Whitley County Occupational Tax: Rates, Exemptions, Deadlines

Whitley County, Kentucky imposes a 1% occupational tax on wages earned and net profits generated inside the county. It applies whether you live in Whitley County or just work there, and whether your business is based in the county or only does part of its work there. Employers withhold the tax from employee paychecks; business owners pay it on their net profits.

Who Has to Pay

The tax reaches anyone earning money from work or business activity within county boundaries. A commuter who lives in another county but drives into a Whitley County job has the 1% withheld from each paycheck. A sole proprietor, partnership, corporation, or other entity doing business in the county owes 1% on the net profits tied to that activity.1Whitley County Fiscal Court. Whitley County Occupational Tax Ordinance 2005-08

Employers carry the responsibility for withholding tax from employee pay and sending it to the county. Most employees never file anything themselves. Check your pay stub to confirm the deduction is being taken.

How the 1% Is Calculated

For employees, the base is gross salaries, wages, commissions, bonuses, and other compensation paid for services performed in Whitley County, in cash or property. For businesses, the base is net profits from county activity, measured by net income as reported on your federal return and adjusted under the Internal Revenue Code. If your business operates in more than one taxing district, only the Whitley County share is taxable, and the ordinance uses a payroll-and-sales apportionment formula to figure that share.1Whitley County Fiscal Court. Who Is Exempt

The ordinance exempts a short list of taxpayers:1Whitley County Fiscal Court. Whitley County Occupational Tax Ordinance 2005-08

  • Activities that federal or Kentucky law shields from local taxation.
  • Banks, trust companies, state and federally chartered savings and loans, and production credit associations.
  • Insurance companies already paying a state license fee or premium tax, including domestic life insurers.
  • Businesses already paying a license fee under another Whitley County ordinance.

If you think you fit one of these, confirm it with the Occupational Tax Administrator before you stop filing. The taxpayer carries the burden of proving the exemption.

Registering a New Business

A new business in Whitley County must register with the Occupational Tax Administrator before opening. • Annual Net Profits Return. Due the 15th day of the fourth month after your fiscal year ends. Calendar-year filers owe it by April 15.

Late Filing Penalties

A late return or late payment carries a 5% penalty of the unpaid tax for each month or partial month it stays overdue. The penalty tops out at 25% of the tax owed but is never less than $25. Interest also runs at 1% per month on the unpaid balance from the original due date until the tax is fully paid.1Whitley County Fiscal Court. Whitley County Occupational Tax Ordinance 2005-08

The charges stack quickly. On a $2,000 balance filed six months late, you’d hit the 25% penalty cap at $500 and owe another $120 in interest for those six months. Violating any part of the ordinance is also a misdemeanor carrying a fine of $10 to $100 per violation.1Whitley County Fiscal Court. Whitley County Occupational Tax Ordinance 2005-08

If You Work or Operate Inside Williamsburg

The City of Williamsburg and Whitley County have an interlocal agreement covering their occupational taxes. Kentucky law generally lets taxpayers who pay a city occupational fee take a credit against the county fee, which avoids being taxed twice on the same wages or profits. If your workplace or business sits inside city limits, check with both the city and the county on how the credit applies before you file. The City of Williamsburg’s website lists the county Occupational Tax Administrator’s contact information alongside its own new-business resources.3City of Williamsburg. New Business Owner Information
