In Virginia, when no court order exists, both legal parents share equal custody of their child. Neither one outranks the other, and neither can lawfully block the other from time with the child. That default is clean for married couples because both spouses are automatically legal parents. For unmarried couples it is more complicated, because an unmarried father has no enforceable custody rights until paternity is legally established.1Virginia Code Commission. Virginia Code 20-124.2 – Court-Ordered Custody and Visitation Arrangements
Married Parents Share Everything by Default
If you are married, Virginia treats you and your spouse as having equal legal and physical custody from the moment the child is born. That holds even after you separate, right up until a court enters an order that says otherwise.
Equal legal custody means both of you have authority over decisions about school, medical care, and how the child is raised. Equal physical custody means the child can lawfully reside with either of you.2Virginia Code Commission. Virginia Code 20-124.1 – Definitions Nobody holds a tiebreaker.
That is also the problem. Equal rights with no schedule and no decision-making structure works only as long as both parents cooperate. The moment you disagree about where the child sleeps or which doctor to see, neither of you can force the issue, and law enforcement will not step in to pick a winner between two legal parents when there is no order to enforce.
Unmarried Parents: Paternity Decides Everything
Virginia law forbids courts from favoring one parent over the other based on gender.1Virginia Code Commission. Virginia Code 20-124.2 – Court-Ordered Custody and Visitation Arrangements But unmarried mothers and unmarried fathers do not start in the same place. A mother is a legal parent by giving birth. A father is not a legal parent automatically. Until he establishes paternity, he has no custody rights the law will enforce.
Being listed on the birth certificate is useful as a record, but on its own it does not create the legal parent-child relationship Virginia requires before a father can assert custody.3Virginia Code Commission. Virginia Code Chapter 3.1 – Proceedings to Determine Parentage Without that legal foundation, an unmarried father who wants parenting time has no mechanism to demand it. The mother’s choices control.
Once paternity is established, that gap closes. The father then stands on equal footing with the mother, and both parents have the same default rights that married parents have.
How an Unmarried Father Establishes Paternity
There are two main paths, plus a separate registry for adoption situations.
The simplest is a Voluntary Acknowledgment of Paternity (AOP), a sworn written statement signed by both parents. It carries the same legal weight as a court judgment of paternity.4Virginia Code Commission. Virginia Code 20-49.1 – How Parent and Child Relationship Established Many parents sign at the hospital, but the form is also available through the Virginia Department of Social Services and the Virginia Paternity Establishment Program.5Virginia Paternity Establishment Program. Virginia Paternity Establishment Program Before signing, both parents must receive a written and oral explanation of what they are agreeing to. Either parent can rescind within 60 days. After that, the acknowledgment can only be set aside by proving fraud, duress, or a material mistake of fact.
If the mother will not sign, the father can file a petition in the Juvenile and Domestic Relations District Court to establish parentage. The court can order genetic testing and, if the results confirm the biological relationship, enter an order declaring the man the legal father. That same proceeding can also decide custody, visitation, and child support.6Virginia Code Commission. Virginia Code Title 20 Domestic Relations 20-49.8 Either parent, the child, or a representative of the Department of Social Services can file the petition.3Virginia Code Commission. Virginia Code Chapter 3.1 – Proceedings to Determine Parentage
Separately, Virginia keeps a Birth Father Registry through the Department of Social Services. Registering within 10 days of the child’s birth preserves an unmarried father’s right to be notified if the child is placed for adoption or enters foster care.7Virginia Department of Social Services. Virginia Birth Father Registry It does not establish paternity on its own and does not grant custody rights, but it keeps the father in the loop in adoption and foster care proceedings.
Why “Equal Rights” Without an Order Is a Weak Position
An informal arrangement works until one parent decides it doesn’t. If the other parent keeps the child and refuses contact, you have nothing to hand police and nothing a court can enforce overnight. Officers will usually decline to intervene between two legal parents when no order defines who is supposed to have the child.
The exposure runs further than access. Without an order, either parent can unilaterally change the child’s school, authorize medical treatment, or move with the child to another city or another state. The longer any of those decisions sit in place, the harder they are to unwind, because courts weigh the child’s established stability heavily when they finally do decide.
For unmarried fathers, waiting is especially costly. Every month without established paternity and without an order is another month in which the mother has sole practical control and the child’s current routine becomes more entrenched as the status quo a judge will be reluctant to disturb.
Filing for a Custody Order
Custody and visitation cases go to the Juvenile and Domestic Relations (J&DR) District Court.8Virginia Code Commission. Virginia Code 16.1-241 – Jurisdiction Venue follows the child: file in the city or county where the child lives at the time of filing. If the child was recently moved, you can file where the child lived before the move, so long as that was within the previous six months and a parent still lives there.9Virginia Code Commission. Virginia Code 16.1-243 – Venue
The paperwork starts at the local Court Services Unit of the J&DR court, where you initiate a Petition for Custody and Visitation.10Virginia Judicial System Court Self-Help. Custody, Visitation and Support The other parent then has to be formally served. Filing fees vary by locality.
In appropriate cases, the court is required to refer parents to a free dispute resolution orientation session with a certified mediator, after first checking for any history of family abuse.11Virginia Code Commission. Virginia Code 20-124.4 – Mediation If mediation does not resolve things, a judge decides.
At the first hearing you can ask for a temporary order to set a baseline schedule while the case is pending. If the child is in danger from abuse, neglect, or a threatened abduction, you can request emergency relief, and the court has authority to act quickly.9Virginia Code Commission. Virginia Code 16.1-243 – Venue
When the judge does rule, the only standard is the best interests of the child. The court cannot start from a preference for any custody arrangement and cannot favor either parent by gender. Instead it works through the factors in Virginia Code 20-124.3, which cover the child’s and each parent’s physical and mental condition, the existing parent-child relationships, each parent’s history of caregiving, each parent’s willingness to support the child’s relationship with the other, the child’s preference where age and maturity warrant, and any history of family abuse within the past 10 years.12Virginia Code Commission. If the Other Parent Lives in Another State
When the parents are in different states, or one parent moves the child out of Virginia, which state’s court can hear the case is governed by the Uniform Child Custody Jurisdiction and Enforcement Act. The baseline is “home state” jurisdiction: Virginia can decide custody if the child has lived in Virginia for at least six consecutive months immediately before filing.13Virginia Code Commission. Virginia Code 20-146.12 – Initial Child Custody Jurisdiction If the child recently left Virginia but lived here within the prior six months and a parent still lives here, Virginia courts can still take the case. For children under six months old, the home state is wherever the child has lived since birth.
At the federal level, the Parental Kidnapping Prevention Act requires every state to honor custody orders from another state as long as those orders were issued under proper jurisdictional rules.14Legal Information Institute. Parental Kidnapping Prevention Act (PKPA) If the other parent has taken the child across state lines and no order exists, filing quickly in the child’s home state is the most important move you can make.
