What Qualifies a Person for IHSS in California?

To qualify for IHSS in California, you have to meet three conditions at the same time: you must be 65 or older, legally blind, or disabled; you must live in your own home in California; and you must be eligible for Medi-Cal.1CDSS Public Site Department of Social Services. In Home Supportive Services (IHSS) Program If all three are true, a county social worker then visits your home to decide what tasks you need help with and how many caregiver hours to authorize each month.

Age, Blindness, or Disability

You only need to fit one of the three categories. Age is the simplest: anyone 65 or older qualifies on age alone, with no requirement to show a disability. Legal blindness qualifies at any age. The third route is a qualifying disability, which also has no age floor.1CDSS Public Site Department of Social Services. In Home Supportive Services (IHSS) Program

For the disability route, IHSS uses the Social Security Administration’s definition. Your physical or mental impairment has to be medically documented, expected to last at least twelve continuous months or result in death, and severe enough to prevent substantial gainful activity. If you already receive SSI or SSDI, your disability status is settled and you won’t be asked to prove it again. For a child under 18, the standard is different: the impairment must cause “marked and severe functional limitations” rather than an inability to work.2Social Security Administration. Living in Your Own Home in California

You have to be a California resident, and you have to live in your own home. IHSS reads “own home” generously. A house, an apartment, a hotel room, or the home of a relative where you live all count.3California Department of Social Services (CDSS). Overview of the In-Home Supportive Services (IHSS) Program

Some living situations are excluded. Acute care hospitals, skilled nursing facilities, intermediate care facilities, and licensed community care facilities do not qualify as your own home. If you’re currently in one of those settings, you become eligible once you move back to a private residence.1CDSS Public Site Department of Social Services. In Home Supportive Services (IHSS) Program Expect to show basic proof of where you live, such as a utility bill or a lease, when you apply.

Medi-Cal Eligibility

IHSS is a Medi-Cal program, so a Medi-Cal eligibility determination has to be in place before services can be authorized.1CDSS Public Site Department of Social Services. In Home Supportive Services (IHSS) Program If you already receive SSI, you’re automatically Medi-Cal eligible in California and can skip the financial screening. If you don’t, the income threshold is 138% of the Federal Poverty Level, which comes out to roughly $21,597 per year for a single person in 2026.4DHCS – CA.gov. Qualify – Medi-Cal

A long-standing barrier is gone. On January 1, 2024, California eliminated the asset test for all Non-MAGI Medi-Cal programs under Assembly Bill 133. Before that, countable resources above $2,000 for an individual were disqualifying. Savings, retirement accounts, and other assets no longer stand between you and Medi-Cal eligibility.5DHCS – CA.gov. DHCS Medically Needy/Share of Cost Letter No. 25-18

If Your Income Is Over the Limit: Share of Cost

Income over the standard Medi-Cal limit doesn’t automatically end your IHSS prospects. The state calculates a monthly Share of Cost, which is the amount you have to pay toward your own medical and care expenses each month. Once you’ve met that amount, Medi-Cal covers the rest, IHSS included. In practice, this keeps the program open to people whose income is just over the free-Medi-Cal line but who still can’t absorb the full cost of in-home care.

If You’re Married: Spousal Impoverishment Protections

When one spouse needs IHSS-level care and the other stays in the community, federal rules keep the community spouse from being impoverished by the Medi-Cal spend-down. For 2026, the community spouse can keep between $32,532 and $162,660 in countable resources, with a monthly income allowance of at least $2,643.75 and up to $4,066.50.6Centers for Medicare & Medicaid Services. 2026 SSI and Spousal Impoverishment Standards You don’t have to drain joint savings before your spouse can qualify.

