When Does Child Support End in Kentucky: Age 18, 19, and Beyond

In Kentucky, child support ends when the child turns 18. The main exception is a child still enrolled full-time in high school at that birthday: support continues until graduation or the end of the school year in which the child turns 19, whichever comes first. A handful of other events can cut support off sooner, extend it indefinitely, or shift the obligation to the paying parent’s estate.

The Age 18 Default

KRS 405.020 sets the parental duty to support a child until age 18. When the child reaches that birthday, the baseline obligation ends by operation of law.1Justia Law. Kentucky Revised Statutes 405.020 – Custody, Nurture, and Education of Children KRS 403.213 echoes this on the court-order side, terminating ordered support upon emancipation of the child unless a statutory exception applies.2Justia Law. Kentucky Revised Statutes 403.213 – Criteria for Modification of Orders for Child Support and for Health Care

No hearing is required for the age-18 cutoff itself. The paperwork to stop wage withholding is a separate step, and skipping it is where most trouble starts.

The High School Extension to 19

If your child is still a full-time high school student when they turn 18, support does not stop. It continues until the child graduates or until the end of the school year in which the child turns 19, whichever comes first.1Justia Law. Kentucky Revised Statutes 405.020 – Custody, Nurture, and Education of Children

A child who turns 18 in January of senior year, for example, keeps receiving support through graduation that spring. A child who drops out loses the extension at the point they leave school. The statute asks for full-time enrollment, not any particular academic performance.2Justia Law. Kentucky Revised Statutes 403.213 – Criteria for Modification of Orders for Child Support and for Health Care

Marriage Ends Support Early

A valid marriage emancipates a minor in Kentucky, and support ends on the wedding date rather than the 18th birthday. KRS 403.213 is specific that the high school extension protects a child emancipated by age but not one emancipated by marriage.2Justia Law. Kentucky Revised Statutes 403.213 – Criteria for Modification of Orders for Child Support and for Health Care A 17-year-old who marries loses support entirely; an unmarried 18-year-old still in high school keeps it through graduation.

Permanent Disability Can Extend Support Indefinitely

Support can continue past 18 with no upper age limit when an adult child is wholly dependent on their parents because of a permanent physical or mental disability. KRS 405.020(2) places this duty jointly on both parents.1Justia Law. Kentucky Revised Statutes 405.020 – Custody, Nurture, and Education of Children

Two conditions matter. The disability must be permanent, and it must leave the child wholly dependent. A manageable condition that allows the child to hold a job and live independently will not qualify. Courts expect medical documentation. The disability does not have to date from birth, but it must be present when the child turns 18 for the continuing duty to attach, and it lasts as long as the dependency does.

Does Child Support End If the Paying Parent Dies?

No. KRS 403.213 states that the support obligation is not terminated by the death of the parent who owes it. The court can modify the obligation, revoke it, or convert it into a lump-sum payment from the deceased parent’s estate.2Justia Law. Kentucky Revised Statutes 403.213 – Criteria for Modification of Orders for Child Support and for Health Care If you are the surviving parent, file promptly: once the estate is distributed to other heirs, recovery gets harder.

College Does Not Extend Support

Kentucky does not require either parent to pay child support for a child attending college. Once the child graduates high school (or the age-19 cutoff hits), the statutory duty ends regardless of whether they enroll in a university.1Justia Law. Kentucky Revised Statutes 405.020 – Custody, Nurture, and Education of Children Support covers high school students through 19, not college students.

Unpaid Arrears Do Not Go Away

A child reaching 18 or graduating does not wipe out support that went unpaid during their minority. KRS 403.213 is explicit that emancipation does not terminate the obligation to pay arrearages.2Justia Law. Kentucky Revised Statutes 403.213 – Criteria for Modification of Orders for Child Support and for Health Care

Collection tools stay available until the balance reaches zero. Those include state and federal tax refund intercepts, liens on real property and bank accounts, suspension of driver’s, professional, and recreational licenses, contempt proceedings that can carry jail time, and federal passport denial once arrears exceed the statutory threshold. The child’s age has no bearing on any of it.

Stopping Wage Withholding When Support Ends

Support ends by law on the triggering date, but the money keeps flowing until someone tells the employer to stop. Payroll departments act on court orders, not calendars. To close out a case cleanly:

  • File a motion in the family court that issued the original order, asking it to terminate the withholding and showing that a termination event (18th birthday, graduation, marriage, death) has occurred.
  • Get a certified copy of the signed termination order from the clerk.
  • Deliver that order to the employer’s payroll department so deductions stop.
  • Provide the same order to Kentucky’s Division of Child Support if payments route through the state system, so their records close out.

File before the end date rather than after. Court dockets move at their own pace, and payments that keep coming out of a paycheck for weeks after support legally ended create an overpayment you then have to chase.

Getting Back an Overpayment

If withholding runs past the termination date, the paying parent can recover the excess. Under 921 KAR 1:420, once the Department for Income Support verifies the overpayment, a refund check is typically issued to the noncustodial parent within one to seven days. Overpayments from intercepted tax returns take longer: up to 30 days for a single return and up to six months for a joint return.3Kentucky Legislative Research Commission. Kentucky Administrative Regulations Title 921 Chapter 1 Regulation 420 The faster route is still to shut off withholding on time in the first place.
