WV Learner’s Permit Requirements, Tests, and Restrictions

To get a West Virginia learner’s permit, you must be at least 15 years old, pass a vision screening and a written knowledge test at a DMV regional office, and pay a $7.50 fee.¹ The credential is officially called a Level 1 Instructional Permit, and if you’re under 18 it sits inside the state’s Graduated Driver License program, which adds school-enrollment rules, parental consent, and strict driving restrictions on top of the basic requirements.²

Who Can Apply

The minimum age is 15. Nothing you do before your fifteenth birthday moves that date up.

If you’re under 17, you also have to be enrolled in school and making satisfactory academic progress, or otherwise comply with West Virginia’s compulsory attendance laws.² Your county school board issues a verification form the DMV requires with your application. During the school year the form is typically good for 30 days; a form obtained over the summer holds until the next term begins. Enrollment isn’t just a starting-line check. If you drop out or your grades collapse while you hold the permit, your driving privileges are on the line.

Documents You Need to Bring

West Virginia issues credentials under the federal REAL ID framework, so the DMV wants originals in specific categories: one proof of identity, one proof of your Social Security number, and two proofs of your current West Virginia address.³

For identity, most applicants bring a certified birth certificate or a valid U.S. passport. Photocopies don’t count. Bring the original Social Security card, not a printout. The two residency documents need to show your physical West Virginia street address. Minors usually rely on a parent or guardian at the same address, using utility bills, bank statements, or government mail.

Since REAL ID enforcement began on May 7, 2025, a credential issued without meeting these documentation standards will not work for boarding domestic flights or entering certain federal buildings.⁴

Parental Consent

Every applicant under 18 needs written consent from a parent or legal guardian, signed on DMV form DS-23P. The signature must either be witnessed by a DMV employee at the counter or notarized ahead of time.⁵ Married applicants under 18 don’t need parental consent but must bring a certified copy of the marriage certificate.

The Two Tests at the DMV

The vision screening comes first. You need 20/40 acuity or better using both eyes, with or without corrective lenses.⁶ If you have vision in only one eye, that eye must meet the same 20/40 standard.⁵ The screener may also check depth perception, color recognition, and peripheral vision. Passing only with glasses or contacts puts a corrective-lens restriction on your permit.

The knowledge test is a computer-based exam of at least 25 questions covering traffic laws, road signs, and pavement markings from the West Virginia Drivers Licensing Handbook. You need 19 correct to pass, and there’s a time limit. Any question left unanswered when time runs out counts wrong.⁵ Audio versions are available for applicants with reading difficulties.

Fail, and you have to wait at least one week to retest. Your $7.50 fee covers up to two attempts; a second failure means paying again before a third try.⁷

Fee and What You Leave With

The permit costs $7.50, paid at the DMV window when you submit your documents.¹ Once you pass both tests, you walk out with a temporary paper permit that lets you begin supervised driving that same day. Your permanent plastic card arrives in the mail within 10 to 15 business days.³

How Long the Permit Lasts

A Level 1 permit issued to someone under 18 stays valid until 30 days after the holder’s eighteenth birthday, and it cannot be renewed.² For a 15-year-old that means roughly three years of runway. Active military members get an extension to 180 days after turning 18. Applicants who are already 18 or older when they apply get a different product: a 60-day instruction permit that can be renewed once for another 60 days without retaking the exam.¹

Restrictions While You Hold the Permit

The permit is a practice license, not a driving license. Every restriction below comes from the graduated licensing statute and is enforced against the driver, not the supervising adult.²

A licensed driver at least 21 years old, or your driver’s education instructor, must sit in the front passenger seat whenever you drive. That person must be alert and unimpaired.
No more than two passengers beyond the supervising adult, unless the extra passengers are family members.
You can only drive between 5:00 a.m. and 10:00 p.m.
No cell phone, no texting, no hands-free devices. The only exception is calling 911 in an emergency.
Anyone under 21 with any measurable alcohol in their system faces the same DUI consequences as an adult.
Every occupant must wear a seatbelt while the vehicle is in motion, regardless of seating position.

Wireless Device Penalties

The phone ban is the restriction most likely to catch a new driver off guard, and West Virginia treats violations as misdemeanors that escalate within any 24-month window. A first offense is a fine of up to $100. A second is up to $200. A third or later offense is up to $350, three points on your driving record, and a possible 90-day license suspension at the court’s discretion. Heavier penalties apply if a phone-related violation causes property damage or injury.⁸ Even a first citation is a problem for a permit holder, because a conviction resets your path to a Level 2 license.

Moving Up to a Level 2 Intermediate License

The permit is a stepping stone. To advance to a Level 2 Intermediate License you must be at least 16 and meet all three of these:

Held the Level 1 permit for at least 180 consecutive days with no convictions during that period.
Completed an approved driver education course, or logged 50 hours of behind-the-wheel practice with at least 10 of those hours at night, certified by a parent or guardian on the required form.
Passed a behind-the-wheel road skills test administered by the DMV.

Both the 180-day clean holding period and the practice hour requirements come from the graduated licensing statute.² Any conviction during that 180 days resets the clock. A ticket at month five puts you back at day one, which is why the curfew, passenger, and phone rules matter well beyond their fines.

Insurance While You Practice

If you’re driving a family car, you’re generally covered under your parent’s auto policy while you hold a Level 1 permit. Most insurers don’t charge extra during the permit stage because you’re always supervised. Even so, notify the insurance company when the permit is issued. Some carriers require the permit holder to be added to the policy formally; others extend coverage automatically to household members. Premiums typically rise once you earn the Level 2 license and start driving unsupervised.
