Who Is Exempt From Workers’ Comp Insurance in Florida?

In Florida, you can be exempt from workers’ compensation in one of three ways: the law already excludes you (sole proprietors and partners outside construction, domestic servants, commission-only real estate licensees, and certain volunteers), you are a corporate officer or LLC member who files for a Certificate of Election to be Exempt, or you qualify as an independent contractor under the statute’s multi-factor test. Who is exempt from workers’ comp in Florida depends heavily on whether the work is construction, because construction tightens almost every rule.

Who Is Already Exempt Without Filing Anything

Some people never need to apply. Florida’s definition of “employee” in Chapter 440 leaves them out from the start.

If you are a sole proprietor or a partner in a partnership and your business is not in the construction industry, the law does not count you as an employee for workers’ compensation purposes.1Official Internet Site of the Florida Legislature. Florida Statutes 440.05 – Election of Exemption, Revocation of Election, Notice, Certification No application, no certificate. If you want to be covered, you can opt in by filing Form DWC-251 with the Division of Workers’ Compensation.2Florida Department of Financial Services. Coverage Requirements

Construction-industry sole proprietors and partners get no such pass. Florida treats them as employees unless they hold a valid exemption certificate or carry their own workers’ compensation policy.3Florida Legislature. Florida Statutes 440.02 – Definitions

Several categories of workers are also written out of the statute entirely, so their employers owe them no coverage:

  • Domestic servants in a private home.
  • Licensed real estate professionals who agree in writing to be paid solely by commission.3Florida Legislature. Florida Statutes 440.02 – Definitions
  • Volunteers for nonprofit organizations or government agencies who do not receive wages or other significant payment.

If you fit one of these, workers’ compensation simply doesn’t apply. There’s nothing to file.

Corporate Officers and LLC Members Who File for Exemption

This is the group most people mean when they ask about Florida exemptions. Officers of a corporation and members of an LLC can file to exclude themselves from their own company’s workers’ compensation coverage. Once the exemption is approved, that person stops counting as an employee, which can drop a small company below the coverage threshold entirely.4Florida Department of Financial Services. Exemptions

The thresholds matter because they decide whether removing yourself solves the problem. Non-construction businesses need coverage once they reach four employees, counting officers and LLC members in that total. Construction businesses need coverage with a single employee, including an owner who is an officer or member. Agricultural businesses need coverage at six regular workers, or twelve seasonal workers who put in more than 30 days in a season or more than 45 days in a calendar year. State and local governments must carry coverage regardless of headcount.2Florida Department of Financial Services. Coverage Requirements

Non-Construction Officers and Members

Outside construction, the statute sets no cap on how many officers or LLC members can elect out. Any officer may file as long as they’re listed with the Florida Division of Corporations.3Florida Legislature. Florida Statutes 440.02 – Definitions

Construction Officers and Members

Construction is tighter in two ways. No more than three officers per corporation, or per group of affiliated corporations, can hold exemptions. And each officer who files must own at least 10 percent of the stock and appear as an officer on the Division of Corporations record.3Florida Legislature. Florida Statutes 440.02 – Definitions The affiliated-corporations piece exists to stop owners from spreading operations across multiple entities to collect more than three exemptions for the same group.

Keep in mind that Florida’s definition of “construction” reaches further than framing and concrete. The Division uses National Council on Compensation Insurance classification codes that pull in landscape gardening, sign installation, road paving, plumbing, roofing, electric power line work, and pipeline construction, among others. If your business sits in any of those trades, the construction rules apply.

Independent Contractors

Independent contractor status is a separate question from the officer exemption, but people often confuse the two. Here too, the construction split dominates.

Outside Construction

A non-construction worker is not an employee if at least four of these six are true:3Florida Legislature. Florida Statutes 440.02 – Definitions

  • Maintains a separate business with their own workspace, truck, equipment, or materials.
  • Holds or has applied for a federal employer identification number.
  • Receives payment to a business entity rather than as an individual.
  • Holds a business bank account used for business expenses.
  • Is free to perform work for other clients without filling out an employment application.
  • Is paid on a competitive-bid or per-task basis under a contract that does not state an employment relationship exists.

A worker who can’t meet four of six can still try to qualify under a backup seven-factor analysis looking at control, expenses, responsibility for completion, profit and loss, and ongoing business obligations. The worker bears the burden of proving independent contractor status.3Florida Legislature. Florida Statutes 440.02 – Definitions

In Construction

Florida treats a construction independent contractor as an employee for workers’ compensation purposes. Full stop.3Florida Legislature. Florida Statutes 440.02 – Definitions The six- and seven-factor tests above don’t apply. A construction subcontractor who wants to stay off someone else’s policy needs either a workers’ compensation policy of their own or a valid certificate of exemption.

How to Apply for an Exemption Certificate

Officers and LLC members apply online through the Florida Department of Financial Services portal using the Notice of Election to be Exempt (Form DWC 250). You’ll need your Social Security number, the business’s Federal Employer Identification Number, and your company’s document number from the Division of Corporations. The form asks for your role and the correct classification code.5Florida Department of Financial Services. Notice of Election to be Exempt

Construction applicants pay a $50 non-refundable processing fee plus a small convenience fee. Non-construction applicants pay no filing fee. The Division has 30 days from receipt of your application to decide.5Florida Department of Financial Services. Notice of Election to be Exempt

Once approved, your Certificate of Election to be Exempt is good for two years. You are responsible for printing it, keeping it, and watching the expiration date. If it lapses, you are counted as an employee again, which can push your business over the coverage threshold and force you to buy a policy.

What You Give Up by Being Exempt

An exemption saves you the premium cost of covering yourself, and that is often the reason people file. The trade-offs are real.

Once your exemption is in place, you cannot collect workers’ compensation benefits if you’re hurt on the job.4Florida Department of Financial Services. Exemptions No medical bills, no lost wages, no permanent disability payments through the system. Many owners assume personal health insurance will fill the gap, but standard health policies typically exclude injuries sustained during employment. Unless your plan has been specifically endorsed to cover work-related injuries, you could be looking at bills with nothing behind them.

Florida’s workers’ compensation system is a trade: the employer gives up the risk of negligence suits, and the employee gives up the right to sue in exchange for guaranteed benefits.6The Florida Legislature. Florida Statutes 440.11 – Exclusiveness of Liability When you elect exemption, you step outside the system. You aren’t entitled to benefits, but you also aren’t bound by the exclusive-remedy limit that would otherwise block a lawsuit. Whether that gives you a practical path to recover anything depends on how the injury happened and how your business is structured.

Keeping the Exemption Valid and Telling Your Contractor

If you’re a subcontractor, holding a certificate isn’t the end of it. Florida requires contractors to demand proof of coverage from every subcontractor, and an exempt officer must hand over a copy of the exemption certificate.7Official Internet Site of the Florida Legislature. Florida Statutes 440.10 – Liability for Compensation Many general contractors go further and require a full policy regardless, as a condition of doing business.

If you decide you want coverage back, or your business structure changes, you can revoke the exemption online. Only the person named on the certificate, or a corporate officer of the same business listed with the Division of Corporations, can file the revocation. An officer of a subcontracting company who revokes an exemption must notify the general contractor immediately, because the change can affect the contractor’s own coverage obligations and liability.8Florida Department of Financial Services.
