Wisconsin Concealed Carry Laws: Permits, Restrictions, and Penalties

To carry a hidden handgun, electric weapon, or billy club in public in Wisconsin, you need a Wisconsin concealed carry license issued by the state Department of Justice. The license costs $40, is valid for five years, and requires you to be at least 21, a Wisconsin resident, legally allowed to possess a firearm under state and federal law, and able to document firearms training.1Wisconsin Department of Justice. Welcome to Concealed Carry Weapon Application Open carry of a firearm is legal without any permit, but once a weapon is hidden on your person or within reach, the license requirement takes over.

One quick boundary before the details: concealed knives are not covered by the state’s concealed-weapon prohibition, so you do not need the license to carry a hidden knife.2Wisconsin State Legislature. Wisconsin Statutes 941.23 – Carrying Concealed Weapon The license is about handguns, electric weapons, and billy clubs.3Wisconsin State Legislature. Wisconsin Statutes 175.60

Who Qualifies

The DOJ must issue a license to any applicant who meets the statutory criteria. You will be denied if any of the following applies to you:

  • You are under 21.4Wisconsin Department of Justice. Wisconsin Carrying Concealed Weapon Law Questions and Answers
  • You are not a Wisconsin resident. Residency is shown with a Wisconsin driver’s license or state ID; active-duty military stationed in the state also qualify.4Wisconsin Department of Justice. Wisconsin Carrying Concealed Weapon Law Questions and Answers
  • You are barred from possessing a firearm under federal law. That covers anyone convicted of a felony, convicted of a misdemeanor crime of domestic violence, or subject to certain domestic violence restraining orders.3Wisconsin State Legislature. Wisconsin Statutes 175.60
  • You are barred from possessing a firearm under Wisconsin law, which includes certain violent felony or misdemeanor convictions and juvenile adjudications for acts that would be a felony if committed by an adult.5Wisconsin State Legislature. Wisconsin Statutes 941.29
  • A court has prohibited you from possessing a dangerous weapon as a condition of bail or release.3Wisconsin State Legislature. Wisconsin Statutes 175.60

Mental health disqualifiers are handled through the federal firearms prohibition. If you have been involuntarily committed to a mental health facility or found not guilty by reason of mental disease or defect, federal law bars you from possessing firearms, which makes you ineligible for the license. Eligibility can be regained if a court later restores your firearm rights.

Training That Counts

You must submit proof of firearms training with your application. Wisconsin accepts a broader range of training than many states and does not require a live-fire exercise. Any of the following qualifies:1Wisconsin Department of Justice. Welcome to Concealed Carry Weapon Application

  • A safety or training course taught by an instructor certified by a national or state firearms organization, such as the NRA.
  • A firearms course open to the public and offered by a law enforcement agency, technical college, university, or private training school, taught by a certified instructor.
  • Completion of Wisconsin’s hunter education program or a substantially similar program from another state.
  • Prior military or law enforcement service that included firearms training, with documentation of that training.

You submit a certificate of completion or equivalent documentation. The statute sets no minimum hour count, which is why hunter safety and shorter certified programs qualify. What matters is that the training comes from a recognized source.

How to Apply

Applications go to the DOJ online or by mail. You will need your Wisconsin driver’s license or state ID number and your training documentation.1Wisconsin Department of Justice. Welcome to Concealed Carry Weapon Application

The $40 non-refundable fee is a $30 application fee plus a $10 background check fee. Fingerprinting is not required. The DOJ runs a name-based background check through state and federal databases. Most checks are straightforward; if your name produces potential matches that need clarification, the DOJ may request more documentation.

The DOJ must process new applications within 21 days of receiving all required materials.6Wisconsin Department of Justice. Managing a CCW License Approved licenses are mailed. Incomplete applications and missing training documents are the usual cause of delays.

Where You Still Cannot Carry

A valid license does not open every door. State law, federal law, and private property rights carve out places where concealed carry remains off-limits, with different penalties attached to each.

Schools and Campuses

Firearms are prohibited on K-12 school grounds, including buildings, parking lots, and athletic fields. Federal law also prohibits firearms within 1,000 feet of school grounds, but holders of a state-issued license that required a background check are exempt from the buffer-zone rule. Wisconsin’s license qualifies for that exemption, so the 1,000-foot zone is not a problem for license holders — but school grounds themselves still are.4Wisconsin Department of Justice. University of Wisconsin system campuses have their own rules. Firearms are prohibited in all university buildings and on university lands unless the chief administrative officer has given written approval.

Government Buildings

Police stations, sheriff’s offices, prisons, jails, and courthouses are off-limits. Judges can extend the prohibition to courtrooms and adjoining areas. Other municipal buildings like city halls and county offices can prohibit firearms if they post signs at entrances.

Taverns

Carrying a handgun inside a tavern is generally prohibited under Wisconsin law. The line between a tavern and a restaurant that happens to serve alcohol can get technical, so the safe approach is to treat any establishment whose primary business is serving drinks as off-limits.

Private Property

Property owners and businesses can ban firearms by posting signs at entrances. The signs themselves do not create a standalone firearms offense for license holders. The exposure is trespassing: if you are asked to leave and refuse, you can be charged.