Needing Help at Home: What the Social Worker Checks

Meeting the three gating requirements makes you eligible to be assessed. The number of hours you actually receive, and whether you receive any at all, comes from a home visit. The social worker’s assessment directly determines your authorization.3California Department of Social Services (CDSS). Overview of the In-Home Supportive Services (IHSS) Program

The social worker rates your functional ability across more than a dozen task categories, including housework, meal preparation, laundry, shopping, bathing, dressing, feeding, toileting, transfers, and ambulation. Each task gets a Functional Index ranking on a 1-to-5 scale:7California Department of Social Services (CDSS). IHSS Assessment and Authorization

  • Rank 1: Independent, no help needed.
  • Rank 2: Verbal reminders or guidance, but no physical help.
  • Rank 3: Some human help needed.
  • Rank 4: A lot of human help needed.
  • Rank 5: Cannot perform the task at all.

Each ranking corresponds to a standard time guideline, which the social worker adds up into your authorized hours. The assessment also factors in your diagnoses, medications, living situation, household members, durable medical equipment, and any help you already get from family or community sources.7California Department of Social Services (CDSS). IHSS Assessment and Authorization

A common mistake is downplaying your limitations in front of a stranger. Describe your worst days, not your best ones. If a task sometimes goes well but regularly fails or you hurt yourself trying, say so plainly. “I fell twice last month getting into the shower” tells the social worker something that “I have trouble bathing” doesn’t.

Services the Program Covers

IHSS funds practical, non-medical help so you can stay at home: domestic tasks like cleaning, cooking, laundry, and shopping; personal care including bathing, dressing, grooming, toileting, and transfers; accompaniment to medical appointments; and paramedical services such as medication administration, wound care, catheter care, and tube feeding, which have to be ordered and the provider trained by a licensed medical professional.3California Department of Social Services (CDSS). IHSS Program Paramedical Services Fact Sheet A separate category, protective supervision, covers people with cognitive impairments who cannot recognize danger on their own and need observation throughout a 24-hour day; it has its own evidence requirements, including a hazard log and the SOC 821 assessment form.9CA.gov (California Department of Social Services). All County Letter 15-25 – Protective Supervision Clarifications

How Many Hours Are Possible

There is a ceiling. A severely impaired recipient receiving protective supervision can be authorized up to 283 hours per month, about nine hours a day, under Welfare and Institutions Code Section 12303.4(b).10California Department of Social Services. Assessment and Authorization – Part IV – Cost Limitations Non-severely impaired recipients receiving protective supervision are typically capped around 195 hours per month depending on subprogram. Most recipients come in well under the cap, because hours are driven by what the task-by-task assessment actually totals.

What You File to Apply

Two documents start the eligibility review. The Application for Social Services (SOC 295) goes to your county IHSS office by mail, fax, or in person. The Health Care Certification form (SOC 873) is completed by a licensed health care professional and describes your limitations and your need for in-home help to avoid placement in a care facility.1CDSS Public Site Department of Social Services. In Home Supportive Services (IHSS) Program

Before your doctor fills out the SOC 873, bring a current medication list, contact information for your other treating physicians, and concrete examples of tasks you struggle with. “I burned food on the stove because I forgot it was cooking” tells the certifier something a vague phrase like “memory problems” doesn’t. The certification carries more weight when it’s specific.

Once approved, the county issues a Notice of Action listing each authorized service and the monthly hour total.1CDSS Public Site Department of Social Services. In Home Supportive Services (IHSS) Program IHSS can pay retroactively to the date you submitted your application, as long as you were Medi-Cal eligible and had a documented need as of that date; paramedical services are the exception and can’t be authorized before the health care professional’s order is on file.11California Department of Social Services (CDSS). E-Note 133 – Effective Date of IHSS Program Benefits

If You’re Denied or Approved for Too Few Hours

Every IHSS decision arrives with a Notice of Action explaining what the county decided. If you’re denied, or your authorized hours look too low, you have 90 days from the notice to request a state hearing.12California Department of Social Services. State Hearing Procedures Manual – Section 22-009

If you’re an existing recipient facing a reduction or termination, the timing is tighter and more important. Filing your hearing request before the effective date on the notice triggers “aid paid pending,” which keeps your current hours in place until the hearing is decided.13California Department of Social Services. State Hearing Procedures Manual – Section 22-072 Miss that effective date and your hours drop while you wait. This is where many recipients lose ground: the notice gets set aside, the date passes, and aid paid pending is gone.
