of Social Services, other state agencies and courts, local governments, the IRS, and certain federal agencies.3Virginia Tax. Why Was Your Refund Reduced or Withheld (Offset)? Back child support, unpaid state taxes, or a court judgment can all intercept the rebate before it reaches you. In most cases there is no advance notice; you learn about the offset when the payment is smaller than expected or does not arrive.
Federal Tax Treatment
What happens on your federal return depends on how you file. If you took the standard deduction federally, the rebate is not taxable income and does not need to be reported.1Virginia Tax. What You Need to Know About the 2025 Tax Rebate
If you itemized and deducted state income taxes, you may need to report the rebate as income on your next federal return under the tax benefit rule: you got a federal break for paying Virginia taxes, so getting some of that money back has to be accounted for. Virginia will send a Form 1099-G in that case, the same form issued for a regular state refund.4Internal Revenue Service. IRS Issues Guidance on State Tax Payments Some itemizers may still owe nothing extra if the $10,000 cap on state and local tax deductions kept them from deducting the full amount of state taxes they paid.
Watch for Scams
The Department of Taxation will not ask for personal information or demand payment through a text, email, or phone call. If someone tells you to verify your identity or pay a fee to receive your rebate, it is a scam. The state calculates and sends the payment automatically; nothing beyond filing on time is required.
Red flags include unsolicited texts or emails with links to sites that mimic the Virginia Tax portal using slightly misspelled URLs, calls that threaten arrest or penalties unless you hand over banking information, and social media posts offering a larger rebate if you fill out a special form. The real payment comes either by direct deposit to the account already on file or by a paper check from the Commonwealth of Virginia. When in doubt, go directly to the Virginia Department of Taxation website rather than clicking any link you were sent.
