West Virginia Department of Transportation regulations govern how vehicles are titled and registered, how drivers are licensed, how often cars must be inspected, and how commercial carriers operate on state roads. Most of the rules sit in Title 17 of the West Virginia Code and are enforced by the Division of Motor Vehicles, the Division of Highways, and the West Virginia State Police. Here is what applies to you, whether you drive a passenger car, haul freight, or just moved to the state.
Registering and Titling a Vehicle
Every vehicle driven on public roads in West Virginia must be registered with the DMV. New residents get 30 days after establishing residency to title and register, using Form DMV-1-TR with proof of ownership and proof of insurance from a company licensed in the state.1WV Division of Motor Vehicles. New Residents Minimum liability coverage is $25,000 per person for bodily injury, $50,000 per accident for bodily injury, and $25,000 for property damage.2WV Division of Motor Vehicles. The base annual fee for a Class A passenger vehicle is $50. The DMV can adjust it every five years for inflation, with any single-year increase capped at 10 percent.3West Virginia Legislature. West Virginia Code 17A-10-3 A biennial option is available at double the fee for two years of coverage. Electric and hybrid owners pay a supplemental annual fee to offset lost fuel-tax revenue.
Titling costs $15, plus a 6 percent sales tax on the purchase price for vehicles worth more than $500, or a flat $30 for cheaper vehicles. Financed vehicles carry a $10 lien recording fee.4WV Division of Motor Vehicles. DMV Titles The 6 percent tax applies to private sales and gifts, with exemptions for transfers between spouses and between parents and children if the tax was already paid in West Virginia.5West Virginia Legislature. West Virginia Code 17A-3-4
Renewal is tied to county personal property tax. You cannot renew without a paid tax receipt or an exemption affidavit from the county assessor. Renewals can be done by mail, at a DMV regional office, through a DMV kiosk, or at participating sheriff’s offices for Class A passenger vehicles and motorcycles.6West Virginia Division of Motor Vehicles. Vehicles brought in from another state need a physical serial number inspection before a West Virginia title will issue, performed by the State Police or at an authorized inspection station.7Cornell Law Institute. W. Va. Code R. 91-2-9 – Physical Inspection of Serial Numbers New residents then have 10 days after titling to get a West Virginia safety inspection, though stickers from Louisiana, Mississippi, Missouri, New Hampshire, New York, Oklahoma, Texas, Utah, and Wyoming are honored until they expire under reciprocity.6West Virginia Division of Motor Vehicles. Driver Licensing in West Virginia
First-time drivers go through a three-stage Graduated Driver’s License program. The Level 1 instruction permit is available at 15 after a written knowledge test and vision screening. Before moving up to the Level 2 intermediate license at 16, permit holders must log 50 hours of supervised driving with at least 10 at night, certified by a parent, guardian, or responsible adult over 21.8West Virginia Legislature. West Virginia Code 17B-2-3A An approved driver’s education course can substitute for the 50-hour requirement.
Adult applicants need original documents proving identity, a Social Security number, and West Virginia residency. Identity can be shown with an original or certified U.S. birth certificate or a valid U.S. passport. Residency takes two documents such as utility bills no older than 60 days, a lease, or a bank statement.9West Virginia Department of Transportation. Acceptable Proof Documents Applicants transferring an out-of-state license must surrender it and pass a vision test.
A Class E license costs $5 per year of validity. A Class D license, which covers heavier non-commercial vehicles, is $6.25 per year. A motorcycle endorsement adds $1 per year.10West Virginia Legislature. West Virginia Code 17B-2-8 – Issuance and Contents of Licenses; Fees All renewal applicants must pass a vision screening under W. Va. Code ยง17B-2-12.
REAL ID
Federal REAL ID enforcement began on May 7, 2025. You now need a REAL ID-compliant license, or an acceptable alternative such as a valid passport, to board domestic flights and enter certain federal facilities.11Transportation Security Administration. REAL ID A West Virginia REAL ID requires the same identity, Social Security, and residency documents as a standard license, plus proof of any legal name changes through certified marriage certificates, divorce decrees, or court orders.9West Virginia Department of Transportation. Acceptable Proof Documents If you already hold a standard West Virginia license, you can upgrade at your next renewal or at a regional DMV office.
