In California, the EDD will only accept a disability certification from a licensed healthcare provider who falls into one of two categories defined by Unemployment Insurance Code Section 2708: “physicians” and “practitioners.”1California Legislative Information. California Unemployment Insurance Code 2708 – Filing, Determination and Payment of Disability Benefit Claims The list of who can certify disability in California for EDD purposes is broader than most people assume, but every provider on it is limited to conditions within their professional scope of practice.
Physicians Authorized to Certify SDI Claims
Section 2708 defines “physician” by referencing California Labor Code Section 3209.3, which recognizes several categories of licensed professionals.2California Legislative Information. California Labor Code 3209.3 Any of the following can complete your certification:
- Medical doctors (M.D.) and doctors of osteopathy (D.O.), who can certify the widest range of conditions
- Psychologists, for disabilities caused by mental health conditions
- Chiropractors, for musculoskeletal conditions within their scope
- Acupuncturists, for conditions treated through acupuncture within their licensed scope
- Optometrists, for vision-related disabilities
- Dentists, when a dental or oral condition is the cause of disability
- Podiatrists, for foot and ankle conditions
The scope-of-practice limit matters. A psychologist cannot certify a broken leg, and a podiatrist cannot certify a mental health disability. Your provider also has to be licensed in California, with one narrow exception for out-of-state care covered below.
Other Practitioners Who Can Certify
Section 2708 separately authorizes certain “practitioners,” though some of them face conditions that physicians do not.1California Legislative Information. California Unemployment Insurance Code 2708 – Filing, Determination and Payment of Disability Benefit Claims
Nurse practitioners can certify disability claims. For conditions other than pregnancy, childbirth, or postpartum recovery, a nurse practitioner must first perform a physical examination and collaborate with a physician and surgeon. For pregnancy-related claims, nurse practitioners can certify independently within their scope of practice.
Physician assistants can certify as well, but the physical examination must be performed under the supervision of a physician and surgeon. That supervision standard is stricter than the collaboration standard that applies to nurse practitioners.
Licensed midwives and nurse-midwives can certify disability claims, but only for pregnancy, childbirth, and postpartum conditions. Outside those situations, their certification authority does not apply.
What If You’re Being Treated Outside California
You are not disqualified from SDI benefits simply because you live or receive care somewhere else. If you are being treated in another state or country, your claim can be supported by a certificate from a physician or practitioner licensed or certified in that state or country.3California Legislative Information. California Unemployment Insurance Code 2708 – Filing, Determination and Payment of Disability Benefit Claims The provider must be the one actually treating you; you cannot find an out-of-state provider just to sign a form.
What the Provider’s Certification Must Include
Picking an authorized provider is only half the job. The certification itself has to contain a statement of medical facts based on a physical examination and a documented medical history, the provider’s conclusion that you are disabled, and an opinion on how long the disability will last.1California Legislative Information. California Unemployment Insurance Code 2708 – Filing, Determination and Payment of Disability Benefit Claims The EDD looks closely at several specific items:4Employment Development Department. Certify or Extend Claims – Basics for Physicians/Practitioners
- A diagnosis with an ICD code. If no diagnosis has been reached, the provider must give a detailed statement of your symptoms.
- A specific estimated recovery date. “Unknown” or “indefinite” is not accepted.
- Any secondary diagnoses that contribute to the disability.
- Your age, gender, and occupation, which the EDD uses to evaluate how the condition affects your ability to work.
- Relevant medical history, including past illnesses, injuries, and treatments.
Many claims stall here. A certification that names a diagnosis but never explains how the condition prevents you from doing your specific job gives the EDD little to work with. Before the appointment, make sure your provider understands what the job actually involves, whether that is standing for eight hours, lifting heavy objects, or sustained concentration, so the certification ties your medical limitations to the work you cannot perform.
How Your Provider Submits the Certification
The SDI application is a two-part form. You fill out Part A of the Application for Disability Benefits (DE 2501). Your provider fills out Part B, the Physician/Practitioner’s Certificate. The EDD will not process your claim until both parts are in.5Employment Development Department. DE 2501 Disability Insurance Claim Form Instructions
Your provider has two ways to send Part B:
- Online through myEDD, by logging into their SDI Online account and locating your claim. If you filed Part A online, give your provider the receipt number so they can find it.6Employment Development Department. Step 3 – Have a Medical Certification Completed
- By mail, using the paper Part B that comes with the DE 2501.
One detail trips up busy medical offices: the provider must personally sign the form. Rubber-stamped signatures are not accepted.5Employment Development Department. DE 2501 Disability Insurance Claim Form Instructions
The 49-Day Filing Deadline
You have 49 days from the date your disability began to submit the complete application, provider certification included.5Employment Development Department. DE 2501 Disability Insurance Claim Form Instructions Miss that window and you can lose benefits entirely. If you are hospitalized or otherwise unable to coordinate the paperwork yourself, have a family member help contact your provider’s office rather than waiting until you are recovered.
Extending Benefits Past the Original Recovery Date
If your disability lasts longer than the recovery date your provider gave originally, they need to file a Physician/Practitioner’s Supplementary Certificate (DE 2525XX). You will receive this form with your final SDI payment.7Employment Development Department. If you lost the form or never got it, request another through your SDI Online account or by calling the EDD at 1-800-480-3287.
Paid Family Leave Uses the Same Provider List
If you are applying for Paid Family Leave to care for a seriously ill family member, the same categories of physicians and practitioners authorized for SDI can complete the care certification. The care recipient’s healthcare provider fills out and signs Part D of the DE 2501F form.8Employment Development Department.
