WV Farm Tax Exemption Form: Eligibility, Filing, and Denials

West Virginia does not offer a farm property tax “exemption” in the strict sense; what the state offers is farm use valuation, and you apply for it by filing a Farm Use Valuation Application (the WV farm tax exemption form most people are searching for) with your County Assessor between July 1 and September 1 each year. The valuation replaces market-based property values with rates tied to what the land actually produces, which can substantially lower your tax bill. To keep it, you have to refile every year, meet the state’s definition of a farm, and get the paperwork in before September 1.

Who Qualifies

West Virginia Code ยง 11-1A-3 defines a farm as land currently used primarily for farming that was also used for farming at least seasonally during the year before the current tax year.1West Virginia Legislature. West Virginia Code 11-1A-3 The word “primarily” does real work here. If the main use of your property is residential or recreational, the land will not qualify no matter how much you grow in a backyard plot or how many chickens you keep.

The income thresholds turn on acreage. Five acres or more must produce at least $1,000 in annual value from agricultural products, counting sales, your own consumption, or use on the farm. Fewer than five acres must produce at least $500, and that amount must come from actual sales of farm products.2Cornell Law Institute. Corporations have an extra test. A corporate owner qualifies only if its principal activity is farming, and if a parent corporation holds the controlling stock, that parent must also be primarily engaged in farming.3West Virginia State Tax Department. Valuation of Farmland in West Virginia

What Counts as Farming

The statute defines farming broadly. Producing livestock, poultry, fruit, vegetables, grains, hay, honey, syrups, tobacco, horticultural products, nursery stock, Christmas trees, ornamental trees, sod, and seed all count, whether for sale, consumption, or use.1West Virginia Legislature. One important boundary: commercial forestry and growing timber for sale do not qualify.2Cornell Law Institute. West Virginia Code of State Rules 110-1A-2 – Valuation of Farmland and Structures Situated Thereon for Ad Valorem Property Tax Purposes Woodland can be listed on your application as part of the acreage breakdown, but timber sales cannot be used to hit the $500 or $1,000 threshold. Christmas tree farms, orchards, and nursery stock are carved out from the timber exclusion and do qualify.

The Homesite Is Assessed Separately

Even on a qualifying farm, the one acre immediately around your principal residence is valued as a homesite using the same method applied to nearby non-farm homes, taking into account location, resale value, and accessibility.1West Virginia Legislature. West Virginia Code 11-1A-3 On a 50-acre farm, 49 acres get the farm rate and the acre under your house does not. The rest of the land keeps the agricultural valuation.

What to Gather Before You File

Pulling records together before you open the form prevents most delays. You need four things.

  • An acreage breakdown that divides your land into pasture, cropland, woodland, and wasteland. The assessor applies different per-acre rates to each category, so the numbers should match what a person would see on the property.
  • Livestock counts as of July 1, including cattle, sheep, poultry, goats, horses, and any other farm animals.
  • Financial records showing the gross value of agricultural products you sold, consumed, or used during the previous calendar year. These are how you prove the income threshold.
  • Your parcel information from your most recent property tax bill, including district, map, and parcel numbers.

If someone else farms your land under a lease, you still file the application as the owner. You will need the operator’s name, address, and phone number, and you are responsible for making sure the operator files the WV State Farm Census Report and Personal Property Assessment on their end.4Marion County, West Virginia. How and When to File

The filing window is July 1 through September 1. Applications received after September 1 are denied, and the property is assessed at full market value for the following tax year.5Boone County Assessor. Farms There is no grace period.

The state runs an online portal at farmcensus.wvda.us, which is the fastest way to file and gives you electronic confirmation. You can also file on paper in person or by certified mail through your County Assessor’s office. If you filed last year, many assessor offices will send you a preprinted form with your parcel and acreage information already populated. Verify every field before signing. Outdated acreage or a wrong parcel number carried forward from a prior year can trigger problems that surface months later.

Filling Out the Form

The top of the application captures your identity and parcel information. Check every digit in the parcel IDs. A transposed number can link your application to another property and create a mess you may not notice until the valuation notice arrives.

The land-use tables ask you to enter acres by category: permanent pasture, cropland, woodland, and wasteland. The state applies different per-acre values to each category, so a farm with 30 acres of cropland and 20 acres of wasteland is valued very differently from one with the reverse split. Be accurate. Claiming wasteland as cropland invites a field visit and possible denial.

Complete the livestock and crop production sections in full. Blank fields can look like an incomplete form and prompt additional review, even when your numbers are small.

After You File

The assessor’s office reviews your application against its records and may visit the property to confirm that what you reported matches what is there. Your updated valuation notice usually arrives early in the following year and reflects the farm use rates for the upcoming tax year.

This is not a one-time filing. You have to resubmit between July 1 and September 1 every year. Miss a year and your land reverts to full market-value assessment. The most common reason farms lose the valuation is not that farming stopped, but that the annual paperwork slipped.

If Your Application Is Denied

You can challenge a denial before the county commission sitting as the Board of Equalization and Review, which convenes no later than February 1 of the tax year.6West Virginia Legislature. West Virginia Code 11-3-24 You must appear at that meeting to ask for relief. Not showing up waives your right to correct the assessment through the county process for that year.

If the Board rules against you, the next step is the state Office of Tax Appeals. That appeal must be filed by March 31 of the property tax year. If Your Land Is Mostly Woodland

Because commercial timber does not qualify under farm use valuation, West Virginia runs a separate Managed Timberland Program for landowners with substantial woodland. It requires at least 10 contiguous wooded acres, agreement of all owners, and a timberland management plan (which you have until the end of the second year after filing the contract to develop with a professional forester). Annual certification goes to the Division of Forestry between March 1 and September 1. Falsifying the certification or failing to follow a professionally prepared plan costs you the valuation. The program is separate from farm use valuation, with different forms, agencies, and deadlines. A property with both productive farmland and a large wooded tract can be filed under each program for the respective portions.
