New York waives the standard three-weekly-activity work search rule in six situations spelled out in 12 NYCRR 473.4(k): a temporary layoff with a firm written return date, union members who get work through a hiring hall, enrollment in a Department of Labor–approved Section 599 training program, acceptance into the Self-Employment Assistance Program, participation in an approved Shared Work plan, and days you are serving jury duty. If one of these applies to you, NYS unemployment work search requirements are waived for as long as the underlying situation lasts, but you still have to certify weekly and keep documentation that proves you qualify.1New York State Codes, Rules and Regulations. 12 NYCRR 473.4 – Work Search Requirements
Temporary Layoff With a Written Return Date
A temporary layoff waives the work search only if your employer gives you a written, definite return-to-work date that falls within eight consecutive weeks of the layoff.1New York State Codes, Rules and Regulations. 12 NYCRR 473.4 – Work Search Requirements A vague promise to call you back doesn’t count. The date must be specific enough for the Department of Labor to verify during an audit.
If the employer needs more time, the Department can authorize up to four additional weeks, bringing the total to twelve. That extension requires the employer to submit a written request with a new return date.1New York State Codes, Rules and Regulations. 12 NYCRR 473.4 – Work Search Requirements Without that paperwork, the waiver ends at week eight and you owe three activities per week going forward.
Union Members Who Get Work Through a Hiring Hall
If you are a union member and your union assigns work through a hiring hall or dispatch system, you don’t have to conduct a separate job search on your own.1New York State Codes, Rules and Regulations. 12 NYCRR 473.4 – Work Search Requirements The union functions as your placement channel.
Carrying a union card is not enough by itself. You must stay in compliance with the union’s membership requirements and with its own work search or dispatching rules.1New York State Codes, Rules and Regulations. 12 NYCRR 473.4 – Work Search Requirements That means current dues, your name on the out-of-work list, and accepting referrals when they come. Letting membership lapse or turning down a dispatch costs you the waiver and may cost you the benefits themselves.
There is a second advantage worth knowing. Under Labor Law Section 593, claimants who are not subject to a recall date and who do not obtain employment through a union hiring hall face a stricter standard for accepting job offers after ten weeks of benefits.2New York State Senate. New York Labor Law 593 – Disqualification for Benefits Hiring hall members are carved out of that provision.
Approved Training Under Section 599
Section 599 of the Labor Law lets you attend a full-time training program while collecting benefits without doing a work search, provided the Department of Labor has formally approved the program.3New York State Department of Labor. 599 Program Approval is not automatic. The Commissioner looks at whether the training leads to an occupation with real employment prospects in New York, based on current and projected labor market conditions.4New York State Senate. New York Labor Law 599 – Career and Related Training; Preservation of Eligibility
To qualify, the program has to meet several criteria:
- It upgrades your existing skills or trains you for an occupation leading to more stable, long-term employment.
- There are reasonable employment opportunities in the state for that occupation, now or in the near future.
- It takes no more than twenty-four months to complete.
- It is offered by a reliable agency or institution.
- You have the aptitude and prerequisites to finish it.4New York State Senate. New York Labor Law 599 – Career and Related Training; Preservation of Eligibility
Once approved, you are excused from the three-activity requirement for the whole program. You keep certifying weekly, but your obligation is to attend and complete the coursework.
Self-Employment Assistance Program
Claimants accepted into the Self-Employment Assistance Program (SEAP) work on launching a business instead of looking for a job, and they don’t owe work search activities while they do it.5New York State Department of Labor. Self-Employment Assistance Program (SEAP)
To be eligible you must be at least 18, have at least 13 weeks of unemployment benefits remaining when you are accepted, and either receive an invitation letter from the Department of Labor or qualify as a dislocated worker. You cannot have been in SEAP before, and you cannot have previously owned or operated a business of the same type you are proposing.5New York State Department of Labor. Self-Employment Assistance Program (SEAP)
The program requires at least 20 hours of entrepreneurial training and at least two meetings with a business counselor you choose. You need a clear business idea going in; this isn’t for people still brainstorming. The business must be located in New York, and you must plan to be a full-time active owner. You can receive a combined total of 26 weeks of unemployment and SEAP benefits during your benefit year, and you must have written acceptance into the program before starting any business activities while collecting benefits.6New York State Department of Labor. Shared Work Program
If your employer cut your hours instead of laying you off and filed an approved Shared Work plan, you are not required to look for other work. You just need to stay fully available for your normal schedule with the Shared Work employer.7New York State Department of Labor. How to File a Claim Under the Shared Work Program

Jury Duty
Days you are serving on a jury are exempt from work search, whether that’s a single afternoon or a multi-week trial.1New York State Codes, Rules and Regulations. 12 NYCRR 473.4 – Work Search Requirements On days you aren’t at the courthouse, you should still be available and able to work. Hold on to your summons and any court-issued documentation of your service dates; those are exactly the records the Department may ask to see during an audit.
How to Certify When Your Work Search Is Waived
A waiver doesn’t excuse you from certifying. You still claim your benefits each week through the Department of Labor’s online system or by phone, and the system still asks whether you completed at least three work search activities that week or followed an official work search plan.8New York State Department of Labor. Certify for Weekly Unemployment Insurance Benefits Answer consistent with your exempt status. The Department’s records should already reflect your basis for the waiver, whether that is your employer’s written return date, your Section 599 approval, your SEAP acceptance, or your Shared Work plan.
This is where claimants get into trouble. The certification screens aren’t always clear about exemptions, and the wrong answer can trigger an automatic eligibility review that freezes payments while it gets resolved. If you aren’t sure how to respond, call the Department before you certify. Keep digital or physical copies of whatever supports your waiver: the employer letter with the return date, your union membership card and dispatch records, your Section 599 approval notice, your SEAP acceptance letter, or your jury summons.
Penalties for Claiming a Waiver You Don’t Qualify For
Claiming an exemption that doesn’t apply to you, or falsely reporting that you did work search activities, is treated as fraud. Under Labor Law Section 594, a claimant who willfully makes a false statement to obtain benefits forfeits benefits for between one and twenty effective weeks after the offense is discovered. You also have to repay every dollar you received because of the false statement, plus a civil penalty equal to the greater of $100 or 15 percent of the overpaid amount.9New York State Senate. New York Labor Law 594 – Reduction and Recovery of Benefits and Penalties for Wilful False Statement Those penalties can remain in effect for up to two years from the final determination and are separate from any criminal exposure under other state or federal law.
Fraud isn’t caught only through random audits. An employer disputing your claim, a union reporting that you weren’t in compliance, or a training provider flagging non-attendance can all open an investigation.
Appealing a Denial of Your Waiver
If the Department decides your exemption doesn’t apply, or issues you an overpayment or penalty, you have 30 days from the date on the determination notice to request a hearing in writing.10Unemployment Insurance Appeals Board. Request a Hearing Calling to argue does not count. You can file through your NY.Gov account using the Claimant Request for Hearing form, or mail or fax the request to the Department. An Administrative Law Judge can extend the deadline in limited circumstances if you explain the delay.
Hearings are conducted through the Virtual Hearings Center and are generally scheduled within about 30 days of the request. Get supporting documents to the Appeals Board at least three days before the hearing.10Unemployment Insurance Appeals Board. Request a Hearing A letter from your employer confirming a return date, union records showing compliance, or your Section 599 approval notice are the documents that decide these cases.
