WV ABC Laws: Drinking Age, DUI Limits, and Sales Hours

West Virginia alcohol laws set 21 as the minimum age to buy beer, wine, or spirits, allow sales between 6:00 AM and 3:00 AM (with some counties pushing Sunday starts to 1:00 PM), make it illegal to drive with a blood alcohol concentration of 0.08% or higher, and leave room for individual counties and towns to tighten the rules further. The Alcohol Beverage Control Administration (WVABCA) enforces the statewide framework, and your county or municipality can layer additional restrictions on top of it.1West Virginia Alcohol Beverage Control Administration. Drinking Age and Identification

You must be 21 to purchase beer, wine, or spirits anywhere in the state. It is illegal to sell alcohol or nonintoxicating beer to anyone under 21, anyone who is visibly intoxicated, anyone addicted to a controlled substance, or anyone who lacks the mental capacity to consent.2West Virginia Legislature. West Virginia Code 60-3-22 – Sales to Certain Persons Prohibited Expect to show a government-issued photo ID at the register or the door. Refusing a sale when ID can’t be produced is not just permitted but protective for the business.

On the employment side, anyone at least 18 can lawfully work for a licensee, including pouring and serving alcoholic beverages.3West Virginia Legislature. West Virginia Code 60-3A-24 – Unlawful Acts by Persons That is more permissive than some neighboring states; an 18-year-old bartender is legal in West Virginia.

When Alcohol Can Be Sold

For on-premises establishments like restaurants, bars, and private clubs, sales are prohibited between 3:00 AM and 6:00 AM every day of the week.4West Virginia Legislature. West Virginia Code 60-7-12 – Certain Acts of Licensee Prohibited; Criminal Penalties A restaurant can pour its first drink at 6:00 AM and must stop at 3:00 AM.

Sunday is where it gets uneven. Under a county opt-in tied to § 7-1-3ss of the West Virginia Code, some counties push Sunday sales back to 1:00 PM.4West Virginia Legislature. West Virginia Code 60-7-12 – Certain Acts of Licensee Prohibited; Criminal Penalties Whether brunch at your local spot includes mimosas before noon depends on which side of that opt-in your county landed on.

Retail Stores

HB 2025, enacted in 2021, set the start time for beer, wine, and liquor sales at 6:00 AM every day for both on-premises and off-premises licensees.5West Virginia Legislature. House Bill 2025 Sunday retail hours for spirits remain subject to county-level restrictions, so not every liquor store opens early on Sundays.

DUI Limits and Penalties

The standard legal limit in West Virginia is 0.08% BAC. Drivers under 21 are capped at 0.02%, and a BAC of 0.15% or higher triggers aggravated penalties even on a first offense.6West Virginia Legislature. West Virginia Code 17C-5-2 – Driving Under the Influence of Alcohol, Controlled Substances, or Drugs; Penalties

  • First offense, BAC under 0.15%: misdemeanor, up to six months in jail, $100 to $500 fine, six-month license revocation.
  • First offense, BAC 0.15% or higher: misdemeanor with mandatory minimum jail time and harsher administrative consequences.
  • Second offense: misdemeanor, six months to one year in jail, $1,000 to $3,000 fine, 10-year license revocation.
  • Third or subsequent offense: felony, two to five years in state prison, discretionary $3,000 to $5,000 fine, lifetime license revocation.

Participation in the state’s test-and-lock (ignition interlock) program can shorten the revocation period in exchange for installing a device that requires a clean breath sample before the vehicle will start.6West Virginia Legislature. West Virginia Code 17C-5-2 – Driving Under the Influence of Alcohol, Controlled Substances, or Drugs; Penalties The real cliff is between the second and third offense: a misdemeanor becomes a felony with state prison time and a permanent record.

Open Containers in Vehicles

Federal law under 23 U.S.C. § 154 requires every state to prohibit open alcoholic beverage containers in the passenger area of a motor vehicle on public highways. An open container is any bottle, can, or receptacle that is open, has a broken seal, or has had its contents partially removed.7Office of the Law Revision Counsel. 23 USC 154 – Open Container Requirements West Virginia maintains an open container law, so any unsealed alcoholic beverage inside the passenger cabin is a potential citation.

Home Delivery and Wine Shipments

HB 2025 also opened the door to home delivery of beer, wine, and liquor through licensed retailers and authorized third-party delivery services.5West Virginia Legislature. House Bill 2025 Delivery personnel must hold specific permits, verify the recipient’s age in person at the door, and cannot leave alcohol unattended or hand it to anyone who appears intoxicated or underage.

Wineries shipping wine directly to West Virginia residents must first obtain a direct shipper’s license from the WVABCA, pass a background check, pay the applicable license fee, and collect state and local sales, municipal, and liter taxes as if the sale occurred at the delivery address.8West Virginia Legislature. West Virginia Code 60-8-6A – Direct Shipper’s License9Cornell Law Institute. West Virginia Code of State Rules 175-4-9 – Direct Shipment of Wine Shipping containers must be clearly labeled as containing alcohol and require an adult signature on delivery. The United States Postal Service prohibits mailing alcohol entirely, so shipments move through private carriers like UPS or FedEx.

Local Option Elections

State law is the floor, not the ceiling. Under West Virginia Code § 60-5-1, residents can vote on whether alcohol may be sold for off-premises consumption in their county or municipality.10West Virginia Legislature. West Virginia Code 60-5 – Local Option Elections A “no” vote triggers an order from the WVABCA commissioner to close all stores selling alcohol for off-premises consumption in that jurisdiction within 30 days. Communities that previously voted to restrict sales can later reconsider through the same procedures.11West Virginia Legislature. West Virginia Code 60-5-9 – Allowing State-Wide Off Premises of Alcoholic Liquors; Exceptions; Procedures

Municipalities also control whether to adopt earlier Sunday service hours. If a local government has not voted to approve expanded Sunday hours, the default state restriction applies. Two towns 20 minutes apart can have very different rules, so checking with your local government or the WVABCA before assuming statewide rules apply locally is worth the time.

Rules for Licensed Businesses

On-premises licensees cannot allow disturbance of the peace, obscene entertainment, lewd conduct, or illegal gambling on the premises.4West Virginia Legislature. West Virginia Code 60-7-12 – Certain Acts of Licensee Prohibited; Criminal Penalties A first violation for serving a visibly intoxicated person might bring a fine and mandatory staff retraining; repeated violations can lead to license revocation and forfeiture of surety bonds. Law enforcement also runs compliance operations using underage volunteers who attempt to buy alcohol, and a failed check can produce both administrative penalties and criminal charges against the employee who completed the sale.
