In Oregon, child support ends on the child’s 18th birthday by default, with one major exception: if the child is attending school, the obligation can continue until age 21. Support can also end earlier if the child marries, enters active military duty, or is emancipated by a court. None of this erases arrears, and none of it happens automatically; you have to ask for the order to be terminated.1Oregon State Legislature. Oregon Revised Statutes 109.510 – Age of Majority
Age 18 Is the Default
Oregon’s age of majority is 18, so a current support obligation ends on the child’s 18th birthday unless something extends it.1Oregon State Legislature. Oregon Revised Statutes 109.510 – Age of Majority That is true whether or not the child still lives at home, has a job, or depends on either parent for money. If the child is not in school and nothing else applies, your current obligation stops on that date.
If your order was originally entered in another state, Oregon’s rules may not control when it ends. Eligibility for extended support depends on the law of the state that issued the original order, even if Oregon has since modified it.2Oregon Department of Justice. The Multi-Child “Class Order” Trap
When one support order covers more than one child and does not break down a per-child amount, the full payment stays in place until the youngest child turns 18. Oregon calls this a class order. The total does not drop on its own when an older child ages out.3Oregon Secretary of State. Division 55 Oregon Child Support Program To lower the amount after the first child turns 18, you have to request a formal modification. Until the state issues a new order, the original figure is still your legal obligation.
Extended Support for a Child in School
Under ORS 107.108, a court can order support to continue past 18 for a child attending school, up to age 21. To qualify, the child must be unmarried, enrolled at least half-time (based on the school’s own definition of a full load), and making satisfactory academic progress as the school measures it.4Oregon Public Law. Oregon Revised Statutes 107.108 – Support or Maintenance for Child Attending School The child also cannot be emancipated by active military service or a court decree.2Oregon Department of Justice. Support for Students Ages 18-21
Qualifying schools cover a wide range: community colleges, four-year universities, vocational and technical programs including the Job Corps, GED programs, and high school programs for students finishing grade 12.4Oregon Public Law. Extended support is not automatic. If your order doesn’t already contain a child-attending-school provision, the order has to be modified to add one. If the student later drops below half-time or stops meeting academic standards, that gives the paying parent grounds to seek termination.
Scheduled breaks don’t interrupt support. ORS 107.108 defines a “regularly scheduled break” to include a summer semester or term and any break of four months or less, so support continues through those gaps.4Oregon Public Law. Oregon Revised Statutes 107.108 – Support or Maintenance for Child Attending School A longer gap outside the normal academic calendar is a different story.
One procedural point: a child attending school becomes a party to the support case. The adult child has standing to participate, apply for services through the Oregon Child Support Program, and seek enforcement independently.4Oregon Public Law. Events That End Support Before 18
Three events end a current support obligation before the child’s 18th birthday because they change the child’s legal status:
- Marriage. A minor who marries is treated as having reached the age of majority under Oregon law.5Oregon Department of Justice. Child Support FAQs
- Entering active military duty.2Oregon Department of Justice. Support for Students Ages 18-21
- Court-ordered emancipation.5Oregon Department of Justice. Child Support FAQs
Even when one of these clearly applies, do not just stop paying. The support order remains enforceable until it is officially modified or terminated, so follow the formal process.
Arrears Don’t End When Current Support Ends
This is where parents lose the most money. When current support terminates, any past-due balance survives. You still owe every dollar, and Oregon has one of the longest collection windows in the country: child support judgments remain enforceable for 35 years from the date of the original judgment that established the obligation.6Oregon Public Law. Oregon Revised Statutes 18.180 – Expiration of Judgment Remedies in Circuit Court During that time, the state can pursue collection through income withholding, tax refund intercepts, and other tools.
At the federal level, past-due child support can be collected through administrative offset of most federal payments, including tax refunds and certain federal salary payments.7eCFR. 31 CFR 285.1 Collection of Past-Due Support by Administrative Offset Social Security benefits and some other payments are generally excluded, but the collection reach is broad.
If you owe arrears, you may be able to negotiate a payment plan or, in limited cases, request a review for a credit on the balance. The Oregon Child Support Program handles those requests through its modification and review process.
How to Request Termination
Support does not end automatically just because a qualifying event occurs. You have to file for it. The Oregon Department of Justice provides a “Request for Review – Modification or Termination Packet” (form CSF 01 0142A), available on the DOJ website or by phone.8Oregon Department of Justice. Forms
The form asks for your case number, the child’s date of birth, and the reason you believe support should end: the child reached 18, graduated, dropped below half-time enrollment, married, enlisted, or was emancipated. Submit the completed form to the Oregon Child Support Program by mail at PO Box 14680, Salem, OR 97309, or by fax.9Oregon Department of Justice. Request for Review Modification, Change of Custody, Credit on Arrears or Termination If your case is court-managed rather than handled through the state program, you can file directly with the circuit court instead.
Once the state receives the request, the other parent has an opportunity to respond. If the parties disagree, the matter goes to an administrative hearing, and a parent who disagrees with the final decision can appeal by filing a petition for review in circuit court within 60 days.
Stopping the Wage Withholding
Most Oregon child support comes out of paychecks automatically, and ending the withholding is a separate step from ending the obligation. After a termination order is issued, the state sends a notice to your employer directing them to stop the deduction. Oregon law requires employers to act no later than the next regular payday after receiving a withholding change. Until that notice reaches payroll, deductions continue.
If money is still coming out of your check after you have confirmation that the order has been terminated, contact both the Oregon Child Support Program and your employer’s payroll department. And remember that stopping current withholding does not touch arrears. If you still owe back support, the state can keep withholding from your wages to collect it under a separate directive until the balance is paid or you reach an agreement.
