Where Can You Smoke Marijuana in Colorado: Homes, Lounges, Rentals

In Colorado, adults 21 and older can legally smoke marijuana in two kinds of places: a private residence where the property owner allows it, or a licensed marijuana hospitality lounge. Everywhere else is a problem. Public spaces, hotels, federal land, and vehicles each carry their own penalties, and the rules catch both visitors and longtime residents off guard.

In a Private Home

A private residence is the simplest legal option. The Colorado Constitution permits adults 21 and older to consume marijuana as long as it is not done “openly and publicly” or in a way that endangers others. Inside your own home or on your own property, you are within the law.

Renters have an extra step. Colorado law gives property owners the right to prohibit marijuana possession and consumption on their property, and a lease that bans marijuana use is enforceable. Check your lease before you light up, and if the language is unclear, ask the landlord. The same principle governs any property you don’t own: the owner sets the rules.

At a Licensed Marijuana Hospitality Lounge

Colorado licenses marijuana hospitality businesses where adults can consume on-site. These lounges need both a state license and approval from the local city or county, so they only exist in jurisdictions that have opted in.1Justia. Colorado Code 44-10-609 – Marijuana Hospitality Business License Denver has been the most active market, with several lounges operating; other cities have been slower to pass local ordinances allowing them.

Consumption inside a licensed hospitality business is explicitly exempt from the state’s public consumption ban. Some lounges permit smoking or vaping only; others also allow edibles. Alcohol is generally not served at the same location. Before planning a visit, check the state licensing authority’s website for a current list of licensed hospitality businesses.

Hotels, Airbnbs, and Short-Term Rentals

This is where visitors run into trouble. Hotel owners can ban marijuana use and possession on their property, and most do. A “smoking-permitted” room typically covers tobacco only. Colorado’s official cannabis guidance tells travelers to research a property’s marijuana policy before booking.2Cannabis. Laws About Cannabis Use

Vacation rentals are more flexible because the owner decides. Some Colorado hosts explicitly market cannabis-friendly listings. If the listing or house rules say nothing about marijuana, assume it is not permitted. Using marijuana on a rental without the owner’s permission can cost you the reservation, and stepping outside to smoke instead can turn into a public consumption citation.

Where Smoking Marijuana Is Illegal

Colorado prohibits openly and publicly consuming marijuana. Openly and publicly displaying, consuming, or using two ounces or less is a drug petty offense carrying a fine up to $100 and up to 24 hours of community service.3City and County of Denver. Marijuana Consumption Information More than two ounces in public pushes the penalties into standard possession territory.

Specific places off-limits for consumption include:

  • Sidewalks, streets, parks, and trails. Any publicly accessible outdoor space counts.
  • Schools, hospitals, and government buildings, indoors or out.
  • Restaurants, bars, and other businesses without a marijuana hospitality license. Colorado’s Clean Indoor Air Act was amended in 2013 to include marijuana smoking, so even a bar that allows tobacco cannot allow cannabis.
  • Public transportation, including buses, trains, rideshares, and their stations and stops.
  • Ski resorts, both the slopes and the lodges. Many ski areas also sit on federal land, adding a second layer of prohibition.

Federal Land Is Completely Off-Limits

Marijuana remains illegal under federal law and is still a Schedule I controlled substance.4Drug Enforcement Administration. Drug Scheduling Because federal law controls on federal property, you cannot use, possess, or transport marijuana on any federal land in Colorado. That includes Rocky Mountain National Park and other national parks, national forests, Bureau of Land Management territory, and federal buildings.

Colorado has more federal land than many visitors realize. Ski slopes, hiking trails, and campgrounds frequently sit on Forest Service or BLM land.2Cannabis. Laws About Cannabis Use Federal law enforcement regularly patrols these areas and can arrest and charge you under federal statutes regardless of what Colorado law says.

In a Vehicle

Smoking in a car on a public road is a separate offense. No one in the passenger area of a motor vehicle on a public road may consume marijuana or possess an open marijuana container.5Justia. Colorado Code 42-4-1305.5 – Open Marijuana Container – Motor Vehicle – Prohibited – Definitions

The definition of “open marijuana container” is narrower than most people expect. A container qualifies only when all three conditions are met: it is open or has a broken seal, some contents have been removed, and there is evidence that marijuana was consumed inside the vehicle. A sealed dispensary bag in your trunk is fine. A half-eaten package of edibles on the passenger seat with crumbs around it can be enough. A violation is a Class A traffic infraction with a $50 fine plus a $7.80 surcharge.

Driving impaired is far more serious. Colorado charges DUI when a driver is substantially unable to safely operate a vehicle and DWAI when ability is affected to the slightest degree. The law creates a permissible inference of impairment at five nanograms or more of delta-9 THC per milliliter of blood, but an officer can arrest at any blood level if the officer observes impaired driving.6Colorado Department of Transportation. Drugged Driving Frequently Asked Questions A first marijuana DUI carries 5 days to 1 year in jail, a $600 to $1,000 fine, up to 96 hours of community service, and license revocation of up to 9 months.7Colorado General Assembly. Colorado Drunk Driving Laws – Colorado Law Summary THC can linger in the bloodstream for days or weeks after use, and Colorado has no safe harbor for residual THC, which makes regular users especially exposed.

For Out-of-State Visitors

Visitors follow the same rules as residents. There is no tourist exception. Because hotels generally ban marijuana and parks, sidewalks, and rental cars are off the table, a licensed hospitality lounge is the most realistic legal option for most travelers who are not staying in a cannabis-friendly rental.

Adults 21 and older can buy and possess up to one ounce at a time from a licensed retail dispensary regardless of residency, and the state allows possession of up to two ounces total.2Cannabis. Laws About Cannabis Use You will need a government-issued photo ID. Cash is accepted everywhere, debit at some shops, credit cards rarely because of federal banking restrictions.

Do not take marijuana out of Colorado. Crossing a state line with marijuana is a federal offense even if the destination state has legalized it, and the same applies to mailing or shipping. Colorado’s legalization stops at the state border.
