The items exempt from sales tax in Georgia fall into a handful of clear categories: groceries bought for home use, prescription drugs and prescribed medical equipment, qualifying agricultural supplies, manufacturing inputs, most services, and some digital subscriptions. Motor vehicles are also exempt from ordinary sales tax, but they carry a separate title tax instead. One wrinkle shapes everything below: Georgia’s 4% state tax and the local taxes added by counties and cities (2% to 5%) don’t always come off together.1Georgia.gov. Georgia Sales and Use Tax Rate Chart Some exemptions remove both; others only remove the state portion.
Groceries Bought for Home Use
Food and food ingredients for home consumption are exempt from the 4% state sales tax under O.C.G.A. § 48-8-3(57).2Georgia Secretary of State. Georgia Comp. R. and Regs. R. 560-12-2-.104 – Food Exemption That covers pantry and refrigerator staples: meat, vegetables, flour, dairy, canned goods, and the like. Local sales taxes still apply in most counties, so your grocery receipt will usually show some tax even though the state’s share is gone.
Several things sold in a grocery store don’t qualify. Alcoholic beverages, tobacco products, and dietary supplements (identifiable by a “Supplement Facts” label rather than “Nutrition Facts”) are fully taxable at both state and local rates. Prepared food is also excluded. Georgia treats food as prepared if the seller has heated it, mixed two or more ingredients to sell as a single item, or sold it with eating utensils. A rotisserie chicken or a deli sandwich with a fork gets taxed at the full combined rate.
Purchases made with SNAP benefits or WIC coupons are fully exempt from both state and local sales tax, regardless of what food is involved.
Prescription Drugs and Medical Equipment
Prescription drugs dispensed by a pharmacist for human use are exempt from sales tax under O.C.G.A. § 48-8-3(47), and so is insulin whether or not a prescription is required.3Georgia Department of Revenue. Georgia Sales and Use Tax Exemptions – O.C.G.A. 48-8-3 The requirement is a valid prescription from a licensed provider. Over-the-counter drugs don’t qualify, even when a doctor recommends or prescribes them.4Georgia Department of Audits. Georgia Sales Tax Exemption for Prescription Drugs If you can buy the medication without a prescription, Georgia taxes it.
Prescription eyeglasses and contact lenses are exempt. Reading glasses off the rack are not.
Several categories of medical equipment are exempt when a physician prescribes them: durable medical equipment such as hospital beds and oxygen delivery systems designed for repeated home use; prosthetic devices that replace or support a body part; and mobility-enhancing equipment such as wheelchairs, walkers, crutches, and scooters that help someone with limited mobility and wouldn’t be used by a person with normal mobility.5Cornell Law School – Legal Information Institute. Georgia Comp. R. and Regs. R. 560-12-2-.30 – Drugs, Durable Medical Equipment, Prosthetic Devices, and Other Medical Items Hearing aids are exempt under a separate provision, O.C.G.A. § 48-8-3(52). All of these require documentation; suppliers must keep prescription records to justify not collecting tax.
Agricultural Supplies and the GATE Card
Georgia provides broad exemptions for farming operations through O.C.G.A. § 48-8-3.3. Seeds, fertilizers, pesticides, livestock feed, and heavy equipment like tractors and harvesters used directly in agricultural production all qualify.6Justia. Georgia Code 48-8-3.3 – Exemptions for Agricultural Operations Irrigation materials and crop chemicals are covered too.
To claim the exemption, you need a Georgia Agriculture Tax Exemption (GATE) card, administered by the Georgia Department of Agriculture. The card costs $150 for the 2026–2028 cycle and is valid for two years beginning January 1, 2026.7Georgia Department of Agriculture. Apply for a GATE Card You present it to the seller at purchase. Without the card, the retailer must collect the tax.
The qualifying threshold is $5,000 in annualized sales from agricultural production.8Georgia Department of Agriculture. GATE FAQs Timber growers without annual revenue can qualify based on an average of at least $5,000 per year over time, and rental income from farmland counts. Hobby farms below $5,000 in annual revenue don’t qualify.
