Wisconsin Lodging Tax: Rates, Platforms, and Filing

If you rent out lodging in Wisconsin for stays under a month, you owe a 5% state sales tax on every booking, and in almost every county you also owe a 0.5% county tax (0.9% in Milwaukee County). On top of that, your city, village, or town can add a local room tax of up to 8%, and a few areas layer on special district taxes as well. The Wisconsin lodging tax is really several taxes stacked on the same stay, filed on different returns, with real personal consequences if you collect the money and fail to turn it over.

Which Stays Are Taxable

The state sales tax under Wis. Stat. § 77.52 applies to lodging rented to “transients,” meaning anyone staying for a continuous period of less than one month. “One month” is defined as a calendar month or 30 days, whichever is shorter, counting the first day of the rental but not the last.1Wisconsin State Legislature. Wisconsin Statutes 77.52 – Imposition of Retail Sales Tax A guest who checks in February 1 crosses the line on February 28 — the end of the calendar month — not after a full 30 nights.

The tax hits hotels, motels, inns, tourist homes, lodging houses, summer camps, resort lodges, cabins, and any other accommodations offered to the public.1Wisconsin State Legislature. Wisconsin Statutes 77.52 – Imposition of Retail Sales Tax The taxable amount is the room charge plus any mandatory fees a guest can’t avoid, such as resort fees or cleaning charges.

The Tax Layers You May Owe

State Sales Tax

69 counties add 0.5%. Milwaukee County charges 0.9%. Only two counties statewide have no county sales tax at all.2Wisconsin Department of Revenue. DOR Tax Rates You collect this at the same time as the state tax and report both on the same return.

Local Room Tax

Under Wis. Stat. § 66.0615, cities, villages, and towns can impose a room tax up to 8%. Municipalities tied to convention center construction or renovation in counties of at least 380,000 can exceed that cap.3Wisconsin State Legislature. Wisconsin Statutes 66.0615 Actual rates vary; check with your municipal clerk or treasurer for the exact figure where your property sits.

This one is important procedurally: the local room tax is separate from the state system. The Department of Revenue does not collect it for the municipality.4Wisconsin Department of Revenue. Wisconsin Room Tax Report You file one return with the state for the sales and county taxes, and a second return directly with the municipality for the room tax.

Special District Taxes

Ten Wisconsin municipalities impose a Premier Resort Area Tax on lodging. The rate is 1.25% in the City of Wisconsin Dells and the Village of Lake Delton, and 0.5% in Bayfield, Eagle River, Ephraim, Rhinelander, Sister Bay, Stockholm, and (effective July 1, 2026) Sturgeon Bay and Minocqua.5Wisconsin Department of Revenue. Lodging in Milwaukee County also carries a Wisconsin Center District tax: 3% countywide and 7% on hotel rooms within the City of Milwaukee itself.6Wisconsin Center District. Financial Information A hotel guest in downtown Milwaukee can pay the state sales tax, the 0.9% county tax, the local room tax, and the district tax all on the same bill.

When You Don’t Collect

The most common exemption is the one-month rule above. Once a guest’s continuous stay reaches a calendar month or 30 days, whichever is shorter, the stay stops being transient lodging and the sales tax no longer applies.1Wisconsin State Legislature. Wisconsin Statutes 77.52 – Imposition of Retail Sales Tax

Sales to the federal government and its agencies are exempt from both the state sales tax and the local room tax.3Wisconsin State Legislature. Wisconsin Statutes 66.0615 Nonprofits with tax-exempt status can book tax-free only if the organization itself pays directly — not the individual traveler — and provides a completed Form S-211 with its Certificate of Exempt Status (CES) number.7Wisconsin Department of Revenue. Accepting an incomplete certificate and skipping the tax carries a $250 fine per transaction.7Wisconsin Department of Revenue. If You Book Through Airbnb or VRBO

Since January 1, 2020, marketplace platforms that facilitate lodging bookings in Wisconsin have been required to collect and remit the state sales tax and county tax for their hosts. As of October 1, 2021, they must also collect local room taxes and report them to the municipality.8Wisconsin Department of Revenue. The platform files a consolidated return covering all its hosts, so you don’t file for bookings it collected on. Two cautions. First, if the platform was required to collect and failed to, the host remains personally liable. Second, any direct bookings you take outside a platform — a return guest who contacts you by email, say — are still your responsibility: register with the state, collect the taxes, and file your own returns on those.

Getting Registered

Before you collect a dollar, you need a Wisconsin Seller’s Permit. Apply by filing Form BTR-101 (Application for Business Tax Registration) with the Department of Revenue. You’ll need your legal business name, a Federal Employer Identification Number or Social Security Number, the property’s physical address, the date you expect to begin renting, and a NAICS code identifying you as a lodging provider.10Wisconsin Department of Revenue. Application for Wisconsin Business Tax Registration The initial fee is $20.11Wisconsin Department of Revenue. Business Tax Registration You can file electronically through the Department’s website.

The application asks for an estimate of your monthly taxable receipts, which the Department uses to assign your filing frequency. The seller’s permit covers your state and county tax obligations only. For the local room tax, register separately with each municipality where your property is located; forms and procedures differ by town.

Filing and Paying

File state sales tax and county tax returns through the Department of Revenue’s My Tax Account online portal.12Wisconsin Department of Revenue. DOR Make a Payment The Department assigns you a monthly, quarterly, or annual schedule based on your estimated volume. Returns are generally due the last day of the month following the reporting period.13Wisconsin Department of Revenue. DOR Businesses Calendar

Local room tax returns go to the municipality on a separate schedule, with forms, due dates, and payment methods that vary. Confirm those details when you register with the local office.

Penalties and Personal Liability

Miss a filing deadline and you get a $20 late filing fee for starters. Delinquent taxes accrue interest at 1.5% per month until paid. Unpaid taxes that are not yet delinquent carry 12% annual interest from the return’s due date. If you don’t file at all, a separate failure-to-file penalty of 5% of the tax due per month applies, up to a 25% cap.14Wisconsin State Legislature. Wisconsin Statutes 77.60 – Interest and Penalties

The more serious exposure is personal. Every dollar of sales tax you collect from a guest is legally state property held in trust. Willfully failing to turn it over makes any officer, member, or responsible person of the business personally liable for the full amount with interest and penalties, and that liability survives even if the business dissolves. Intentionally failing to remit collected taxes — or paying another creditor before paying the state — is treated as theft under Wisconsin criminal law, and paying a supplier before the Department of Revenue is itself treated as evidence of intent to steal.15Wisconsin State Legislature. Wisconsin Statutes 77.60(11)

Records and Audits

Keep every record related to lodging tax collection for at least four years from the date the return was filed or due, whichever is later.16Wisconsin Department of Revenue. Sales and Use Tax – Common Questions That means booking confirmations, receipts, exemption certificates, bank statements, and the worksheets showing how you calculated what you reported.

The Department conducts both field audits (an auditor visits and compares returns against your books) and office audits run through the mail with questionnaires and document requests. Auditors can pull data from third parties, including booking platforms, so any gap between what Airbnb reported and what you filed will surface quickly.17Wisconsin Department of Revenue. Audits Track each reservation with the dates of stay, nightly rate, mandatory fees, taxes collected, and guest name; attach the S-211 to any exempt booking. Clean records cost very little; a trust fund assessment costs a great deal.
