The Virginia tax rebate is a one-time payment from the Commonwealth to taxpayers who owed state income tax after credits and deductions. For the 2025 rebate, individual filers can receive up to $200 and joint filers up to $400, based on their 2024 Virginia tax liability. You had to file your 2024 return by November 3, 2025 to qualify.1Virginia Department of Taxation. What You Need to Know About the 2025 Tax Rebate
How Much You Can Receive
The caps are $200 for individual filers and $400 for married couples filing jointly. Your rebate cannot exceed your actual 2024 Virginia tax liability, meaning the tax you owed after all credits, deductions, and subtractions were applied.1Virginia Department of Taxation. What You Need to Know About the 2025 Tax Rebate
So if you filed jointly and your 2024 liability was $150, your rebate is $150, not $400. If credits and deductions zeroed out your liability entirely, you get nothing. There is no published minimum. Even $1 of liability generates a $1 rebate, up to the applicable cap.1Virginia Department of Taxation. What You Need to Know About the 2025 Tax Rebate
Liability for rebate purposes is the underlying tax you owed, not the amount you paid through withholding or estimated payments. A large refund does not mean you had no liability; it usually means you overpaid against a liability that still existed.
Who Qualifies
Two conditions apply: you had Virginia income tax liability for 2024, and you filed your return by November 3, 2025.2Virginia General Assembly. 258 2h (TAX) Provide Income Tax Rebate – HB1600 Full-year residents, part-year residents, and nonresidents with Virginia-source income are all eligible, provided the return shows tax owed.
Full-year residents file Form 760. Part-year residents who moved into or out of Virginia during the year file Form 760PY. Nonresidents who earned Virginia-source income file Form 763.3Virginia Department of Taxation. Residency Status Any of these can produce a rebate.
Military Service Members
Virginia residents on active duty outside the state usually remain Virginia residents and qualify like any other resident. Service members who claimed a different state as their legal residence under the Servicemembers Civil Relief Act are nonresidents, and their active-duty pay is exempt from Virginia tax. If that pay was their only Virginia-source income, they had no filing requirement, no liability, and no rebate. A nonresident service member with other Virginia income, such as rent from Virginia property, who filed Form 763 and owed tax, remains eligible.4Virginia Department of Taxation. Military Tax Tips
Deceased Taxpayers
If a taxpayer died after the tax year but before the rebate arrived, the estate may still receive it. A court-appointed executor or administrator can file for the deceased, and the payment is issued as a check payable to the estate. A surviving spouse who filed jointly is treated as the primary taxpayer and receives the rebate directly.5Virginia Department of Taxation. Deceased Individuals – Filing for Deceased Individuals
The November 3, 2025 Deadline
Miss the November 3, 2025 filing deadline and you forfeit the rebate, no matter how much tax you owed.2Virginia General Assembly. 258 2h (TAX) Provide Income Tax Rebate – HB1600
Virginia automatically grants a six-month extension from the May 1 original due date, pushing the extended filing deadline to November 1. The rebate cutoff of November 3 falls just after that window, so filers using the automatic extension can still qualify if they file in time.6Virginia Department of Taxation. 2024 Form 760IP – Virginia Automatic Extension Payment Voucher for Individuals The extension only delays the filing, not the payment. If you owed tax and didn’t pay by May 1, penalties and interest have been accruing even if you filed later.
How and When the Payment Arrives
The Department of Taxation processes rebates in the order returns were filed. Taxpayers who filed before July 1, 2025 were scheduled to receive their payment by October 15, 2025. Returns filed after July 1 are processed in the order received.2Virginia General Assembly. 258 2h (TAX) Provide Income Tax Rebate – HB1600
If you received your most recent Virginia refund by direct deposit, the rebate goes to the same bank account. Everyone else receives a paper check at the address on their most recent return. That includes people who owed money when they filed, people who didn’t receive a refund, and people whose bank account on file is now closed.1Virginia Department of Taxation. What You Need to Know About the 2025 Tax Rebate
The Department cannot update your bank account information or switch your payment method. If a direct deposit fails because the account is closed, a paper check will follow. If you moved, a current U.S. Postal Service forwarding order will route the check to your new address; without one, it may come back to the state as undeliverable.1Virginia Department of Taxation. Checking the Status of Your Rebate
The Virginia Department of Taxation offers a rebate lookup tool on its website, along with its “Where’s My Refund” tool and an automated phone line at 804-367-2486.7Virginia Department of Taxation. Where’s My Refund?
If a rebate check goes uncashed for more than a year, the Department is required to turn the funds over to the Virginia Treasury Department’s Unclaimed Property Division. From that point, you have to contact that division directly to recover the money.8Virginia Department of Taxation. Uncashed Refund Check Letter
When Your Rebate Can Be Taken for Debts You Owe
Virginia’s Set-off Debt Collection Act lets the Department of Taxation intercept your rebate to pay delinquent debts owed to state agencies, local governments, and the courts.9Virginia Code Commission. Virginia Code 58.1-520 – Definitions The statute defines a “claimant agency” broadly, covering state, county, city, and town units, circuit and district courts, and the Internal Revenue Service. Unpaid taxes, court-ordered restitution, and other government debts come out of the rebate first; only what’s left reaches you.10Cornell Law School. 23 Va. Admin. Federal Tax on the Rebate
Whether the rebate is federally taxable depends on how you filed federally. If you took the standard federal deduction, the rebate generally isn’t taxable. If you itemized and deducted your state income taxes, part or all of the rebate may need to be reported as federal income. The $10,000 cap on the state and local tax deduction means many itemizers couldn’t deduct their full state taxes to begin with and may owe nothing extra.11Internal Revenue Service. IRS Issues Guidance on State Tax Payments
Virginia issues a Form 1099-G for rebate payments, as it does for regular state refunds. If you itemized, check that form against the IRS guidance before filing federally.1Virginia Department of Taxation. What You Need to Know About the 2025 Tax Rebate
If You Need to Amend Your Return
An amended Virginia return that changes your 2024 tax liability can change your rebate. Increased liability can mean a larger rebate, up to the cap. An amendment that erases your liability can disqualify you. Amended returns seeking a refund generally must be filed within three years of the original due date, including any valid extensions. If the IRS changes your federal return, you have one year from the final federal determination to file the Virginia amendment.12Virginia Department of Taxation. Amending Your Return
A Smaller 2026 Rebate Has Been Proposed
A budget amendment in the 2026 legislative session would authorize another round at lower amounts: $100 for individual filers and $200 for joint filers, based on 2025 tax liability. The filing deadline would be November 3, 2026, with payments for early filers due by October 15, 2026. The proposal sets aside roughly $499 million from the general fund. As of early 2026, it had received committee approval but had not been signed into law.13Virginia General Assembly. Tax Rebate – Budget Amendment SB30 (Committee Approved) Item 261 3s