Manufacturing Equipment and Industrial Materials
Companies that manufacture tangible goods in Georgia benefit from exemptions under O.C.G.A. § 48-8-3.2. Machinery and equipment used directly and necessarily in the manufacturing process are exempt, and so are industrial materials that become part of the finished product.9Justia. Georgia Code 48-8-3.2 – Exemptions for Manufacturing Equipment, Industrial Materials, Packing Supplies, and Energy The exemption extends to repair and replacement parts for manufacturing machinery, as well as equipment used to maintain, clean, or repair other exempt machinery. Electricity and natural gas consumed directly in manufacturing at the plant also qualify.
Most Services
Georgia doesn’t tax the majority of services. Legal work, accounting, medical consultations, landscaping, house cleaning, and similar professional or personal services are all exempt.10Department of Revenue. What is Subject to Sales and Use Tax? Itemized charges for repair labor and installation labor are also not subject to sales tax.
The taxable exceptions are narrow: hotel and accommodation charges, in-state transportation of people (taxis, rideshares, limousines), admissions to events, and charges for participation in games or amusement activities. When a service provider also sells you tangible goods as part of the job, the goods portion is taxable even though the labor isn’t.
Streaming Subscriptions and Downloaded Software
Georgia started taxing certain digital products on January 1, 2024, and the rules draw a sharper line than most people expect. The question is whether you receive permanent ownership or merely access through a subscription.11Department of Revenue. Rule 560-12-2-.118 – Digital Products, Goods, and Codes
Streaming subscriptions and cloud-based access are not taxable. If your right to use the content ends when you stop paying, no sales tax applies. A music streaming service, a video-on-demand subscription, and cloud software accessed through a browser all remain exempt. Prewritten computer software delivered electronically (downloaded to your computer) is also exempt, as is internet access service.
Digital products you download and keep permanently, by contrast, are taxable. That includes e-books, music files, movie downloads, digital video games, and digital photographs when you retain the file.
Motor Vehicles
Motor vehicles are exempt from ordinary sales tax, but they aren’t tax-free. Buyers pay a one-time Title Ad Valorem Tax (TAVT) when the vehicle is titled, and the TAVT applies whether you buy from a dealer or in a private sale.12Department of Revenue. Vehicle Taxes – Title Ad Valorem Tax (TAVT) The current rate is 7.0% of the vehicle’s fair market value, paid to your county tag office at registration. On a $30,000 vehicle, that’s $2,100 upfront.
Two situations lower the rate. If a vehicle already has a Georgia title and TAVT was previously paid, an immediate family member receiving the vehicle pays only 0.5% of fair market value, using Form MV-16 to certify the relationship. New Georgia residents titling a vehicle they already own pay 3%.
What People Often Think Is Exempt But Isn’t
A few categories catch Georgia shoppers off guard:
- Clothing. Georgia taxes all apparel at the full combined rate. There’s no standing exemption.
- Over-the-counter medications. Even on a doctor’s advice, OTC drugs are fully taxable. Only drugs that legally require a prescription qualify.4Georgia Department of Audits. Georgia Sales Tax Exemption for Prescription Drugs
- Nonprofit purchases. Georgia generally does not grant sales tax exemptions to churches, charities, or other nonprofits. These groups pay sales tax on tangible goods like anyone else.13Department of Revenue. Tax Exempt Nonprofit Organizations
- Prepared food. Anything heated by the seller, mixed from multiple ingredients for sale as one item, or sold with eating utensils is taxed at the full combined state and local rate.
Georgia once held an annual back-to-school sales tax holiday each summer, exempting clothing under $100, computers under $1,000, and school supplies under $20. State lawmakers discontinued the holiday after 2016, and it hasn’t been reinstated. The authorizing statute remains on the books, but no exemption period has been scheduled in recent years.