Federal Buildings and National Parks

Federal law prohibits firearms inside any building owned or leased by the federal government where federal employees work. Post offices, federal courthouses, VA facilities, and Social Security offices all qualify. Knowingly bringing a firearm into a federal facility carries up to a year in prison.7Office of the Law Revision Counsel. 18 USC 930 – Possession of Firearms and Dangerous Weapons in Federal Facilities

National parks in Wisconsin follow state carry law for outdoor areas, so a license is valid on trails and campgrounds. Park Service buildings — visitor centers, ranger stations, administrative offices — are federal facilities and remain off-limits.8National Park Service. Firearms in National Parks

Carrying While Drinking

Going armed with a firearm while under the influence of an intoxicant is a Class A misdemeanor, carrying up to nine months in jail and a $10,000 fine.9Wisconsin State Legislature. Wisconsin Statutes 941.20 – Endangering Safety by Use of Dangerous Weapon A conviction can also lead to license revocation. The statute does not set a blood-alcohol threshold the way OWI laws do. Any level of impairment from alcohol or drugs triggers the prohibition, and it applies whether you are on foot, in a car, or anywhere else.

Traffic Stops and Police Encounters

Wisconsin is not a duty-to-inform state. You do not have to volunteer that you are carrying during a traffic stop. If an officer asks, answer truthfully. Lying or giving misleading information can produce an obstruction charge.

An officer who learns you are armed can temporarily take possession of the weapon during the encounter if they believe it is necessary for safety. The firearm must be returned afterward if there is no legal reason to keep it. Keeping your hands visible and following the officer’s instructions keeps the interaction routine.

Traveling Out of State

Wisconsin recognizes concealed carry permits from a long list of other states, but recognition is not universal. The DOJ keeps the current list online and updates it as other states change their laws. Recognition hinges on whether the issuing state requires a background check comparable to Wisconsin’s.10Wisconsin Department of Justice. CCW Reciprocity

Some states are recognized only with conditions. Wisconsin honors South Dakota’s enhanced and gold licenses only, Louisiana licenses only if issued or renewed after March 9, 2015, and Florida licenses only if issued to non-Florida residents after August 1, 2013. Permits from Maine, New Hampshire, New Jersey, Oregon, and Vermont are not recognized at all.10Wisconsin Department of Justice. CCW Reciprocity

Whether another state honors your Wisconsin license is governed by that state’s laws, not Wisconsin’s. The DOJ does not maintain a list of states that recognize Wisconsin permits, so check the destination state’s rules before traveling. Even permitless-carry states vary: some recognize out-of-state permits, some do not, and prohibited locations and magazine limits can differ.

If you are driving through a state that does not recognize your permit, the federal Firearm Owners’ Protection Act gives limited cover. You can transport a firearm through any state as long as you can legally possess it at both origin and destination. During transport the firearm must be unloaded and stored where it is not directly accessible from the passenger compartment; if the vehicle has no trunk, it must be in a locked container other than the glove compartment or console.11Office of the Law Revision Counsel. 18 US Code 926A – Interstate Transportation of Firearms This covers passing through, not stopping for extended periods or carrying concealed in a non-recognizing state.

Flying with a firearm follows TSA rules regardless of your permit. The firearm must be unloaded, locked in a hard-sided container, and in checked baggage. You must declare it at the ticket counter. Ammunition goes in its original packaging or a container designed for it, with loaded magazines securely boxed. Carry-on is never allowed.12Transportation Security Administration. Transporting Firearms and Ammunition

Penalties for Violations

The consequences depend on what you did and where you did it.

  • Carrying any concealed weapon without a license is a Class A misdemeanor, punishable by up to nine months in jail and a fine up to $10,000.4Wisconsin Department of Justice. Wisconsin Carrying Concealed Weapon Law Questions and Answers
  • Carrying after revocation can escalate to felony charges, especially when the revocation stems from a conviction that bars you from possessing firearms.
  • Bringing a firearm into a courthouse, jail, or similar restricted government building can produce felony charges. A felony conviction triggers a permanent loss of firearm rights under both state and federal law.5Wisconsin State Legislature. Wisconsin Statutes 941.29
  • Carrying on school grounds is a separate criminal offense that can reach felony-level penalties.
  • Armed while intoxicated is a Class A misdemeanor with up to nine months in jail and a $10,000 fine, plus possible license revocation.9Wisconsin State Legislature. Wisconsin Statutes 941.20 – Endangering Safety by Use of Dangerous Weapon
  • Ignoring a posted private property firearms ban is not a standalone firearms offense, but refusing to leave after being asked turns it into trespassing.

Most concealed carry violations start as misdemeanors, but any charge that crosses into felony territory permanently ends your right to possess firearms. That single conviction does not just cost you the license. It bars you from keeping a gun in your home for life unless a court restores your rights.

Keeping the License Current

A Wisconsin license is valid for five years. You can submit a renewal application up to 120 days before the expiration date and up to 90 days after it.13Wisconsin Department of Justice. Concealed Weapon Renewal Application Instructions The renewal fee is $22, split between a $12 application fee and a $10 background check fee.6Wisconsin Department of Justice. Managing a CCW License No additional training is required.

One thing to watch. The 90-day post-expiration window keeps you from having to file a brand-new application, but it does not let you keep carrying. Once the license expires, your carry authority ends until the renewal is approved. Miss the 90-day window entirely and you are no longer eligible to renew; you must submit a full new application with the $40 fee.13Wisconsin Department of Justice. Renewals are processed within 21 days, the same timeline as new applications. You also have to notify the DOJ within 30 days of any address change during the life of the license.6Wisconsin Department of Justice. Managing a CCW License
