The Winchester meals tax form is a one-page monthly return filed with the Commissioner of the Revenue, reporting your gross receipts, subtracting exempt sales, and remitting 6.5% of the taxable amount by the 20th of the month after collection.1City of Winchester. Admissions, Lodging, Meals Taxes You can pick up the form at the Commissioner’s office or file through the city’s taxpayer portal at taxes.winchesterva.gov.2City of Winchester. Taxpayer Portal
What Goes on the Form
The return itself is short. You fill in:
- Business name and location
- Reporting period (the calendar month being reported)
- Gross receipts: total sales for the month, taxable and non-taxable combined
- Deductions: exempt sales such as government purchases, food stamp transactions, and bulk sales
- Taxable receipts: gross receipts minus deductions
- Tax due: taxable receipts multiplied by 6.5%
- Authorized signature, date, and phone number
The arithmetic is simple. Start with everything you sold, subtract what’s exempt, multiply by 0.065. There are separate fields for penalty and interest if the return is late; leave them blank if you’re filing on time. Cross-check your taxable receipts against daily sales records and bank deposits before you sign.
Even a month with no sales needs a return. File a zero return rather than skipping the month.
Separating Taxable Sales From Exempt Sales
The deduction line is where most filing errors happen, so your daily records need to track the two categories separately.
Taxable sales include all prepared food and drinks ready for immediate consumption, whether eaten on-site or taken to go: sandwiches, hot foods, deli items, prepackaged single-serving salads, pastries, ice cream cones, pizza slices, and similar individual portions.3City of Winchester, VA. Business Taxes Alcoholic beverages and soft drinks are taxable whether or not food is sold with them. The 6.5% applies to the total cost of the meal, including any mandatory gratuity or service charge added by the seller; voluntary tips left by the customer are not taxable.1City of Winchester. Exempt sales that belong on the deductions line include:
- Factory-sealed beverages and prepackaged foods sold for off-premises consumption
- Food stamp (SNAP) and WIC purchases
- Theater sales of popcorn, candy, and non-alcoholic drinks
- Bulk sales: six or more of the same non-prepackaged item (donuts, cookies), or any single item weighing more than half a pound3City of Winchester, VA. Business Taxes
- Meals purchased and paid for by the Commonwealth of Virginia, its political subdivisions, or the federal government4Virginia Code Commission. Virginia Code 58.1-3840 – Certain Excise Taxes Permitted
Nonprofit organizations, churches, and volunteer fire departments have limited exemptions for fundraising events. A whole cake or a gallon of ice cream falls outside the tax; a single slice or scoop does not.
Deadline and Late Penalties
The return and payment are due by the 20th of the month following the collection period. If the 20th lands on a weekend, the deadline moves to the next business day.1City of Winchester. Admissions, Lodging, Meals Taxes January collections are due February 20, February collections are due March 20, and so on through the year.
A late return triggers a penalty of 10% of the tax due or $10, whichever is greater, plus interest at 10% per year beginning the day after the original due date.1City of Winchester. Admissions, Lodging, Meals Taxes Those charges compound across months if you fall behind.

Records to Keep
Winchester requires you to keep detailed records of all gross receipts, the amount charged to each purchaser, dates of purchase, and taxes collected for at least two years.3City of Winchester, VA.
