If you’re 21 or older, the only place you can legally smoke weed in Boston is on private property with the owner’s permission. That’s it. Massachusetts legalized adult-use cannabis under M.G.L. c. 94G, but the same law bans consumption in every public place, and federal rules override state law on a surprising amount of Boston real estate. The gap between “legal to buy” and “legal to use somewhere” is wider than most people expect.
Your Home and Other Private Residences
Your own home is the clearest legal option. Adults 21 and older can consume cannabis inside a residence they own and keep up to 10 ounces at home. Away from home, the possession limit drops to one ounce on your person, with no more than five grams in concentrate form.1General Court of Massachusetts. Massachusetts General Laws Chapter 94G Section 7 – Personal Use of Marijuana
A friend’s house works too, as long as the owner says yes. The word that matters is private. Step onto a sidewalk, a park path, or any space the public can access, and you’re in violation of state law.
If You Rent or Stay in a Hotel
Renters have split rights depending on how they consume. A landlord can write a lease that bans smoking cannabis and prohibits growing plants on the property. A lease cannot prohibit non-smoked consumption like edibles or tinctures, unless banning it would cause the landlord to violate federal law or the property is state-owned.2Cannabis Control Commission. Guidance on Consumption of Marijuana for Adult Use So in a typical Boston apartment, edibles are protected and a smoking ban is enforceable.
Hotels are the owner’s property, and most Boston hotels maintain smoke-free policies that cover cannabis along with tobacco. Many go further and ban all forms of cannabis use, edibles included. Check directly with the hotel before you assume anything.
Federally Subsidized Housing
Cannabis is still a Schedule I substance under federal law, which creates a hard ban in any housing that receives federal funding. The Quality Housing and Work Responsibility Act requires owners of federally assisted housing to deny admission to anyone currently using a controlled substance under federal law and to include lease terms allowing eviction for cannabis use.3U.S. Department of Housing and Urban Development. Use of Marijuana in Multifamily Assisted Properties Massachusetts law does not override this. If you live in a Boston Housing Authority property or any federally subsidized unit, cannabis use in any form on the premises puts your housing at risk.
Public Places Are Off-Limits, All of Them
State law prohibits consuming cannabis in any public place and prohibits smoking cannabis anywhere tobacco smoking is banned.4General Court of Massachusetts. Massachusetts General Laws Chapter 94G Section 13 – Penalties The Cannabis Control Commission reads this to cover every form of consumption, not just smoking. Edibles, vape pens, tinctures, drinks: none of them are legal in public.5Cannabis Control Commission Massachusetts. Know the Laws
That covers:
- Parks and outdoor spaces, including the Boston Common, the Esplanade, playgrounds, sidewalks, and streets
- Restaurants, bars, and entertainment venues, since any place where tobacco is banned is also off-limits for cannabis
- Workplaces of any kind, whether an office, kitchen, or warehouse
- Federal property, including courthouses, post offices, federal office buildings, and the Boston Harbor Islands
A common misread: people assume edibles get a pass in places where smoking is banned because nothing is burning. They don’t. The public consumption ban applies to all methods.5Cannabis Control Commission Massachusetts. Know the Laws
College Campuses
Boston has more than 30 colleges and universities, and every one of them bans cannabis on campus. Federal funding ties mean the age of consent under state law doesn’t change anything. Northeastern University’s policy is typical: all cannabis possession and use is prohibited on any university property, at any university-sponsored event, and even at off-campus student organization activities, because the school receives federal funds.6Northeastern University. Notification in Accordance with the Drug-Free Schools and Communities Act and Drug-Free Workplace Act Violations can trigger both university discipline and state or federal prosecution.
