Last call in California is 2:00 a.m., and it is 2:00 a.m. everywhere in the state. Business and Professions Code Section 25631 bars any licensed establishment from selling, giving, or delivering alcohol between 2:00 a.m. and 6:00 a.m.1California Legislative Information. California Code Business and Professions Code 25631 That covers bars, restaurants, nightclubs, liquor stores, and grocery stores alike. Cities and counties can set an earlier cutoff, but no local government can push the hour later.
What 2 AM Actually Requires
The cutoff is stricter than a simple “no new drinks.” Section 25632 makes it a separate misdemeanor for any licensee to allow alcohol to be consumed on the premises during the prohibited hours.2California Legislative Information. California Code Business and Professions Code 25632 Drinks have to be off the tables by 2:00 a.m., which is why most bars run last call fifteen to thirty minutes earlier to give staff time to clear glasses.
The ban also reaches the buyer. Anyone who knowingly purchases alcohol between 2:00 a.m. and 6:00 a.m. is committing a misdemeanor under Section 25631, though in practice enforcement falls almost entirely on the business.1California Legislative Information. The One Exception: An Arena in Inglewood
California has a single statutory exception to the 2:00 a.m. rule, and it is narrow. Section 25631.5 permits alcohol service between 2:00 a.m. and 4:00 a.m. inside a fully enclosed arena with at least 18,000 seats in the City of Inglewood, which effectively means the Intuit Dome.3California Legislative Information. California Code Business and Professions Code 25631.5 Even there, the conditions are tight:
- Service is confined to a private club area of no more than 2,500 square feet, capped at 100 people.
- Only dues-paying members of the club and their guests may enter.
- The after-hours window only follows a sporting event, concert, or similar major event at the arena.
- Everyone in the area must be 21 or older.
- Servers must have completed Responsible Beverage Service training.
- The provision sunsets on January 1, 2030 unless the legislature renews it.
The exception also requires Inglewood to adopt an ordinance and the licensee to notify local law enforcement.3California Legislative Information. California Code Business and Professions Code 25631.5 No other venue, city, or license type in California qualifies.
How the Rule Works on Daylight Saving Nights
Section 25631 handles the two clock-change nights explicitly. On those nights, “2 o’clock a.m.” means two hours after midnight regardless of what the clock reads.4Alcoholic Beverage Control. Hours of Sale In the fall, bars still close two hours after midnight even though the clock passes 2:00 a.m. twice. In the spring, when clocks jump straight from 2:00 a.m. to 3:00 a.m., the same rule applies. Drinking time is the same as any other night.
When Local Rules or License Conditions Make It Earlier
Cities and counties can shorten the hours. Some communities impose earlier cutoffs for off-sale stores or for premises near residential areas, so a store or bar may legally have to stop sooner than 2:00 a.m. depending on where it sits.
The California Department of Alcoholic Beverage Control can also attach restrictions to an individual license, often at the request of local law enforcement or a city council.5Alcoholic Beverage Control. Requirements and Guidelines A licensee has 10 days to petition for removal or modification, but the condition stays in force until the ABC rules.
Penalties for Serving After 2 AM
Violating Section 25631 or 25632 is a misdemeanor.1California Legislative Information. California Code Business and Professions Code 25631 Penal Code Section 19 sets the maximum at six months in county jail, a fine of up to $1,000, or both.6California Legislative Information. For the business, the ABC’s administrative penalties usually bite harder than the criminal ones. The standard first-offense suspension schedule for after-hours sales or consumption runs:7Alcoholic Beverage Control. Disciplinary Guidelines
- 15-day license suspension for serving the general public.
- 10-day suspension for serving employees and friends.
- 5-day suspension for serving employees only.
For suspensions of 15 days or less, the ABC may accept a Petition for Offer in Compromise, letting the licensee pay a monetary penalty instead of closing. Repeat violations or a pattern of problems can lead to revocation.7Alcoholic Beverage Control. Disciplinary Guidelines
Is California Going to Move Last Call to 4 AM?
Not yet. Legislators have introduced several bills over the years to extend last call to 4:00 a.m. in select cities, usually through a pilot-program structure. The most recent version would create designated areas where late-night sales could continue for an additional two hours. As of early 2025, the bill was awaiting a hearing in an Assembly committee. Earlier versions stalled or were vetoed, and nothing has been signed into law. Until something changes, 2:00 a.m. is the hard cutoff everywhere in California outside that one Inglewood arena.
