Wholesale License in Arkansas: Requirements, Fees, and Renewal

To operate as a wholesale prescription drug distributor in Arkansas, you need an Arkansas wholesale drug distributor license issued by the Arkansas State Board of Pharmacy. The initial permit costs $300, renews every two years for another $300, and requires you to designate an Arkansas-licensed pharmacist-in-charge who works directly for your business at the licensed location.¹²

Who Needs the License

Arkansas requires a permit for anyone engaged in the wholesale distribution of prescription drugs, which includes manufacturing them in the state, shipping them into the state, or selling or offering to sell them in the state.³ The law uses the term “legend drugs,” which just means prescription medications.

If your operation has multiple Arkansas locations under joint ownership and shared control, the Board may require a separate permit for each facility, each with its own application and fees.³ Businesses dealing only in non-pharmaceutical goods do not need this permit.

How to Apply

You submit the Board of Pharmacy’s official Wholesale Distributor of Prescription (Legend) Drugs application. The form collects the business name, address, ownership structure, contact information, and details about every location where drugs are stored or distributed.¹

The application also asks about criminal history and prior regulatory actions. A “yes” answer requires a detailed written explanation to the Board, though applicants who already filed one for a prior application don’t need to submit it again.¹

Pharmacist-in-Charge Requirement

Every wholesale distributor must designate an Arkansas-licensed pharmacist-in-charge. That person has to be a direct employee, not a consultant, and must be physically present at the location listed on the application.¹ You can’t submit the application until you have one on staff. Out-of-state companies entering Arkansas often underestimate how much lead time this takes.

Fees

The Board of Pharmacy’s fee schedule controls the amounts you actually pay, which are higher than the figures in the older underlying statute. Under the current schedule:

Initial permit: $300
Renewal: $150 per year, paid biennially, so $300 at each renewal
Change of ownership: $150, and a new permit is required

Those figures come directly from the Board’s rules.²

Renewal Cycle and Expiration

Wholesale distributor permits expire on December 31 of the first even-numbered year after the permit is issued.⁴ After that initial term, renewal is on a two-year cycle.⁵ A permit issued in 2025 expires December 31, 2026, and renews for the 2027–2028 cycle.

At each renewal you’ll update the Board on current contact information, all storage and distribution facility addresses, ownership or partnership structure, and the names of owners or operators.⁶

Late Renewal and Voided Permits

If you miss the expiration date, the Board assesses late penalties from its fee schedule. A permit unrenewed for 90 days after expiration becomes void, and for wholesale distributors specifically, if the renewal remains unpaid by April 1 of the year following expiration, the permit is void.⁴

Once voided, you cannot legally distribute prescription drugs in Arkansas. Getting back in means starting the full initial application over. Any distribution during the gap is unlicensed and exposes you to enforcement.

Display, Records, and Facility Standards

Every wholesale distributor must display its permit in a conspicuous place at the licensed location.³

You have to keep inventories and records for every incoming and outgoing prescription drug transaction. Each record must show the name and address of the seller or transferor, the address the drugs shipped from, the identity and quantity of drugs received or distributed, and the dates of receipt and distribution.⁷

Records have to be available for Board inspection and copying for two years after the drugs are distributed or disposed of. On-site or electronically retrievable records must be produced immediately during an inspection. Records kept off-site have to be produced within two business days of a Board request.⁷

Facilities must have adequate lighting, ventilation, temperature control, sanitation, humidity management, sufficient space, appropriate equipment, and proper security. A clearly marked, separate area is required for drugs that are outdated, damaged, or opened from sealed containers. The premises must stay clean, orderly, and pest-free.⁸

Federal Requirements That Run Alongside the State License

DEA Registration

If you distribute any controlled substance in Schedules I through V, you must register separately with the DEA using Form 225.⁹ The distributor registration fee is $1,850 per year.¹⁰ List I chemicals require a separate registration at the same fee. Renewals use Form 225a. Any address change needs an approved state license for the new location before the DEA will process it.

FDA Drug Supply Chain Security Act

Under the DSCSA, wholesale distributors must report their licensure and other business information to the FDA annually, trace products at the package level as drugs move through the supply chain, and notify the FDA within 24 hours of identifying an illegitimate product.¹¹ The documentation overlaps significantly with Arkansas’s own record-keeping rules.

Suspicious Order Monitoring

Arkansas rules also require wholesale distributors to watch for and flag suspicious orders. You have to develop criteria for identifying unusual purchasing patterns, especially from new customers.¹² Ignoring red flags in orders puts both the Arkansas permit and any DEA registration at risk.