Safety Inspections
West Virginia switched from annual to biennial safety inspections on January 1, 2024. All registered motor vehicles, trailers, semi-trailers, and pole trailers must be inspected every 24 months. The sticker fee is capped at $19 for the full two-year period.12WV Division of Motor Vehicles. Vehicle Inspection
Inspections happen at official stations licensed by the State Police. The checklist covers registration, insurance, safety glass, body and frame, horn, mirrors, wipers, brakes, steering and front-end parts, exhaust, fuel system, tires, lights, and seat belts.13West Virginia State Police. Official Inspection Procedure If your vehicle fails, you have five days to make repairs and return to the same station for a reinspection of only the rejected items. Come back after five days and the station can require a complete reinspection at full cost.14West Virginia State Police. Rejection Procedure
Commercial Driver’s License Rules
A CDL is required to operate a commercial vehicle, and the class depends on weight and cargo. Class A covers combination vehicles with a gross combination weight rating of 26,001 pounds or more when the towed unit is rated above 10,001 pounds, which includes most tractor-trailer rigs. Class B covers single vehicles rated at 26,001 pounds or more towing a unit under 10,001 pounds, including straight trucks and large buses. Class C covers lighter vehicles that carry 16 or more passengers (driver included) or transport placarded hazardous materials.15West Virginia Division of Motor Vehicles. WV Commercial Driver’s License Manual
CDL holders who self-certify as non-excepted interstate or intrastate drivers must keep a valid FMCSA Medical Examiner’s Certificate on file with the DMV. The physical has to be done by a certified medical examiner on FMCSA’s National Registry, and the certificate is good for up to two years. Let it expire without filing a new one within 30 days and the DMV downgrades your CDL to a standard Class E license.16WV Division of Motor Vehicles. Commercial Driver’s License School bus drivers and CDL holders at government agencies generally fall under excepted status and are exempt from FMCSA medical rules.
Disqualification
A first DUI conviction in any vehicle results in a one-year CDL disqualification, or three years if the driver was hauling placarded hazardous materials. A second DUI or test refusal in a separate incident triggers a lifetime disqualification. Lifetime disqualification can be reconsidered after 10 years if the driver completes the Safety and Treatment Program or an equivalent. Using a commercial vehicle to commit a felony involving controlled substances or human trafficking brings permanent, non-reinstatable disqualification.17West Virginia Legislature. West Virginia Code 17E-1-13 – Disqualification
Lesser moving violations like speeding 15 mph or more over the limit, reckless driving, or improper lane changes carry a 60-day disqualification for a second conviction within three years and 120 days for a third within three years.17West Virginia Legislature. West Virginia Code 17E-1-13 – Disqualification
Weight Limits and Oversize Permits
West Virginia follows the federal bridge formula and caps maximum gross vehicle weight at 80,000 pounds for common tractor-semitrailer combinations with five or more axles, with a 10 percent tolerance. Single axles max out at 20,000 pounds and tandem axles at 34,000 pounds.18West Virginia Legislature. West Virginia Code 17C-17-9a – Gross Weight of Vehicles and Loads Weigh stations on major routes and mobile enforcement units check compliance, and overweight trucks must offload before continuing.
Fines for overweight coal-hauling trucks are calculated per pound over the limit and escalate in tiers from 1 cent per pound (1 to 4,000 pounds over) up to 45 cents per pound (more than 40,000 pounds over). A second or subsequent conviction within two years roughly doubles most tiers. A truck 25,000 pounds over the limit faces a first-offense fine of $7,500 and a repeat-offense fine of $10,000. These fines are mandatory. Judges cannot waive or reduce them. Shippers or receivers who knowingly direct overloading face the same fines as the operator.19West Virginia Legislature. West Virginia Code 17C-17A-10 – Penalties for Violation of Weight Laws
Loads exceeding standard dimensions need a Division of Highways permit before they move. The thresholds are more than 8 feet 6 inches wide, more than 13 feet 6 inches tall, or more than 65 feet long for combination vehicles. Single-trip permits run $20 for overdimensional or overweight loads, with an added 4 cents per ton-mile for overweight movements. Superload permits cover anything beyond single-trip limits and have no fixed weight or dimension cap, but each requires a bridge analysis and a suitable route.20WV Department of Transportation. Permit Information Larger loads require escort vehicles, with the exact configuration depending on width, length, height, and road type; individual DOH districts and the Parkway Authority can impose stricter requirements than the baseline.
Interstate Carrier Obligations
Carriers running across state lines with vehicles over 26,000 pounds gross weight or with three or more axles must register under the International Registration Plan. IRP lets you pay proportional registration fees to your base state based on miles traveled in each jurisdiction, instead of registering separately in every state.21WV Division of Motor Vehicles. IRP and IFTA
Qualifying carriers also report fuel purchases and miles traveled through the International Fuel Tax Agreement. IFTA returns go to the West Virginia State Tax Department quarterly. A late return triggers a penalty of 10 percent of the tax due or $50, whichever is greater, assessed per month.22West Virginia State Tax Department. International Fuel Tax Agreement Quarterly Report
Penalties for Noncompliance
Failing to register a vehicle, letting registration expire, or driving without a valid license all draw fines. Specific amounts vary because municipal courts set their own schedules, but expect figures in the low-to-mid hundreds of dollars plus court costs. Repeat offenses lead to higher fines and possible suspension of driving privileges. Commercial drivers operating without proper credentials face steeper penalties, and employers who put unlicensed drivers behind the wheel can also be fined.
Running an oversized load without a permit brings a separate fine and mandatory offloading of excess cargo. Repeated permit violations can draw FMCSA scrutiny that affects a carrier’s safety rating and interstate operating authority. Commercial vehicles are also subject to roadside inspections by the State Police and Division of Highways, which check mechanical condition, driver credentials, and cargo securement against FMCSA standards; failure can mean fines, an out-of-service order on the spot, or suspension of the carrier’s registration.
