If you are on California State Disability Insurance for pregnancy, you apply for Paid Family Leave after SDI as soon as the EDD sends you the Claim for Paid Family Leave Benefits – New Mother form (DE 2501FP), which arrives automatically after your final SDI payment. You must return it within 41 days of your family leave start date, or you can lose benefits.1Employment Development Department. Paid Family Leave Claim Process
You do not need to guess the timing or start a new claim from scratch. The EDD builds the handoff into the end of your pregnancy disability claim, and your bonding payments begin the day your medical disability period ends.
When the DE 2501FP Arrives and the 41-Day Deadline
Pregnancy SDI typically runs up to four weeks before your due date and up to six weeks after a vaginal delivery, or eight weeks after a cesarean.2Employment Development Department. Disability Insurance – Pregnancy FAQs When that medical recovery period ends, you become eligible for up to eight weeks of PFL to bond with your baby.3California Legislative Information. California Code UIC – Section 3301
After your last SDI payment, the EDD sends you the DE 2501FP automatically. How it arrives depends on how you filed your SDI claim in the first place. If you filed on paper, you will get a paper form in the mail. If you filed through SDI Online, a link to the electronic DE 2501FP shows up in your SDI Online inbox.4Employment Development Department. Transitioning from Disability Insurance to Paid Family Leave
The firm deadline: file no earlier than the first day of your family leave, and no later than 41 days after that start date. Missing the 41-day window can cost you benefits.1Employment Development Department. Paid Family Leave Claim Process Return the form as soon as it reaches you.
No Waiting Period on the Transition
New PFL claims normally have a seven-day unpaid waiting period. That waiting period is waived when you transition directly from a pregnancy SDI claim, so your PFL payments start on the first day of your bonding leave with no gap.5Employment Development Department. Because you came through SDI as a birthing mother, you also do not need to submit separate proof of your relationship with the child.6Employment Development Department. How to File a Paid Family Leave Claim in SDI Online The EDD already has what it needs from your pregnancy claim.
How to Return the Form
If you filed SDI online, log in to your myEDD account, open your SDI Online inbox, and complete the DE 2501FP there. If you filed by mail, fill out the paper form the EDD sent you and return it in the pre-addressed envelope included with the form.7Employment Development Department. Before you start, have your Social Security number, California driver’s license or state ID number, and your employer’s business name, phone number, mailing address, and your last day worked.6Employment Development Department. How to File a Paid Family Leave Claim in SDI Online
You can also split your eight weeks of bonding leave into blocks across the 12 months after your child’s birth. Each new block of leave requires a separate PFL claim with the EDD.
What Happens After You File
Once the EDD receives a complete claim, processing usually takes about 14 business days. You will get a Notice of Computation (DE 429DF) showing your estimated weekly benefit, followed by an Electronic Benefit Payment notification once the claim is approved.8Employment Development Department. Paid Family Leave Benefits and Payments FAQs After the first payment, benefits are generally issued every two weeks.
If anything about your claim is missing or inconsistent, processing takes longer. Returning the form promptly and double-checking your employer information and leave dates is the single best thing you can do to keep payments on schedule.
How Much You Will Receive
PFL replaces between 70% and 90% of your weekly wages, with lower earners receiving the higher replacement rate. The benefit is calculated from your highest-earning quarter in the roughly 5 to 18 months before your claim start date.9Employment Development Department. Paid Family Leave Benefit Payment Amounts For 2026, the maximum benefit is $1,765 per week.10Employment Development Department. Contribution Rates and Benefit Amounts
To qualify at all, you must have earned at least $300 in wages subject to SDI deductions during the 18 months before your claim start date.11Employment Development Department. Paid Family Leave If you already received SDI for your pregnancy, you have met this.
Your partner can file a separate PFL bonding claim for the same child, so a family can receive up to 16 combined weeks of bonding benefits. Bonding benefits must be used within 12 months of the child’s birth.1Employment Development Department. Paid Family Leave Claim Process
PFL Does Not Protect Your Job
This catches new parents off guard. PFL is a wage replacement program. It does not require your employer to hold your position or guarantee that you can return to the same role. Job protection comes from separate laws, and whether they cover you depends on your employer’s size and your tenure.
- The California Family Rights Act (CFRA) provides up to 12 weeks of job-protected leave for bonding, but you need at least 12 months with your employer, 1,250 hours in the year before leave, and an employer with five or more employees.12California Civil Rights Department. PDL Baby Bonding
- The federal Family and Medical Leave Act (FMLA) uses similar tenure and hours rules but applies only to employers with 50 or more employees within 75 miles.13U.S. Department of Labor. Family and Medical Leave Act
If you work for a small employer that falls outside both laws, taking PFL will pay you, but no state or federal statute requires your employer to hold your job. Confirm your protection with your employer in writing before leave begins.
If Your Claim Is Denied
If the EDD finds you ineligible, you will receive a Notice of Determination with an Appeal Form (DE 1000A). You have 30 days from the date on the notice to file a written appeal.14Employment Development Department. State Disability Insurance Appeals
Fill out the appeal form, explain in detail why you believe you qualify, and include anything the EDD may have been missing. Mail it to the return address on the notice. The EDD reviews the appeal internally first; if they still deny it, your case goes to the California Unemployment Insurance Appeals Board for a hearing before an Administrative Law Judge.14Employment Development Department. Late appeals are still accepted, but you have to show good cause for missing the 30-day window before the judge will hear the case.
