Will I Lose My Medi-Cal If I Get Married?

Getting married will not automatically end your Medi-Cal, but it changes how the state measures your eligibility. Once you are legally married, your spouse’s income is added to yours and the household is judged against a two-person limit. For 2026, a single adult can earn up to about $1,835 per month and stay eligible, while a two-person household’s ceiling is about $2,489 per month. The two-person limit is only roughly $654 higher than the single-person limit, so a working spouse can push a household over the line quickly. If the combined income stays under the threshold, your coverage continues; if it doesn’t, there are specific programs that let you transition without a gap.

How Marriage Changes Your Income Calculation

Most non-elderly, non-disabled adults qualify for Medi-Cal under the Modified Adjusted Gross Income (MAGI) rules, which borrow from federal tax rules to count income and define the household. Federal regulations require that a married couple living together be placed in the same Medi-Cal household, regardless of how they file their taxes.1eCFR. 42 CFR 435.603 Application of Modified Adjusted Gross Income (MAGI) – Section: (f) Household Your spouse’s wages, self-employment income, interest, dividends, and net capital gains are all combined with yours for a single eligibility determination.2Medicaid.gov. MAGI 2.0 Building MAGI Knowledge Part 2 – Income Counting

The MAGI ceiling is 138 percent of the Federal Poverty Level. The 2026 figures look like this:3HealthCare.gov. Federal Poverty Level (FPL) – Glossary

  • One person: about $22,025 per year, or $1,835 per month
  • Two people: about $29,863 per year, or $2,489 per month
  • Three people: about $37,702 per year, or $3,142 per month
  • Four people: about $45,540 per year, or $3,795 per month

Some couples assume that filing separately will keep their incomes from being combined. It will not. Federal rules apply the same household treatment whether you file jointly, separately, or not at all.1eCFR. 42 CFR 435.603 Application of Modified Adjusted Gross Income (MAGI) – Section: (f) Household Filing status does start to matter if you lose Medi-Cal and move to Covered California, because married couples generally need to file jointly to receive premium tax credits.4HealthCare.gov. When the Math Can Work in Your Favor

A larger household size raises the income limit, so marriage does not always push you out. If your spouse earns very little or nothing, the move from a one-person to a two-person threshold can actually give you more room.

Children in the home work the same way. When you marry someone who has children, those children generally become part of your Medi-Cal household if they live with you, and vice versa.5Centers for Medicare & Medicaid Services. Reporting Your Marriage to Medi-Cal

You are required to report your marriage within 10 days of the date it happens. Before you contact your county, pull together:

  • The exact date the marriage became legal
  • Your spouse’s Social Security number
  • Proof of your spouse’s income, such as the two most recent pay stubs or a recent W-2
  • Current bank and investment statements, if either spouse is enrolled through a Non-MAGI program

You can report the change through the BenefitsCal online portal, by mail to your county social services office, or by phone to that office.6BenefitsCal. Reporting Awareness Update The Department of Health Care Services provides change-report forms, including the MC 210 RV, through the DHCS website and county offices.7Department of Health Care Services. After the update is processed, you will receive a Notice of Action explaining whether your coverage continues, changes, or ends, along with your right to appeal.8DHCS. Medi-Cal Notice of Action (NOA) – FAQs

If You Report Late

Missing the 10-day window does not trigger an automatic penalty, but it can create an overpayment. If the state later finds that you received benefits during a period when your household was over the income limit, you can be required to pay the difference back. For honest mistakes or simple delays, repayment is typically capped at 10 percent of your monthly benefits at a time. That cap does not apply if the state concludes you intentionally hid your marriage or your spouse’s income, in which case the full amount can be recouped more aggressively.9Social Security Administration. If Marriage Pushes You Over the Limit

Losing Medi-Cal because of a combined income increase does not leave you uninsured. Two options cover most situations.

Transitional Medi-Cal for Families With Children

If you have children in the home and your family loses Medi-Cal because of higher earnings, you may qualify for Transitional Medi-Cal (TMC), which continues no-cost coverage for up to 12 months. The first six months have no income test. To keep coverage for the second six months, you must stay employed, report earnings quarterly, and keep gross income (minus child-care costs) under 185 percent of the Federal Poverty Level.10Medicaid.gov. TMA Unwinding FAQs TMC is tied specifically to increased earnings, so it fits the situation of marriage raising household income rather than other reasons for an eligibility change.

Covered California and Premium Tax Credits

Losing Medi-Cal is a qualifying life event that opens a 90-day special enrollment window with Covered California, counted from the last day of your Medi-Cal coverage.11Covered California. You Don’t Qualify for Medi-Cal Anymore – Now What You do not have to wait for annual open enrollment.12Covered California. Major Life Changes

If your combined household income is between 138 and 400 percent of the Federal Poverty Level, you may qualify for federal premium tax credits that cut your monthly premium.13Covered California. Program Eligibility by Federal Poverty Level for 2026 For a two-person household in 2026, that range is roughly $29,863 to $86,560 per year. To receive the credits, married couples generally must file a joint return.4HealthCare.gov. If You Qualify Through Age, Blindness, or Disability

If you or your spouse receives Medi-Cal through a Non-MAGI program — coverage based on being 65 or older, blind, or disabled — marriage affects you in an additional way. California reinstated asset limits for Non-MAGI programs effective January 1, 2026.14Department of Health Care Services. DHCS All-County Welfare Directors Letter 26-02 The limits are $130,000 for an individual and $195,000 for a couple, with an additional $65,000 per family member up to ten people. When you marry, both spouses’ countable assets are combined against the couple’s $195,000 limit.15Department of Health Care Services. Asset Limits FAQs A spouse’s income is also factored in through income deeming, where a portion of the higher-earning spouse’s income is attributed to the applicant.16Department of Health Care Services. Non-MAGI Medi-Cal

MAGI-based Medi-Cal still has no asset test. If you qualify through the standard adult pathway, only income matters, and the asset-limit change does not touch you.

If the Non-MAGI situation involves long-term care, ask your county Medi-Cal office about spousal impoverishment rules. In 2026, the at-home “community spouse” can keep up to $162,660 in countable assets under the Community Spouse Resource Allowance, along with a minimum monthly income allowance for living expenses, while the spouse receiving long-term care is held to the $130,000 individual limit.15Department of Health Care Services. Asset Limits FAQs The protections are more generous than the standard limits suggest, and they apply only when you ask the county to evaluate them.