Federal Property in Boston
Boston has a lot of federal land, and none of it follows Massachusetts cannabis law. That includes the federal courthouses, the JFK Federal Building, post offices, VA hospitals, and the Boston Harbor Islands National Recreation Area. Possession there is a criminal offense under 21 U.S.C. § 844, with penalties that escalate on each conviction:7Office of the Law Revision Counsel. 21 USC 844 – Penalties for Simple Possession
- First offense: up to one year in jail and a minimum $1,000 fine
- Second offense: 15 days to two years in prison and a minimum $2,500 fine
- Third or subsequent offense: 90 days to three years in prison and a minimum $5,000 fine
The practical takeaway is that location changes everything. Getting caught with cannabis on the Boston Common is a $100 civil ticket. Getting caught on the Harbor Islands is a federal misdemeanor with a mandatory minimum fine. Sometimes the distance between the two is a single block.
In a Car or Ride-Share
Consuming cannabis in a vehicle is illegal, and the state treats it more seriously than ordinary public consumption.
Driving under the influence of cannabis is a criminal offense under M.G.L. c. 90, § 24. A first offense carries a fine between $500 and $5,000, up to two and a half years in jail, and a one-year license suspension.8General Court of Massachusetts. Massachusetts General Laws Chapter 90 Section 24 – Driving While Under Influence of Intoxicating Liquor, etc. This leaves a criminal record, unlike the civil fines attached to public consumption.
An open container of cannabis anywhere in the passenger area carries a civil penalty of up to $500. “Open” means any package with a broken seal or missing contents. The passenger area covers every seat and any space within reach. To transport legally, keep sealed product in the trunk; if the vehicle has no trunk, put it behind the last row of seats or in a locked glove compartment.4General Court of Massachusetts. Massachusetts General Laws Chapter 94G Section 13 – Penalties
The same rules apply in an Uber or Lyft. You can’t consume in a ride-share, and the driver can set stricter rules about sealed product in the car.
Social Consumption Venues Are Not Open Yet
Massachusetts approved regulations for licensed social consumption establishments, which took effect on January 2, 2026. On paper, these are the cannabis equivalent of bars: licensed venues where you can buy and consume on-site. In practice, no licenses have been issued. The Cannabis Control Commission is still building the application process and public education materials.9Cannabis Control Commission Massachusetts. Massachusetts Social Consumption Establishment Regulations are Now in Effect
There’s a second obstacle specific to Boston. Municipalities must opt in through a referendum, ordinance, or bylaw before any establishment can open locally, and local governments can add restrictions such as banning combustion inside licensed venues. The Commission created three new license types, including an Event Organizer license for temporary consumption events.10Cannabis Control Commission Massachusetts. Massachusetts Cannabis Control Commission Unanimously Approves Final Social Consumption Regulations Until Boston opts in and licenses are actually issued, no legal social consumption venue is operating in the city.
Medical Cardholders
If you hold a valid medical marijuana registration card, the public consumption statute states it “shall not be construed to limit the medical use of marijuana.”4General Court of Massachusetts. Massachusetts General Laws Chapter 94G Section 13 – Penalties Even so, the Cannabis Control Commission states that medical patients still cannot consume in public places or on federal land.5Cannabis Control Commission Massachusetts. Know the Laws A card does not unlock the Boston Common or the Harbor Islands.
What a Violation Costs
Most consumption violations are civil fines, but the amounts and the type of offense vary with the location:
- Public consumption by any method: civil fine up to $1004General Court of Massachusetts. Massachusetts General Laws Chapter 94G Section 13 – Penalties
- Open container in a vehicle: civil fine up to $5004General Court of Massachusetts. Massachusetts General Laws Chapter 94G Section 13 – Penalties
- Driving under the influence: criminal offense, $500 to $5,000 fine, up to 2.5 years in jail, one-year license suspension8General Court of Massachusetts. Massachusetts General Laws Chapter 90 Section 24 – Driving While Under Influence of Intoxicating Liquor, etc.
- Possession on federal property: federal misdemeanor, minimum $1,000 fine and up to one year in jail for a first offense7Office of the Law Revision Counsel. 21 USC 844 – Penalties for Simple Possession
The jump from a $100 civil ticket to a federal criminal charge based purely on where you’re standing is the single most important thing to understand about cannabis enforcement in Boston.
