Wisconsin Sales Tax Filing: Form ST-12, Deadlines, and Penalties

Wisconsin sales tax filing runs through the Department of Revenue’s My Tax Account portal on Form ST-12. You file on a schedule the DOR assigns based on how much tax you collect, report 5% state tax plus any county or resort area tax owed, and pay by the deadline for your assigned period. Miss it and you owe a $20 late filing fee, escalating penalties, and 18% annual interest on the unpaid balance.

Filing Frequency and Deadlines

  • Early monthly: $3,601 or more per quarter, returns due by the 20th of the following month
  • Monthly: $1,201 to $3,600 per quarter, returns due by the last day of the following month
  • Quarterly: $601 to $1,200 per quarter, returns due by the last day of the month after the quarter ends
  • Annual: $600 or less per year, one return for the entire year

The early monthly tier catches filers off guard. Once your quarterly liability crosses $3,600, your deadline moves ten days earlier than the regular monthly one, to the 20th instead of the last day of the following month.2Wisconsin State Legislature. What You Report on Form ST-12

Form ST-12 starts with total gross receipts from all sales during the reporting period, taxable and nontaxable together.3Wisconsin Department of Revenue. The local tax section is where the form takes real time. Seventy counties impose an additional 0.5% county tax, and Milwaukee County imposes 0.9%.5Wisconsin Department of Revenue. Billing or delivery location determines which county’s tax applies. Manitowoc and Racine counties recently adopted the 0.5% tax as well.

Form ST-12 also has a use tax section. When your business bought items without paying Wisconsin sales tax, typically from out-of-state or online sellers, you report and pay the equivalent use tax on the same return.7Wisconsin Department of Revenue. Keep exemption certificates (Form S-211), invoices, receipts, and out-of-state purchase records organized by reporting period. How to File and Pay

Nearly all businesses file through My Tax Account. You log in, open your sales tax account, enter figures from your completed Form ST-12, submit, and save the confirmation number as proof of timely filing.

The DOR’s TeleFile system handles the same return by phone through an automated prompt, including state, use, and county tax.9Wisconsin Department of Revenue. Paper filing requires a formal waiver. You submit Form EFT-102 at least 60 days before the due date and explain why electronic filing creates an undue hardship, including what steps you tried.10Wisconsin Department of Revenue. For payment, ACH debit through My Tax Account is the most common route and credits your account immediately for the correct period. Credit card payments go through a third-party processor that charges a convenience fee on top of the tax. Either way, the transaction has to be completed by the deadline, not just started. If you have a paper filing waiver, a check or money order can be mailed with the voucher from the paper return, postmarked by the due date.2Wisconsin State Legislature. The Discount for Filing on Time

Wisconsin lets you keep part of the sales tax you collect as a retailer’s discount, but only if the return and payment are both on time.11Wisconsin Department of Revenue. Retailer’s Discount The tiers:

  • $0 to $10 in total sales tax: keep the full amount
  • $10 to $1,333 in total sales tax: keep $10
  • More than $1,333: keep 0.75%, up to $8,000 per reporting period

For a monthly filer collecting $50,000 or more in tax per period, the 0.75% adds up to hundreds of dollars a year. Miss the deadline and you forfeit the discount for that period entirely.

Penalties and Interest for Late Filing

  • Late filing fee: $20 flat, on any delinquent return
  • Failure-to-file penalty: 5% of unpaid tax the first month, plus 5% for each additional month or partial month, capped at 25%
  • Interest on delinquent tax: 1.5% per month, 18% annualized, until paid
  • Incorrect return penalty: 25% of the tax due for an inaccurate return
  • Fraud penalty: 50% of the tax due for an intentional failure to file or a false return
  • Exemption certificate misuse: $250 per invoice

The numbers add up quickly. A business that owes $2,000 and waits four months to file could owe $400 in failure-to-file penalty plus roughly $120 in interest, on top of the tax and the $20 late fee. Zero-Sales Periods and Closing the Account

You must file a return for every assigned reporting period, even one with no sales and no tax due.13Wisconsin Department of Revenue. Sales and Use Tax – Common Questions Skipping a zero-dollar return is treated the same as not filing at all, and the penalty clock starts.

If you stop making sales in Wisconsin, cancel the seller’s permit through My Tax Account and file a final return covering the period through your closing date. A dormant permit that hasn’t been formally closed keeps generating return obligations, and missing periods trigger the same penalties as any other unfiled return. The permit is not transferable, so a buyer of your business needs to apply for their own before making taxable sales.
