WorkForce WV Registration for SNAP Benefits: ABAWD Rules and Appeals

If you receive SNAP in West Virginia and you’re a work-eligible adult, you have to register as a job seeker with WorkForce West Virginia before the Department of Human Services (DoHS) will approve or continue your benefits. Who Has to Register

Federal rules require most SNAP recipients between the ages of 16 and 59 to register for work. Anyone younger than 16 or 60 and older is automatically exempt.2eCFR. 7 CFR 273.7 – Work Provisions Within that age range, you don’t have to register if you fall into one of these groups:

  • You’re physically or mentally unfit for employment. Your doctor completes the state’s Disability/Incapacity Medical Assessment form (DFA-DIMA-1), which asks for diagnosis, prognosis, expected duration, and work limitations. Return it by the deadline your caseworker gives you; a late form alone can cost you benefits.
  • You’re a parent or household member caring for a child under six.
  • You’re enrolled at least half-time in a recognized school or training program.
  • You’re in a drug or alcohol treatment program that prevents you from working.
  • You’re already working at least 30 hours per week, or earning the equivalent of 30 hours at federal minimum wage.

If none of those fit, plan on registering. When you apply through the WV PATH portal, your caseworker decides whether work registration applies to you and directs you to WorkForce West Virginia. Your SNAP application can stall or be denied until the registration is on file.

How to Register With WorkForce West Virginia

You have three options, and all three satisfy the same requirement.

Online. WorkForce West Virginia uses the MACC portal for job seeker registrations. You create an account, enter your employment history and skills, and submit the profile. The system timestamps your completion, and that’s what the DoHS uses to confirm compliance.

In person. Walk into any WorkForce West Virginia Career Center. Staff can take you through the whole registration on-site, which helps if your work history is complicated or you’d rather not do it online.

By phone. Call 1-800-252-JOBS (TTY: 304-558-1549). The wait is longer than the other two options, but it works if you don’t have reliable internet.

After you finish, WorkForce West Virginia notifies the DoHS electronically. You don’t need to deliver a printout to your caseworker. Save any confirmation number or email you receive anyway. Having your own record is cheap insurance if the electronic handoff ever fails.

What to Have Ready Before You Start

Gather these so you don’t have to stop halfway through:

  • Your Social Security number and a government-issued ID.
  • Your employment history — previous employers, job titles, and start and end dates going back several years.
  • Education records: diplomas, GEDs, college degrees, and any professional certifications or licenses.
  • Specific job skills, such as equipment operation, software, or trade skills. The portal uses these to match you with local openings.
  • A current phone number, mailing address, and email. Notices about your registration status and job matches go to whatever contact information you enter.

Accuracy matters beyond job matching. The DoHS cross-references your WorkForce data with your SNAP case, and a mismatched name, wrong Social Security number, or outdated address can hold up the verification that keeps your benefits moving.

What You Have to Keep Doing After You Register

Registering once isn’t the end of it. Under federal rules, work-registered SNAP recipients must accept a suitable job if offered, and cannot voluntarily quit a job or drop below 30 hours a week without good reason.3Food and Nutrition Service. Turn down a reasonable offer without that kind of justification and you face disqualification.

Some participants are also assigned to the SNAP Employment and Training (E&T) program, which layers additional requirements on top. Before any E&T placement, you’ll sign a Personal Responsibility Plan listing the activities you’re expected to do and when. That document is the benchmark your caseworker uses to judge whether you’re making satisfactory progress, so read it carefully before you sign.

The Stricter Rules for Adults Without Dependents

If you’re an able-bodied adult without dependents, known as an ABAWD, a separate time limit applies. ABAWDs can receive SNAP for only three months in any 36-month period unless they meet additional work activity requirements.5West Virginia Legislature. As of November 1, 2025, West Virginia classifies adults ages 18 through 64 as ABAWDs if they have no dependents and no qualifying disability.6West Virginia Department of Human Services. To keep benefits past the three-month limit, an ABAWD must meet at least one of these each month:

  • Work at least 20 hours per week, averaged monthly (80 hours per month).
  • Participate in an approved workforce training or education program at least 20 hours per week.
  • Volunteer 20 hours per week with an approved organization.
  • Any combination of work, training, and volunteering totaling 20 hours per week.

Miss the threshold in a month and you start burning through your three countable months. Once they’re used, you’re off benefits until the 36-month period resets or you regain compliance.

What Happens If You Don’t Comply

Penalties for failing to meet work requirements without good cause escalate each time:2eCFR. 7 CFR 273.7 – Work Provisions

  • First violation: disqualification for at least one month, with states allowed to impose up to three.
  • Second violation: at least three months, up to six at state discretion.
  • Third or later violation: at least six months, and the state may make it permanent.

Here’s the detail that catches people: waiting out the clock isn’t enough. You have to actually start complying — by taking a job, enrolling in training, or beginning a qualifying activity — before benefits can resume. Sitting out three months and reapplying without changing anything gets you nowhere.

If other people in your household also receive SNAP, only the person who failed to comply loses their portion. If the sanction stems from a WV WORKS (cash assistance) sanction, the SNAP penalty can’t run longer than the WV WORKS one, but you still have to serve the full penalty even if the WV WORKS case closes in the meantime.9West Virginia Department of Human Services. If you believe you had good cause for missing something — illness, a transportation emergency, a family crisis — tell your caseworker as early as possible. Documented good cause can keep the sanction from being imposed at all.

Challenging a Reduction or Termination

If the DoHS reduces or ends your SNAP because of a work registration issue, you can request a pre-hearing conference, a formal fair hearing, or both. You can do it in writing or verbally at your local office.10West Virginia Department of Human Services. Fair Hearing and Conference Request Form

You have 90 days from the effective date of the action to request the hearing. Timing within that window matters a lot. If you request the hearing before the reduction or termination takes effect, your benefits stay at their current level while the hearing is pending. Wait until after, and you still get the hearing, but you lose benefits in the meantime. Act the day the notice arrives rather than putting it in a pile.
